09-0818_CC_Minutes_Special MeetingMINUTES August 18, 2009 SAN JUAN CAPISTRANO CITY COUNCIL SPECIAL MEETING Mayor Nielsen called the Special Meeting of the City Council to order at 4:06 p.m. in the City Council Chamber. RM I CAA I COUNCIL MEMBERS PRESENT: Sam Allevato, Tom Hribar, Laura Freese, Mayor pro tem Dr. Londres Uso and Mayor Nielsen COUNCIL MEMBERS/DIRECTORS ABSENT: None PUBLIC COMMENT: Item C — Public Comment: The following persons spoke in support for the City to purchase the property: Rob Ferguson, City Resident; John Murphy, President of United Futbol Club; HJ Weiland, City Resident; Renee Ritchie, City Resident, Open Space Committee; James Miller, United Futbol Club; Justin Crotty, San Juan Capistrano Little League; Airian Nieblas, City Resident; Richard Hill Adams, City Resident; Garfield Logan, City Resident; Julie Ryan Johnson, City Resident. CLOSED SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54957.6, the City Council conferred with its labor negotiators (City Manager, Assistant City Manager, and Human Resources Manager) pertaining to the Memorandum of Understanding negotiations, including salaries, salary schedules, compensation, and terms of employment involving the San Juan Management and Professional Employees' Association, and the San Juan Capistrano Classified Employees' Association. b. Pursuant to Government Code. Section 54957, the City Council conducted a public employee performance evaluation of the City Clerk. C. Pursuant to Government Code Section 54956.8, the City Council conferred with real property negotiators (City Manager and Open Space Finance Sub - Committee) regarding the price and terms of payment for acquisition for real property described as APN 125-172-07 and APN 125-172-17, generally located west of La Pata and south of Ortega Highway. The property owner is Rancho Mission Viejo (RMV). 1 8-18-2009 ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Item C: Mayor Nielsen reported that the City Council voted unanimously to acquire the property. The substantive terms for the purchase and sale agreement are as follows: the property was appraised at thirty-one million dollars ($31,000,000) and Rancho Mission Viejo has agreed to sell the property to the City for twenty-seven and a half million dollars ($27,500,000). The City will acquire the property within 180 days with bond funds made available by Measure Y approved by the voters on November 2008.
