ROLL CALL COUNCIL MEMBERS PRESENT: Sam Allevato, Tom Hribar, Laura Freese, Mayor pro tem Dr. Londres Uso and Mayor Nielsen PUBLIC COMMENT: None CLOSED SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9(b), the City Council conferred with its legal counsel pertaining to significant exposure to litigation regarding one potential case. b. Pursuant to Government Code Section 54956.9(c), the City Council conferred with its legal counsel pertaining to initiation of litigation of one potential case. BUSINESS SESSION: Mayor Nielsen called the Regular Meeting of the City Council of the City of San Juan Capistrano to at 6:45 p.m. in the City Council Chamber. Council Member Hribar led the Pledge of Allegiance and Council Member Allevato gave the invocation. Mayor Nielsen dedicated the meeting to the late Will Timoti, Associated Senior Assistant Program (ASAP) volunteer. ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Mayor Nielsen announced that no reportable actions took place in Closed Session. CITY COUNCIL COMMENTS & ORAL REPORTS: ■ Meeting with Capistrano Unified School District regarding lowering Capital Fund District (CFD) rates for Pacifica San Juan residents. ■ Tea Party. ■ Upcoming meetings with Marines regarding the Toll Roads. ■ The Buxton Company Webinar. ■ San Juan Basin Authority meeting. ■ Green Feast, Ecology Center. OPEN SPACE COMMITTEE REPORT Mayor Nielsen reported that the Open Space Committee will bring a report back to the City Council with the following recommendations: 1) designation of former CARE site for a dog park. 2) Amending General Plan and Zoning designations of the former Shea property (Planned Community) to open space. 3) Designation of former Shea property (not designated for habitat restoration) for temporary equestrian use. SEPTEMBER 19, 2009 PROCLAIMED AS INNER -COSTAL WATERSHED CLEANUP DAY (610.40) Mayor Nielsen proclaimed September 19, 2009 as Inner -Coastal Watershed Cleanup Day and presented a proclamation to Jennifer Gonzalez, Sempra Energy Foundation. 3. DAVID HURLER, PUBLIC WORKS SUPERVISOR. RECOGNIZED FOR 20 YEARS OF SERVICE TO THE CITY (730.20) Joe Tait, Interim Utilities Director, recognized David Hubler, Public Works Supervisor for 20 years of service to the City and Mayor Nielsen presented him with a Certificate of Recognition. 4. Public Comment: x Cathryne Glick, Capistrano Beach resident, felt response should address all issues and work performed by the City to protect water for San Juan Capistrano. Council Comment: ■ Grand Jury's lack of mentioning recycled water in their report, and lack of acknowledgement of the City's ground water recovery plant. Council Action: Moved by Council Member Hribar, seconded by Council Member Allevato, and carried unanimously to authorize the Mayor to sign final version of San Juan Capistrano's response to the findings and recommendations of the Grand Jury report "Paper Water — Does Orange County Have a Reliable Future?" Council Comment: ■ Outdoor events shall be limited to a maximum of 165 people. ■ Forster Mansion property is zoned for commercial use. ■ Traffic and parking issues need to be addressed by scaling down the amount of people attending the events. ■ Conditional Use Permit (CUP) shall be approved for 6 months. ■ Outdoor events shall be limited to 70 events per year. ■ Decibel reading shall not be limited to only music. ■ Acoustic music shall be allowed without amplification. ■ Live musicians shall not be limited to a maximum of four (4) individuals. 6 09-15-2009 ■ Event tents should not need to be taken down in between back to back events. ■ Staff shall schedule monitoring by an acoustical engineer without prior notice to the applicant for two (2) outdoor events during the first three months at the applicant's expense. ■ Troubled by the adjacent single residential property not meeting the 1995 Conditions of Approval requiring shrubs and landscaping along the 15 foot buffer area from the property line. ■ The Forster Mansion is a beautiful historical asset that should be exposed to the public as much as possible. A solid ten (10) to twelve (12) foot wall could be installed between the properties to lessen the sound. Council Action: Moved by Council Member Freese, seconded by Mayor Nielsen, and motion failed 2-3 with Mayor pro tem Uso, Council Member Allevato and Council Member Hribar opposed to adopt RESOLUTION NO. 09-09-15-01, ENTITLED "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DENYING THE APPEAL AND AFFIRMING THE APPROVAL BY THE PLANNING COMMISSION OF CONDITIONAL USE PERMIT 08-011 FOR A WEDDING AND SPECIAL EVENT VENUE AT 27182 ORTEGA HIGHWAY (FORSTER MANSION EXCLUSIVE EVENTS) (APN 666-241-09); with approval of a Conditional Use Permit (CUP) with a six (6) months review by the Planning