Regular Meeting of the City Council of the City of San Juan Capistrano
SEPTEMBER 28, 1964
The regular meeting of the City Council was called to order at 7:32 P.M.,
by Mayor Don Durnford.
The pledge of allegiance was recited. The invocation was given by
Ernest A. Thompson, City Administrator.
The City Clerk called the roll: Councilmen present were: William A.
Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares
and Don Durnford. Councilmen absent were: None.
The minutes of the meeting held September 14, 1964, were corrected with
the change under Recommendations and Reports, Director of Public Works, with
the deletion of the name Joe Feeney and addition of the name Judd Harmon
with regard to attendance at the Water Quality Control Board meeting.
WRITTEN COMMUNICATIONS:
(a) Trends - informational
(b) Resolution - City of Garden Grove:
Regarding the exemption of Sales Tax upon purchases made by govern-
mental agencies.
City Attorney to look into matter and report back to City Council.
(c) Capistrano Beach School District:
Requesting statement of approval for the considerations of the
establishment and/or construction of a school facility to be located
easterly of Harbor Estates being a parcel of land approximately 18 acres
owned by Dr. Clarence Reed in the City.
Council to reconsider when further notification is received from
the school district.
TREASURER'S DEMANDS:
The list of demands and accounts payable on October 1, 1964, was submitted
by the City Treasurer, Alice M. Ross.
Councilman Bathgate made a motion to approve list of demands and instruct
the City Treasurer to draft Warrant No's 1001 thru 1033 for a total amount
of $21,481.46. Councilman Buchheim seconded the motion and it carried
unanimously. So ordered.

COMMITTEE REPORTS:
(a) Parks and Highway Committee:
Mayor Durnford reported that he had not been able to pursue this
matter as yet.
(b) Television franchise - Mission Television:
Item deferred until full proposal is submitted.
(c) Drainage Study - Jack Kubota:
Will be commencing with actual study soon.
PLANNING COMMISSION MATTERS:
(a) Reports:
(1) Division of Land 64-107 - Bramble:
Secretary of the Planning Commission gave report on the above item.
(b) Recommendations:
(1) Rezone 64-103 - "Rosenbaum Annexation":
Public hearing date set for October 12, 1964, at 7:30 P. M.
(2) Land Use Variance 64-113 - Stroschein:
Public hearing date set for October 26, 1964, at 7:30 P. M.
UNFINISHED BUSINESS:
(a) Contract documents naming the Supt. of Streets:
Action deferred until October 12, 1964.
(b) Resolution - Formation ofl9ll Act Improvement District:
Action deferred until October 12, 1964.
(c) Proposed ordinance - providing for the issuance of general obligation
bonds:
Councilman Chermak made a motion to have ordinance read by title
only. Councilman Bathgate seconded the motion and it carried unanimously.
So ordered.
City Attorney gave first reading "An Ordinance of the City of San
Juan Capistrano, California, providing for the issuance of municipal
improvement bonds of said City in the amount of $700,000.00".
(d) Proposed resolution providing for sale of bonds:
Matter to be taken up after recess.
(e) Proposed arterial highway "Niguel Road",
City Engineer gave his report to date.

