Ordinance Number 801181 ORDINANCE NO. 8oi AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADDING TEXT TO PART II OF COMPREHENSIVE DEVELOPMENT PLAN 78-1, ORTEGA PLANNED COMMUNITY, AND ESTABLISHING PLANNING SECTOR B-2 WITHIN THAT DOCUMENT THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: WHEREAS, the proposed text amendment to Comprehensive Development Plan 78-1, Ortega Planned Community, constitutes language which is consistent with the intent and purpose of that Plan; and, WHEREAS, the proposed uses, including assisted living homes, skilled nursing facilities, Alzheimer's care, and senior housing as established by the newly -created Planning Sector B-2 are consistent with other uses within the planning area of Comprehensive Development Plan 78-1; and, WHEREAS, the proposed development standards will provide for a built environment which is aesthetically pleasing and which will be consistent with existing structural design and site planning of the surrounding area; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act and has issued a Negative Declaration and caused a Notice of Negative Declaration to be posted pursuant to the City's Environmental Review Guidelines and any applicable mitigation measures have been included herein as conditions of approval, and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and, WHEREAS, the Ordinance is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan in that the public institutional and senior residential uses proposed within the amended text are consistent with other uses in the immediate area and will, therefore, facilitate thoughtful development as promoted in the Land Use Element; and, WHEREAS, the Planning Commission conducted a duly -noticed public hearing on September 23, 1997 and recommended that the City Council adopt the Ordinance. Based upon the findings set forth in Section 1, preceding, the following amendments to Comprehensive Development Plan 78-1 are hereby enacted to establish a Planning Sector B-2: -1- 182 Planning Sector B-2 A. Purpose and Intent. The purpose of these regulations is to create a high- quality, planned development that provides for professional and medical offices, specialized housing and other services that cater to seniors. The specialized senior housing uses meeting this intent include senior apartments, congregate care, assisted living, skilled nursing, dementia or Alzheimer's care and other services which support the permitted uses. B. Principal Uses Permitted 1. All principal uses permitted in Planning Sectors B and B-1 2. Professional medical offices 3. Medical testing facilities or laboratories in support of the medical offices 4. Senior apartments 5. Congregate care facilities that provide dining, recreational, and other activities for seniors, with apartments of no less than 400 square feet. 6. Assisted living facilities which incorporate dining, recreational, and other activities for seniors with units of no less than 300 square feet. No more than 50% of such facilities can be dual occupancy or semi- private units. 7. Alzheimer's care facilities. € 8. Skilled nursing facilities >f 9. Support services for seniors such as: pharmacy, physical therapy, and adult day care. C. Conditional Uses. All Conditional Uses listed and described in Planning Sector B. D. Uses Not Listed. Any use not listed may be permitted as a conditional use subject to the review and approval of the Planning Commission. E. Area Plan Requirements. See Planning Sector A-1. F. Development Standards. 1. Minimum Lot Size: One (1) net acre 2. Minimum Building Setbacks: Adjacent to Rancho Viejo Road - 50 feet. Adjacent to Calle Arroyo and Paseo Espada - 25 feet. 3. Minimum Landscape Setbacks: Adjacent to Rancho Viejo Road, Paseo Espada, and Calle Arroyo - 10 feet. 4. Maximum Building Height: 2 stories and no greater than 35 feet. 5. Minimum Open Space: 30% 6, Architectural Design: Building plan shall reflect a style consistent with traditional Spanish or early California Architecture and in conformance with the City's adopted Architectural Design Guidelines. -2- 18? SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duty designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
