11-0322_CC_Minutes_Special MeetingMINUTES March 22, 2011 SAN JUAN CAPISTRANO CITY COUNCIL SPECIAL MEETING BUSINESS SESSION: Mayor Allevato called the Special Meeting of the City Council of the City of San Juan Capistrano to order at 9:04 a.m. in the City Council Chamber. Mayor pro tem Kramer fed the Pledge of Allegiance. ROLL CALL COUNCIL MEMBERS PRESENT: Laura Freese, Derek Reeve, John Taylor, Mayor pro tem .Kramer, and Mayor Allevato COUNCIL MEMBERS ABSENT: None Agenda items are presented in the originally agendized format for the benefit of the minutes' reader, but were not necessarily heard in that order. ORAL COMMUNICATIONS/CLOSED SESSION PUBLIC COMMENTS: None COUNCILMANIC ITEMS: 1. DISCUSSION AND FORMATION OF THE AUDITING FINANCIAL AD-HOC COMMITTEE (110.10) Cindy Russell, Chief Financial Officer/Treasurer, and Laura Rocha, Accounting - - Manager, responded to -questions -- - - --- -- -- --- - -- - - Public Comments: • Clint Worthington, City resident, felt that the purpose of the committee is to bring transparency and requested for an independent audit. • John Perry, City resident, provided resume; and felt that he has adequate background and experience to serve on the ad-hoc committee. • Ian Smith, City resident, suggested appointing residents Jim Reardon and John Perry to the ad-hoc committee. • Lennie DeCaro, City resident, suggested to continue with the approved ad-hoc committee, not a mayoral sub -committee; and supported the appointment of Ray Miller, Jim Reardon and John Perry. • Kim Lefner, City resident, expressed concern with excluding individuals from appointment to the ad-hoc committee; and spoke in support of appointing Jim Reardon and John Perry. • Kim McCarthy, City resident, felt it was important for the ad-hoc committee to select an independent auditor; and supported the appointment of Jim Reardon and John Perry. • Orrie Brown, City resident, questioned the intent and impression of a committee. 3/22/2011 Council Comments: • Clarified that the intent of the City Council was to form an ad-hoc committee, not a mayoral subcommittee; the Mayoral Budget Subcommittee comprised of Mayor Allevato and Council Member Reeve were to appoint impartial members of the public with financial background to the ad-hoc committee; preference in selecting Ray Miller, Utilities Commissioner and an individual with auditing knowledge, or with a Certified Public Accountant (CPA) background; and withdrew objection to select Jim Reardon and John Perry to the ad-hoc committee. • Felt that the City Council should be involved every year with the City's annual audit; and felt that the committee should be comprised of individuals with strong financial background. • Preference in appointing Jim Reardon and John Perry to ad-hoc committee as they have practical knowledge in finance, knowledge of government and are critics of the Utilities Department and the Community Redevelopment Agency. • Important for the ad-hoc committee to have a narrow role such as focusing on areas within the Utilities Department and the Community Redevelopment Agency, in order not to lose its value. • Important for the members of the ad-hoc committee to be impartial. CLOSED SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54957, the City Council considered the appointment or employment of an Interim City Manager. b. Pursuant to Government Code Section 54957.6, the City Council conferred with its labor negotiator (Council Committee) as to the salary of the Interim City Ma'eager (un'represented employee): C. Pursuant to Government Code Section 54957, the City Council considered the appointment or employment of a City Manager. ANNOUNCEMENT OF CLOSED SESSION ACTIONS: No reportable actions took place in Closed Session.
