64-1013_CC_Minutes_Regular MeetingRegular Meeting of the City Council of the City of San Juan Capistrano OCTOBER 13, 1964 The regular meeting of the City Council was called to order at 7:33 P. M., by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by John Dawson, City Attorney. The City Clerk called the roll: Councilmen present were: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. Councilmen absent were: None. The minutes of the meeting dated September 28, 1964, were approved as submitted. WRITTEN COMMUNICATIONS: (a) Trends - informational (b) Newsletter - Alton E. Allen, Supervisor 5th District - informational (c) Resolution - City of Westminster: Regarding Proposition A & B on the November ballot. (d) Letter from Fairlane Homes, Inc., regarding zoning of San Juan Creek Valley Floor: (Item held over until public hearing on zoning of valley floor.) TREASURER'S REPORT: The Treasurer's Report for the month of September, 1964, was submitted by the City Treasurer, Alice M. Ross. Councilman Chermak made a motion to accept and file the treasurer's report for the month of September, 1964. The motion was seconded by Council- man Buchheim and it carried unanimously. So ordered. COMMITTEE REPORTSā€¢ (a) Parks & Highways - Mayor Don Durnford: Probably be a month before a decision is reached on amount and terms of sale of property owned by the Division of Highways. (b) Master Drainage Study - Jack Kubota, City 'Engineer: yet. Postponed until later in meeting, as City Engineer was not present /v -/ 3 -/Dq 419 PUBLIC HEARINGSā€¢ (a) Zoning of the Valley Floor: Mayor Durnford opened the public hearing. Mr. Joaquine Errecarte, Mr. Ed Rosenbaum and the Farney brothers all requested that their property, which would be zoned R_1 as a result of the plan, be left as U_1. Letter from Fairlane Homes, Inc., requesting that the northerly section of their property be changed from P_D to C_1 was not acted upon as this hearing was not called for change in zone other than U_1. Mayor Durnford closed the public hearing. It was the council's decision to adopt the suggested zoning from the Planning Commission as a "land use plan" rather than establish it as actual zoning. v- 3-/ Councilman Bathgate offered a resolution to adopt "Exhibit A" as "land use plan" for the valley floor area. The resolution was passed, approved and adopted by a unanimous vote. (b) Prezone "Rosenbaum Annexation" property: Robert Johns gave Planning Commission recommendation pertinent to public hearing. Recommendation was to approve prezoning with the exception that portion of R_1 be changed to E_$. Mayor Durnford opened the puulic hearing. Hugh Halderman spoke on behalf of applicant. There were "No Protests". Mayor Durnford closed the public hearing. Councilman Bathgate made a motion to accept recommendation of Planning Commission with the exception that U_1 be changed to R_1 and C_1 south of reservoir be eliminated, and to have first reading of'an ordinance by title only and a redrafted exhibit supplied before second reading to correspond. The motion was seconded and passed by a majority vote of the council. However, reading an ordinance by title only can only be done with a unanimous vote of the council. Councilman Bathgate made a motion to have ordinance read in full. Councilman Durnford seconded the motion and it carried by a majority vote. Councilman Buchheim and Chermak abstained from voting. City Attorney read ordinance in full. This condituted a first reading. /o -13-4X 4? 4-4) RECOMMENDATIONS and REPORTS: (a) City Attorney _ John H. Dawson: (1) Suggested that the meeting adjourn to October 20, 1964, for action on 1911 Act matters. (2) Requested council consideration on the proposed raise for the City Attorney in the 1964-65 budget. (b) City Engineer - Jack Y. Kubota: (1) Dike & Colegrove, Tact 5675, has completed all grading and commencing -1 with underground utility work. (2) Town & Country, Tract 56249 water line in tract and sewer construction will start Monday (October 19, 1964). (3) Kol-Bet, Tract 5733, in for plan checking. (c) Councilman Buchheim asked how action was progessing for removal of illegal signs. (d) Councilman Chermak: (1) Related problem of "Honda Club" and beer parties utilizing parking lot behind the market. Suggested that Deputy Sheriff's be notified of problem. (2) Related decision of Local Agency Formation Commission with regard to annexations to other cities. (3) Suggested that a split of Supervisorial Districts 4 and 5 would facilitate Southern Orange County better by an additional two super- visorial districts. (e) Councilman Olivares questioned the delay on restricting parking on the Ortega Highway. (f) Mayor Durnford appointed a committee to work with Land Acquisition Service consisting of T. J. Meadows, Ernest A. Thompson and himself. Councilman Buchheim made a motion to adjourn the meeting to October 20, 1964, at 7:30 P. M. Meeting adjourned at 11:33 P. M. Tr -not A.