(f) Land Use Variance 64-111 - First Southern Baptist Church:
Matter continued until October 12, 1964.
(g) Proposed street sweeping contract - B & G Sweeping Service:
Councilman Buchheim made a motion to contract services of B & G
Sweeping Service for one year at the recommended hourly rate of $8.$0
per hour. Councilman Chermak seconded the motion and it carried
unanimously.
The Mayor recommended the streets be swept twice weekly on Monday
and Thursday and directed the City Attorney to draft appropriate
contract.
(h) Proposed resolutinn - LARTS Study:
Matter to be studied further and brought up again October 12 , 1964.
"TEN MINUTE RECESS"...........
Mr. Kobbins of Capistrano Saddle Club asked to be heard and requested
the council to give their attitude on the proposed arterial "Niguel Road".
Councilman Buchheim made a motion to deny the request of Capistrano
Saddle Club. Councilman Oliveres seconded the motion and it carried by
a majority vote. Councilman Bathgate abstained from voting.
Item (a) under Unfinished Business:
I Councilman Bathgate offered resolution for adoptinu. "Resolution of the
City Council of the City of San Juan Capistrano, California, directing the
City Clerk to publish notice inviting sealed proposals for bonds of said
City." The resolution was passed, approved and adopted by a unanimous vote.
NEW BUSINESS:
(a) Select street system map and report:
City Engineer presented the map and report to the City Council.
Councilman Chermak offered resolution for adopting map and report
of routes for select system. The resolution was passed, approved and
adopted by a unanimous vote.
(b) Proposed resolution setting salary for City Treasurer:
It was noted that the City Treasurer's salary must be by ordinance.
Councilman Bathgate made a motion to have first reading of ordinance
by title only. Councilman Buchheim seconded the motion and it carried
unanimously. So ordered.

City Attorney gave first reading by title only "An Ordinance of
the City of San Juan Capistrano setting the salary of the Cite Treasurer".
(c) Agreement - Robert E. Rice:
Councilman Buchheim made a motion to accept the agreement. Council-
man Bathgate seconded the motion and it carried unanimously. 5o ordered.
(d) Petition for a proposed 1911 Act Improvement District:
Councilman Buchheim made a motion to grant permission to establish
boundaries in regards to 1911 Act proposal and petition. Councilman
Olivares seconded the motion and it carried unanimously. So ordered.
(e) Petition for Annexation - "Rosenbaum Annexation":
4 Councilman Bathgate offered resolution of intention to annex
and setting public hearing for October 26, 1964, at 7:30 P. M. The
resolution was passed, approved and adopted by a unanimous vote.
(f) Request for refund - Tract No's 5737 and 5738 - Mission Viejo Company:
Counc2man Chermak made a motion to grant request for refund for
that amount in excess of the $350.00 consitituting charges already
imposed by processing said maps. Councilman Buchheim seconded the
motion and it carried unanimously. So ordered.
Rnd REPORTS•
(a) City Attorney - John H. Dawson:
Related need for county courthouse and county jail as projected
by Proposition "A" & "B" on November ballot and requested signatures
in favor of proposition A & B.
Discussion was held.
No action taken.
(b) Director of Public Works - T. J. Meadows;
Related that Engineering Science, Inc., will have plans and
specifications for trunk sewer line, ocean outfall and treatment plant
completed and submitted to council for letting of bids on October 26,
1964.
He also related that the plans and specifications for the assess-
ment district contract will be available for letting of bids on October 26,
1964.

(c) City Engineer - Jack Y. Kubota:
Reported that Dike & Colegrove Tract 5675 is moving right along.
(d) Councilman Bathgate related problem of truck parking on Ortega Highway
from Ganado Road to freeway.
'f Councilman Durnford offered resolution requesting the State Division
of Highways to authorize posting "No Parking" signs on both sides of
Ortega Highway from Ganado Road to the San Diego Freeway. The
resolution was passed, approved and adopted by a unanimous vote.
,.(e) Councilman Buchheim offered resolutiontn have the parking in front of
Oharzabal property on Camino Capistrano changed from diagonal to parallel
and a portion on Los Cerritos just northerly of Ortega Highway posted
"No Parking".
(f) Councilman Chermak:
(1) Suggested that some method be used for getting the information on
Planning Commission and City Council agendas to the public.
(2) Related problem of speeding trucks on Ortega Highway.
(g) Mayor Durnford:
(1) Suggested that investigation be made into available space for
municipal parking.
(2) Reported receipt of proposed proclamation from National Society
Children of the American Revolution. Requested further information
be made available before any action is taken.
Meeting adjourned at 10:48 P. M.

Council of the City of San Juan Capistrano, held on the 28th day of
