ADJOURNED REGULAR MEETING
Mayor Nielsen called the Special Joint Meeting of the San Juan Capistrano City Council
to order at 6:05 p.m. in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Sam Allevato, Tom Hribar,
Laura Freese, Mayor pro tem Dr. Londres Uso and Mayor Mark Nielsen
COUNCIL MEMBERS/DIRECTORS ABSENT: None
ORAL COMMUNICATIONS:
Bill Hardy, City resident, concerned with safety issues on Camino Capistrano.
PUBLIC HEARINGS:
C1. RESOLUTION 09-09-29-01, ADOPTED PROHIBITING PARKING FROM 2 A.M.
TO 6 P.M. EXCEPT BY PERMIT ONLY ON THE VILEST SIDE OF CAMINO
CAPISTRANO FROM LA ZANJA STREET TO OSO ROAD (570.20)
Written Correspondence:
■ Dan Buckner, City resident, e-mail received September 24, 2009, with
suggestions regarding the proposed parking restrictions.
■ James B. Haynie, City resident, letter received September 28, 2009,
opposed to any permit parking on Camino Capistrano.
■ Iry and Sharon Gram, City resident, e-mail received September 28, 2009, in
favor of parking restrictions on Camino Capistrano.
Ed Connor, Attorney at Law, e-mail received September 28, 2009, opposed
to the parking restrictions on Camino Capistrano.
Omar Sandoval, City Attorney provided a staff report and responded to questions.
Public Comment:
Kathleen Petersen, City resident, spoke in support of the parking restrictions
to eliminate parking on the arterial highway and for safety reasons.
■ Randy Lubert, City resident, felt cars should not be parked on arterial
highways, and commercial vehicles create an eyesore for the City's
gateway.
Juan Pena, City resident, spoke regarding the need of parking for
commercial vehicles and a grace period for residents to adjust to a permit
program on Camino Capistrano.
■ Joaquin Zamarripa, City resident, spoke regarding the need for more area to
park vehicles.

■ Thomas Weiler, City resident, distributed letters from residents who were
not able to attend the meeting, he suggested having a grace period for
adjustment; concerned with the cost of the permits; and the need for
commercial parking.
■ Joanne Marquez, City resident, spoke in preference of not having any
parking restrictions or permit program on Camino Capistrano.
■ Clint Worthington, City resident, distributed pictures to the City Council and
spoke in favor of the parking restrictions due to safety and liability.
■ Ed Connor, Attorney at Law, expressed preference for not having any
restrictions, but to take into consideration having a grace period, the need
for parking for commercial vehicles, and having overnight parking for
guests, if a parking by permit only on Camino Capistrano was implemented.
■ George Avila, representing Mission Hospital, spoke in support of a permit
program for Camino Capistrano; the high cost of the permits; and to work
together with CREER for solutions.
• Paula Steinborn, City resident, spoke in opposition to the parking
restrictions; she felt that tourist come to the City for the Mission and
experience the culture.
■ Bradley Reyes, City resident, spoke regarding the need for parking on
Camino Capistrano.
■ Dusty Otero, City resident, felt that parking on Camino Capistrano was a
need it due to the lack of parking.
■ Rick Friess, City resident, requested that the City Council move slow with
the program's implementations.
■ Jim Morgan, City resident, spoke regarding the traffic impacts on Camino
Capistrano; and felt that the area is an eyesore.
Council Comment:
■ City should purchase units in the Capistrano Villas and tear them down.
■ Provide overnight parking at the parking lots from the Library, La Sala,
Mission Basilica, San Diego Gas & Electric, and open the Capistrano
Garden RV Park for residential parking.
■ Preference in having a grace period of 90 to 120 days to establish a parking
by permit on Camino Capistrano.
■ Flatbed trucks should be allowed to park on Avenida de la Vista.
■ Concern with aesthetics to the City's gateway.
■ Staff should work with the community to identify areas that can be used for
commercial vehicle parking.
■ Permit program on Camino Capistrano should come back for review in six
(6) months together with the Capistrano Villas parking permit program.
■ Concern with safety issues with illegal crossing at the railroad tracks.
■ Parking on Camino Capistrano with a permit should be allowed for a limited
time only in order to give residents time to adjust and find solutions.
■ Parking should be banned in some of the City's arterial roadways.
■ Lack of evidence of a traffic safety issue on Camino Capistrano from the
Police Department.
■ Should consider red-striping at the north end of Camino Capistrano near
Oso Road, where the road is narrower.

■ Police Services should step up enforcement of prohibited commercial
vehicles on Camino Capistrano and Alipaz Street in order to change
behavior.
■ Parking should not be banned in all arterial highways, since the City is a
historic town and not a master planned community.
■ Parking by permit on Camino Capistrano should not be limited to only
residents on the Capistrano Villas, but to all surrounding communities that
have a parking permit program.
■ Permitting area on Capistrano should be pushed as far south as possible to
avoid illegal railroad crossing.
■ The Capistrano Villas parking permit program and the parking by permit
only on Camino Capistrano should start at the same time.
Council Action: Moved by Mayor Nielsen, seconded by Council Member Hribar,
and carried unanimously to approve RESOLUTION NO, 09-09-29-01, entitled "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, ESTABLISHING A "TOW-AWAY NO PARKING 2
A.M. — 6 A.M., EXCEPT BY PERMIT " ON THE WEST SIDE OF CAMINO
CAPISTRANO FROM LA ZANJA STREET TO OSO ROAD"; effective (with towing)
on February 1, 2010; overnight permits on Camino Capistrano are not limited to
just the Capistrano Villas, but to all surrounding communities; staff directed to look
for possibilities of red-striping the north end of Camino Capistrano near Oso Road,
where the road is narrower; Chief of Police Services directed to step up
enforcement of prohibited commercial vehicle parking, specially on Camino
Capistrano and Alipaz Street everyday for at least a month in order to change
behavior (commercial vehicles will not be allowed to park with a permit); item to
come back for further review as a public hearing in six (6) months (August 2010)
from the effective date of February 1, 2009; and staff directed to work with
homeowners associations regarding solutions for commercial vehicle parking in an
off street manner.
ADJOURNMENT:
There being no further business, Mayor Nielsen adjourned the meeting at 8:02 p.m. to
Tuesday, October 6, 2009 at 5:30 p.m. for Closed Session, and 6:30 p.m. for the public
