ROLL CALL: COUNCIL MEMBERS PRESENT: Roy L. Byrnes, M.D., Derek Reeve, Larry Kramer, Mayor pro tem Sam Allevato and Mayor John Taylor COUNCIL MEMBERS ABSENT: None. PLANNING COMMISSIONERS PRESENT: Ian Gardiner, Evan Chaffee, Roy Nunn, Vice -Chair Tim Neely and Chair Sheldon Cohen PLANNING COMMISSIONERS ABSENT: None. PLEDGE OF ALLEGIANCE: Chair Cohen ORAL COMMUNICATIONS: • Dennis Holan, City resident. DISCUSSION ITEM: C1. CONSIDERATION OF DUTIES AND EXPECTATIONS FOR THE PLANNING COMMISSION (110.10) Nelson Miller, Interim Development Services Director, provided a staff report and responded to questions. Council Action: Moved by Council Member Kramer, seconded by Mayor pro tem Allevato, and carried unanimously to direct staff to include design review of projects to the Planning Commission duties, including all the former duties of the Design Review Committee. C2. CONSIDERATION OF 2008-2014 HOUSING ELEMENT STATUS, TASKS TO COMPLETE THE 2008-2014 HOUSING ELEMENT OBJECTIVES, AND REVIEW 2014-2021 HOUSING ELEMENT QUANTITATIVE GOALS (440.20) Nelson Miller, Interim Development Services Director, provided a staff report and responded to questions. 1 8/7/2013 Council Action: Moved by Council Member Byrnes, seconded by Council Member Kramer, and carried unanimously to approve the appropriation of $15,000 from the General Fund Reserves to Planning Services, Professional and Contract Services (Account Number 01-62100-62501-0000-000) to assist staff in the completion of a Draft 2014-2021 Housing Element for submittal to the State Department of Housing and Community Development. C3. CONSIDERATION OF POLICY DIRECTION FOR THE HISTORIC TOWN CENTER MASTER PLAN AND FORM -BASED CODE; AND ADOPTED MASTER PLAN AND FORM -BASED CODE FOR THE 150 ACRE HISTORIC TOWN CENTER PLANNING AREA AND INITIATE THE DISCRETIONARY USE PERMIT (DUP) REVIEW PROCESS FOR THE PROPOSED RECONSTRUCTION OF THE MCDONALDS RESTAURANT (400.20) Bill Ramsey, Assistant Development Services Director, provided a staff report and responded to questions. • Public Comments: Laura Freese, City resident; and Ross Pollard, McDonalds Owner. Council Action: Moved by Mayor pro tem Allevato, seconded by Council Member Reeve, and carried unanimously to 1) confirm the Development Services Director's determination of Form Based Code Section 2.3C that rezoning the "TCE" (Town Center Edge) Zone District requires express legislative action by the City Council; 2) approve initiation of a Discretionary Use Permit (DUP) review process for the "drive-through facilities" for the proposed reconstruction of the McDonalds Restaurant on Del Obispo Street.
