10-1210_CC_Minutes_Special MeetingMINUTES December 10, 2010 SAN JUAN CAPISTRANO CITY COUNCIL SPECIAL MEETING BUSINESS SESSION: Mayor Allevato called the Special Meeting of the City Council of the City of San Juan Capistrano to order at 9:00 a.m. in the City Council Chamber. Mayor pro tem Kramer led the Pledge of Allegiance. ROLL CALL COUNCIL MEMBERS PRESENT: Laura Freese, Derek Reeve, John Taylor, Mayor pro tem Kramer, and Mayor Allevato COUNCIL MEMBERS ABSENT: None Agenda items are presented in the originally agendized format for the benefit of the minutes' reader, but were not necessarily heard in that order. ORAL COMMUNICATIONS/CLOSED SESSION PUBLIC COMMENTS: None COUNCILMANIC ITEMS: 1. APPOINTMENTS OF CITY COUNCIL REPRESENTATIVE TO OUTSIDE AGENCIES AND SUBCOMMITTEES (610.60) Maria Morris, City Clerk, summarized the agenda report. CITY MANAGER a. DISCUSSION REGARDING CITY MANAGER RECRUITMENT (730.20) Kathleen Springer, Human Resources Manager, provided a staff report and responded to questions. Council Comments: • Under Current Issues and Opportunities, preference in removing "Managing and Operating City -Owned Utilities, including a Ground Water Recovery Plant and GAC Expansion" and "Doing more with less, especially with a very active City Council". • Under The Ideal Candidate, preference in adding "Broad knowledge and experience in working with an organization that has its own utilities", - "Demonstrated ability and experience with Economic Development', - "Experience in Downtown Rehabilitation", "The ability to market the City as a Destination",- Historic Preservation and Conservation experience" - "Communicates City Council decisions effectively to the residents"; and removing "Has experience working with and managing utilities", "Has personal strengths and skills to deal effectively with strong willed Council Members and Commissioners". • Preference in listing the benefits without an attached dollar amount, and the salary rage to be based on 25-75 percentile of comparable cities. 3 12/10/2010 Council Motion: Moved by Council Member Freese, seconded by Mayor pro tem Kramer; and carried unanimously to direct staff to revise the City Manager Recruitment Brochure with the following changes: • Remove from Current Issues and Opportunities: "Managing 'and Operating City -Owned Utilities, including a Ground Water Recovery Plant and GAC Expansion" and "Doing more with less, especially with a very active City Council'. • Remove from The Ideal Candidate: "Has experience working with and managing utilities'; "Has personal strengths and skills to deal effectively with strong willed Council Members and Commissioners". • Add under The Idea[ Candidate: "Broad knowledge and experience in working with an organization that has its own utilities", "Demonstrated ability and experience with Economic Development", "Experience in Downtown Rehabilitation'; "The ability to market the . CLOSE© SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9(c), the City Council conferred with legal counsel pertaining to one potential item for initiation of litigation. b. Pursuant to Government Code Section 54956.9(b), the City Council conferred with legal counsel pertaining to an item of significant exposure to litigation pertaining to facts or circumstances not yet known to a potential plaintiff. c. Pursuant to Government Code Section 54956.8, the City Council meet with its Real Property Negotiator (City Manager) concerning the price and terms of payment for the purchase, sale, exchange or lease of certain real property known as 31910 and 31920 Del Obispo (Serra Plaza), in the City of San Juan Capistrano, California. The property owner's negotiating party is Bill Griffith of Rivendell land Company, I nc. d. Pursuant to Government Code Section 54956.9(a), the City Council conferred with legal counsel pertaining to existing litigation in the writ of mandate matter of Scalzo vs. City of San Juan Capistrano. e. Pursuant to Government Code Section 54956.9(a), the City Council conferred with legal counsel pertaining to existing litigation in the complaint for damages matter of Scalzo vs. City of San Juan Capistrano. 4 12/10/2010 f. Pursuant to Government Code Section 54956.9(b), the City Council conferred with legal counsel pertaining to one potential item of significant exposure to litigation regarding the claim for damages brought by Dr. and Mrs. Victor Cachia and Los Cerritos, LLC pertaining to proposed development of an office building at 31551 Avenida Los Cerritos. g. Pursuant to Government Code Section 54956.9(a), the City Council conferred with legal counsel pertaining to existing litigation in the matter of City of San Juan Capistrano v. State of California Dept. of Transportation (Caltrans). h. Pursuant to Government Code section 54957, the City Council did not considered the employment of a City Manager. i. Pursuant to Government Code section 54957.6, the City Council did not meet with its labor negotiator (Council committee) pertaining to the compensation of an unrepresented employee (City Manager). ANNOUNCEMENT OF CLOSED SESSION ACTIONS: No reportable actions took place in Closed Session. ADJOURNMENT: There being no further business, Mayor Allevato adjourned the meeting at 3:00 p.m. to Tuesday, January 4, 2011, at 5:30 p.m. for Closed Session and 6:30 p.m. for a public Business Session, in the City Council Chamber.
