65-0510_CC_Minutes_Regular Meeting5(1.2 Minutes of the Regular Meeting of the City Council of San Juan Capistrano MAY lo, 1965 The regular meeting of the City Council was called to order at 7:32 P. M., by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by John H. Dawson, City Attorney. The City Clerk called the roll: Councilmen present were: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford WRITTEN COMMUNICATIONS Councilmen absent were: None. (a) David L. Baker - Letter regarding committee appointed to study the disposition of State Grant Funds as provided for by the State Beach, Park, Recreational and Historical Facilities Bond Act of 1964 - informational. (b) City of Fountain Valley - requesting support of Assembly Bill 1150, known as the "Park Land Dedication" Bill: Council to study said bill before making any decision. (c) City of Orange - Resolution supporting legislation to control distribution of obscene literature - informational. (d) City of Fountain Valley - requesting opposition to Assembly Bill 1461, which provides for a mandatory 40 -hour week for firemen.after July 1, 1970: Councilman Chermak offered a resolution opposing Assembly Bill 1461. The resolution was passed, approved and adopted by a majority vote. Mayor Durnford and Councilman Buchheim voted "No". (e) Critique of California Urban Policy for Intergovernmental Action - informational. TREASURER'S REPORT The Treasurer's Report for the month of April, 1965, was.submitted by the City Treasurer, Alice M. Ross. Councilman Chermak made a motion to accept and file the treasurer's report for the month of April, 1965. The motion was seconded by Council- man Buchheim and it carried unanimously. So ordered. J- /D -6J' PLANNING COMMISSION MATTERS (a) Reports: None (b) Recommendations; (1) Rezone request RZ 65-101 (Johnson): Public Rearing set for May 24, 1965, at 7:30 P. M. UNFINISHED BUSINESS (a) Resolution of "no majority" protest - Via California Annexation: Councilman Bathgate offered a resolution entitled, "A resolution of the City Council of the City of San Juan Capistrano finding and determining that a majority protest has not been made in the proceedings for the annexation of certain uninhabited territory of the City of San Juan Capistrano known and designated as "Via California" Annexation". The resolution was passed, approved and adopted by a unanimous vote. (b) Second reading - "Via California" Annexation ordinance: Mayor Durnford made a motion to have Ordinance No. 105 read by title only. Councilman Bathgate seconded the motion and it carried unanimously. So ordered. City Attorney read Ordinance No. 105 by title only. Councilman Bathgate offered a resolution adopting Ordinanne No. 105 entitled, "An Ordinance of the City of San Juan Capistrano approving the annexation to the City of San Juan Capistrano of the territory known as "Via California Annexation". The resolution was passed, approved and adopted by a unanimous vote. (c) Recruitment of Bookkeeper and Business License Inspector: Mayor Durnfdrd made a motion to accept the committee report presented at the meeting of April 12, 1965. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. Further action was deferred until an adjourned regular meeting. (d) Divisidn of Land processing guide format: Councilman Bathgate made a motion to adopt the division of land guide format. Councilman Chermak seconded the notion and it carried by a unanimous vote. So ordered. (e) Architectural Restricted Mission Area - John Dawson reporting: City Attorney gave report to the Council. He will submit possible amendment section to Ordinance No. 31 for next council session. NEW BUSINESS (a) Assessment District No. 64-1 (1911 Act) - Easement Deed Parcels - Authorization to accept and record, without demands: Councilman Buchheim offered a resolution accepting and offering for recordation the easement deeds on Parcel No's 6, 7, 10, 12, 22, 15, 16, 17, 18, 35, 33, 36, 39, 40, 40, 40, 41, 42, 43, 44, 46, 48 and 49. The resolution was passed, approved and adopted by a unanimous vote. (b) Easement Deed - Brown & Charles Re: DL 65-102 (Stroschein) - acceptance: Councilman Bathgate offered a resolution accepting said easement deed and ordering it to be recorded. The resolution was passed, approved and adopted by a unanimous vote. RECOMMENDATIONS and REPORTS (a) City Attorney - John H. Dawson: Gave report on basis of questioned legality of Assessment District No. 64-1. (b) Director of Public Works - T. J. Meadows: (1) Stated that Joe Feeney and Clarence Magnusen from Engineering - Science, Inc., were in the audience. Mr. Feeney and Mr. Magnusen presented a map of proposed preliminary assessment districts. (2) Trip to barge postponed until later. Council will be notified. (c) City Engineer - Jack Y. Kubota: (1) Darmi tract principle subdivision activity at present. (2) City in receipt of map for Tract 5949 - Casitas Capistrano. (3) Processing improvement plans for Mission Plaza. (4) Drive -In Theater is ready as far as City is concerned. (5) Office would like to offer recommendations for suggested changes in standard procedures. (6) Discussion of 30" transmission line for Southern Counties Gas Company. Councilman Buchheim made a motion that the City notify the Orange County Road Department and Southern Counties Gas Company that they look with disfavor upon the proposed location J- / 0 —to .i of the 30" transmission line down Camino Capistrano. Council- man Bathgate seconded the motion and it carried unanimously. So ordered. (d) Mayor Durnford reported a meeting held with Supervisor Alton Allen regarding transfer of Orange County Waterworks District No. 4 to jurisdiction of the City. Councilman Bathgate made a motion to ask Bartle -Wells to pro- ceed with draft of feasibility report with regard to said transfer. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. Councilman Bathgate made a motion to adjourn until 7:30 P. M., Tuesday, MAy'18, 1965. Councilman'Chermak seconded the motion and it carried unanimously. So ordered.
