ORDINANCE NO. 857
AN AMENDMENT TO TITLE 2. CHAPTER 2. ADMINISTRATION OF THE MUNICIPAL
CODE REGARDING ARTICLE 7. PLANNING COMMISSION AND ARTICLE 11
DESIGN REVIEW COMMITTEE
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA AMENDING ARTICLE 7 REGARDING THE NUMBER OF
MEMBERS TO THE PLANNING COMMISSION AND THEIR DUTIES, AND
ADDING ARTICLE 11 ESTABLISHING THE DESIGN REVIEW
COMMITTEE TO THE MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1 FINDINGS
Whereas, the City Council desires to amend the number of members to the
Planning Commission and to add a provision to appoint a member at -large to the Design
Review Committee; and,
Whereas, the City Council, on May 15, 2001, initiated consideration of the
amendment to Title 2, Chapter 2 to implement the above changes; and,
Whereas, the amendment is not considered a project under the definitions
contained in the California Environmental Quality Act; and,
Whereas, the City Council conducted a duly noticed public hearing on June
5, 2001 to consider public testimony on the proposed project.
SECTION 2 AMENDMENT TEXT
Based upon the findings set forth in Section 1 preceding, the following amendments to the
Municipal Code are hereby enacted:
Article 7, Planning Commission. The following modifications are hereby made to
said Article:
a. Section 2-2.702, Membership to read in its entirety..."The Planning
Commission shall consist of five (5) members.

b. Section 2-2.703, Duties, amend section (f) to read in its entirety..."To appoint
two (2) members of the Planning Commission to serve on the Design Review
Committee to review and make recommendations to the Planning Commission on
development proposals processed in accordance with Title 9, Chapter 2, Article 2,
Section 9-2.306.
2. Article 11, Design Review Committee. Add Article 11 to read in its entirety:
a Section 2-2.1101. Created.
A Design Review Committee for the City is hereby created.
b. Section 2-2.1102. Membership.
The Design Review Committee shall consist of three members, two (2)
Planning Commissioners appointed bythe Planning Commission and one (1)
member -at -large appointed by the City Council that has a design background
in either planning, architecture, landscape architecture or other similar
experience related to the design of physical improvements and buildings.
C. Section 2-2.1103. Duties.
The Design Review Committee shall undertake and have the following
duties, responsibilities and functions, together with the powers thereto:
(a) The Design Review Committee shall review and make
recommendations to development applicants on the design of projects for
compliance with the goals and policies of the City's General Plan Community
Design Element and adopted Architectural Design Guidelines and other
policies regarding the design of projects that are processed in accordance
with Title 9, Chapter 2, Article 2, Section 9-2.306 of this Code:
(b) To undertake such other duties as may be assigned by the City
Council.
SECTION 3 EFFECTIVE DATE
This Ordinance shall take effect and be in force thirty (30) days after its passage.
SECTION 4 CITY CLERKS CERTIFICATION
The City Clerk shall certify to the adoption of this Ordinance and cause the same to be
posted at the duly designated posting places within the City and published once within
fifteen (15) days after passage and adoption as required by law; or, in the alternative, the
City Clerk may cause to be published a summary of this Ordinance and a certified copy of
the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior
to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the
City Clerk shall cause to be published the aforementioned summary and shall post a
certified copy of this Ordinance, together with the vote for and against the same, in the
Office of the City Clerk.
