64-1228_CC_Minutes_Regular MeetingI - • Regular Meeting of the City Council of the City of San Juan Capistrano DECEMBER 28, 1964 The regular meeting of the City Council was called to order at 7:35 P• M•, by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by John Dawson, City Attorney. The City Clerk, pro tem, called the roll: Councilmen present were: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. Councilmen absent were: None. The minutes of the meeting dated December 14, 1964, were approved as submitted. WRITTEN COMMUNICATIONS: (a) City of Albany: Resolution regarding prevention of disruption of educational pro_ ceases at State supported universities. Mayor Durnford made a motion to table the resolution. Councilman Chermak seconded the motion and it carried unanimously. So ordered. (b) City of Dos Palos, California: Requesting contributions to the Bronco Band for the inaugural parade, January 20, 1965• Councilman Chermak made a motion not to contribute to the support of the Bronco Band. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. (e) March of Dimes: Mayor Durnford proclaimed the month of January, 1965, "March of Dimes:' month. (d) Trabueo Valley Civic Association: Request for use of City Hall as a meeting place. Councilman Chermak made a motion to deny the request and suggest that the association contact the elementary school for use of the auditorium. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. /2 -2.8-/oil (e) Orange County Mosquito Abatement District - appointment of representative: Mayor Durnford reappointed Howard M. Lattimer for the next two-year term of office ending December 31, 1966. ORAL COMMUNICATIONS: Mr. James Barr, President of Val Verde Corporation, requesting that consideration be given to the sewer connection fees for his property. Also requested reconsideration of denial of RZ 64-104 from P_D to C-1. Councilman Chermak made a motion that both items be continued until the next regular meeting, January 11, 1965, and that further particulars and figures be submitted prior to that time, substantiating the requests. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. TREASURER'S DEMANDS: The list of demands and accounts payable on January 1, 1965, was sub - witted by the City Treasurer, Alice M. Ross. Councilman Chermak made a motion to approve list of demands and instruct the City Treasurer to draft Warrant No's 1105 thru 1142 for a total amount of $39,876.34. Councilman Bathgate seconded the motion and it carried unanimously. So ordered. COMMITTEE REPORTS: (a) Technical Staff - San Diego Gas & Electric Company, sewer connection: Discussion was held. Councilman Buchheim made a motion to defer the matter for consider- ation until the City of San Juan Capistrano actually becomes owners and operators of the subject transmission line. The motion was seconded by Councilman Chermak and it carried by a majority vote. Councilman Bathgate voted "No". The Technical Staff recommendation was that the total fee should be $425.00. No further action was taken. (b) Orange County Library District - withdrawal procedure: City Attorney made his report to the council regarding withdrawal procedures. Councilman Buchheim offered a resolution entitled, "A Resolution of the City Council of the City of San Juan Capistrano authorizing and directing publication of notice of its intention to withdraw from the is -28-c y from the County Free Library System". The resolution was passed, approved and adopted by a unanimous vote. City Attorney to report to the council what type of district can be formed to take place of the County Free Library District. "TEN MINUTE RECESS.............. City Attorney gave his report regarding procedure of school districts not complying with zoning ordinances under the State Conservation and Planning Act. PLANNING COMMISSION MATTERS: (a) Reports: (1) Comprehensive Zoning Ordinance (Proposed): Secretary read report from the Planning Commission regarding the above item. (2) Division of Land 64-108 (Klusmann): Secretary read report from the Planning Commission regarding the above item. (b) Recommendations: (1) Rezone request RZ 64-105 (Johnson): Public Hearing set for January 25, 1965, at 7:30 P. M. (2) Land Use Development Plan - element of City General Plan: Public Hearing set for January 25, 19659 at 7:30 P. M. (3) Land Use Variance 64_118 (Stroschein): Discussion was held. Councilman Buchheim made a motion to uphold recommendation of the Planning Commission for approval of LUV 64-118. Councilman Olivares seconded the motion and it carried unanimously. So ordered. UNFINISHED BUSINESS: (a) Land Use Variance 64_111 - First Southern Baptist Church: Councilman Buchheim made a motion to remove LUV 64-111 from the agenda until a request is made to have it placed on again. Councilman Chermak seconded the motion and it carried unanimously. So ordered. /2-2d'-95/ NEW BUSINESS• (a) Agreement - Girard V. Smith and Marilyn J. Smith: Councilman Chermak made a motion to accept the agreement from Girard V. Smith and Marilyn J. Smith. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. RECOMMENDATIONS and REPORTS: (a) City Engineer - Jack Y. Kubota: (1) Has had discussion with the County of Orange and it looks favorable that easement can be acquired for Alipaz Street north of Del Obispo. (2) Still some matters to be worked out regarding Loughridge Corpor- ation and Oso Road. (b) Councilman Bathgate related problem of unfinished sewer line on Camino Capistrano. (c) Councilman Olivares has a possible member for the Planning Commission; however, it still needs to be determined if the proposed member will be able to attend the regular meetings on the let and 3rd Tuesday's of each month.