Commission and changes to conditions as follows; acoustical music allowed without amplification; decibel readings and limits apply to all event noise not just music; live musicians are not limited to a maximum of four (4) individuals; maximum occupancy for outdoor events is 165 people; event tent does not need to be taken down in between back to back events; maximum of 70 amplified outdoor evening events per year allowed; and two (2) outdoor evening events during the first three .months are to be monitored by an acoustical engineer at the applicant's expense. RESOLUTION NO. 09-09-15-02 ADOPTED REVISING THE PARKING PERMIT PROGRAM FOR CAPISTRANO VILLAS I, II AND III (570.20) Written Communication: James B. Haynie, City resident, submitted a letter on September 14, 2009, in favor of limiting the parking on Camino Capistrano to a maximum of three hours to allow all residents and tourists to use the. park. 8 09-15-2009 Petition received on September 14, 2009, with a list of solutions in response to the parking restrictions on Camino Capistrano. The following individuals spoke in support of the parking program, and made suggestions for the program: ■ Michael Jagels, Aliso Viejo resident; Pamela Bashline, City resident, Council Comment: ■ The Capistrano Villas do not have adequate parking to accommodate the amount of cars. ■ Parking will become more challenging through time. ■ Re -striping might create around 30 spaces, but will not be sufficient. ■ Preferences in keeping parking on Camino Capistrano until other alternatives are available. ■ The parking by permit enforcement starting time should be increased from 9:00 P.M. to 11:00 P.M. ■ Need to tow cars that are parked over 72 hours and enforce "no parking" for more than one (1) hour for commercial vehicles. ■ Number of permits should be limited to four (4) permits per unit. ■ Enforcement is the key to a successful parking permit program. Suggestion to allow for a period of a year parking on Camino Capistrano with a parking permit. 9 09-15-2009 ■ Proof of a valid California Driver's License should be required to receive a parking permit ■ The management company responsible for administering the parking permit program should attach the stickers to the cars rather than giving them out. ■ Parking with permits on Camino Capistrano should be look into rather than banning parking. ■ The City is not designed as a Master Planned Community and would not benefit from banning parking on all secondary arterials. Council Action: Moved by Mayor Nielsen, seconded by Council 'Member Freese, and carried unanimously to adopt RESOLUTION NO. 09-09-15-02, ENTITLED "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AUTHORIZING THE CAPISTRANO VILLAS HOMEOWNERS ASSOCIATIONS 1, 11 AND III TO MANAGE THE PARKING PERMIT PROGRAM CURRENTLY MANAGED BY THE CITY, APPROVING REVISED RULES GOVERNING THE PARKING PERMIT PROGRAM, AND MODIFYING THE PARKING PROHIBITION TO "NO PARKING, TOW AWAY ZONES, 11:00 P.M. TO 6:00 A.M., EXCEPT BY PERMIT, EVERYDAY."; Option # 1 selected for implementation of the new parking sign restriction (All new parking restriction signs shall be ordered and installed by November 1, 2009. After a grace period of 10 calendar days, all vehicles not displaying an authorized permit would be subject to citation. "Tow Away" implementation will begin on January 4, 2010, subject to future City Council action) ;permits are limited to a maximum of four (4) permits per unit; proof of a valid California Driver's License is required to receive a parking permit; the "No Parking, Tow Away Zone, except by permit, everyday" from 3:00 a.m. to 6:00 a.m. is to be changed to and adopted from 11:00 p.m. to 6:00 a.m.; and staff to bring back to Council on September 29, 2009 the possible extension of the parking program to Camino Capistrano. Council Action: Moved by Council Member Freese, seconded by Mayor pro tem Uso, and carried unanimously to approve an exception from the City's formal procurement procedures as provided under Section 3-4.305 (2) of the Municipal Code; staff authorized to procure the equipment through the use of another satisfactory contract, and City Manager authorized to execute the purchase agreement for equipment up to $50,000, if no other contract is found, then staff is to continue with the formal bid process and the City Manager is to be authorized to award the bid; and appropriation of $50,000 from the Parking Maintenance reserve funds, approved. ORDINANCES: None 11 09-15-2009 COUNC[LMANIC ITEMS: Council Member Allevato and Council Member Hribar expressed concerns regarding conduct from Commissioners, Committee and Board Members. Omar Sandoval, City Attorney, suggested that an item be agendized to discuss any Commission/Committee/Boards issues.
