Chairman Nielsen called the Regular Meeting of the Board of Directors of the San Juan
Capistrano Community Redevelopment Agency to order at 10:53 p.m.

Board Action: Moved by Director Soto, seconded by Director Hribar, and carried
unanimously, 4-0, to approve items 1 through 3 as recommended by staff.

BOARD ACTIONS
1. 20% OF THE LEASABLE AREA IN THE HOME FURNISHING CENTER MAY
BE AVAILABLE FOR NON -FURNISHING USES APPROVED. (ORANGE
COUNTY DEPARTMENT OF EDUCATION ALTERNATIVE COMMUNITY AND
CORRECTIONAL SCHOOLS AND SERVICES) (515.70)
Description: Signature Services, a property management corporation, requested
approval of tenancy in the Home Furnishing Center for the Orange County
Department of Education's Alternative Community and Correctional School and
Services Program (ACCESS). The Owner Participation Agreement (OPA)
between the Agency and center owner restricts the uses in the center to those
generally associated with home design and accessory center, and allows the
Agency discretion to waive or modify the standards. The applicant proposes to
provide an expanded list of alternative uses for 20% of the center, which includes
leasing an area considered difficult retail space to the Department of Education
for its ACCESS program. In accordance with the results of the City's Economic
Development Study, completed in 1998, which indicated a need for non -retail
tenants to revitalize the center, staff finds the request for alternative uses in 20%
of the center reasonable. A resolution of this issue is at the Board's discretion.

Presentations:
Douglas Dumhart, Economic Development Manager, summarized the staff
report.
Tony Gibson, Director of Student Service for Orange County Department of
Education, described the operation of the school, which is currently located
across the freeway at Ortega and serves between 100 — 155 students, of which
an excess of 75% live in San Juan Capistrano. They traditionally have very few
problems with the students, who primarily are there for independent study and
are very well supervised. Mayor pro tem Nielsen established from Mr. Gibson
that the Department of Education needs at least five years in this location in
order to recoup their tenant improvements; and they would be willing to relocate
with the City's help if a better use for the building is proposed in the future.
Public Comment:
Roger Niaz, representing the property ownership, supported allowing up to 20%
non -retail uses to increase the center's viability; expressed the need for a
monument sign to better advertise the site; and discussed the issues and
process that led to the proposed list of alternate uses.

William Coddle, representing the property ownership, stated the existing tenants
' have expressed support for the proposed mix of uses; and agreed increased
involvement in the community and Chamber of Commerce may improve center
profitability.
Council Action: Moved by Mayor Soto, seconded by Council Member Hribar
and carried unanimously, 4-0, to approve 20% of the leasable area in the home
furnishing center may be available for non -furnishing uses including the Orange
County Department of Education's ACCESS Program for tenancy in the Home
Furnishings Center.
