Ordinance Number 852163 ORDINANCE NO. 852 APPROVING REZONE 00-3, SERRA VISTA OFFICE BUILDING AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CHANGING THE CURRENT ZONING DESIGNATION ON PROPERTY LOCATED AT 30300 CAMINO CAPISTRANO, BETTER KNOWN AS ASSESSOR'S PARCEL NUMBER 649-361-07, FROM GM (GROWTH MANAGEMENT) TO CO (COMMERCIAL OFFICE) AND AMENDING THE CITY'S OFFICIAL ZONING MAP TO REFLECT THIS CHANGE (SERRA VISTA OFFICE BUILDING) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. 1. The proposed rezone has been processed pursuant to the requirements of Land Use Code Sections 9-2.301 and 9-2.302; and, 2. In the determination of staff, the area to be covered by this amendment of the City's Official Zoning Map will allow an effective integration of Commercial Office uses; and, 3. The Environmental Administrator has reviewed the project and an initial study has been prepared pursuant to Section 15063 of the California Environmental Quality Act Guidelines and, pursuant to Section 15070 of the California Environmental Quality Act Guidelines, has issued a mitigated negative declaration and caused a Notice of Negative Declaration to be posted pursuant to Section 15072 of the California Environmental Quality Act Guidelines, and all mitigation measures have been included herein as conditions of approval, and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and, 4. The proposed rezone is consistent with the goals, policies, and objectives of the San Juan Capistrano General Plan in that the principal, accessory, and conditional uses provided for within the Commercial Office District are consistent with surrounding uses in the immediate area and will provide for a development consistent with the intent of the Land Use Element; and, 5. The Planning Commission conducted a duly -noticed public hearing on October 24, 2000, and recommended that the City Council adopt the rezone; and, 6. The City Council conducted a duly -noticed public hearing on November 21, 2000, pursuant to Section 9-2.313 of the Municipal Code to consider testimony, either in favor of or in opposition to the proposed rezone. -t- 164 SECTION 2. Amended Area. The property located at 30300 Camino Capistrano, and better known as Assessor's Parcel Number 649-361-07 is hereby designated a Commercial Office (CO) District on the City's Official Zoning Map. passage. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
