64-0608_CC_Minutes_Regular Meeting3'7 4) Minutes of the Regular Meeting of the City of San Juan Capistrano JUNE 8, 1964 The regular meeting of the City Council was called to order at 7:30 P. M., by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by John Dawson, City Attorney. The City Clerk called the roll: Councilmen present were: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. Councilmen absent were: None. The minuues of the meeting held May 25, 1964, were corrected with the change of total treasurer's demands payable from $8,404.51 to $8,406.01. The minutes were approved as corrected. WRITTEN COMMUNICATIONS: (a.) Trends - informational (b) Orange County League of Cities: Notice of Executive Meeting to be held. June 11, 1964, in Orange, Calif. Councilman Buchheim and. Mayor Durnford to attend the meeting. (c) League of California Cities: Article regarding possible imposition of Hotel Room Tax by the State. Councilman Buchheim suggested to keep article on file until 60 days before next session of the legislature. Councilman Bathgate seconded the motion and it carried. unanimously. So ordered. (d) County of Orange: Notice of public auction of parcel of land, AP 124-301-03. Councilman Bathgate made motion that City Council had no objections to said sale. Councilman Buchheim seconded the motion and it carried - unanimously. So ordered. (e) Board of Supervisors: Resolution regarding effects of possible inland. freeway route between Corona. Del Mar and San Juan Capistrano. ResoUtion on file in City Clerk's office for public reference. (f) Val Verde Corporation: Request for amendment to Resolution 64-2-18-1 and Resolution 64-2-18-2 `JUN 8 '�4 RS L for permission to use cedar fence on a 10 -foot center with 2' X 2' cement block columns rather than solid concrete or masonry wall. Discussion was held. L / Courdlman Chermak offered. resolution amending Resolution No. 64-2-18-1 and. Resolution No. 64-2-;8-2 to allow use of combination of materials. The resolution was passed., approved and adopted by a unanimous vote. (g) Voorheis, Trindle & Nelson, Inc.: Appeal of Plwming Commission disapproval of Tentative Tract No. 5622. Continued. until "Planning Commission Reports". PUBLIC HEARINGS• (a) Weed. Abatement: Mayor Durnford. declared public hearing open. There were "No Protests". Mayor Durnford closed the public hearing. TREASURER'S REPORT: The Treasurer's Report for the month of May, 1964, was submitted by the City Treasurer, Alice M. Ross. Councilman Bathgate made motion to accept the treasurer's report for the month of May, 1964. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. COMMITTEE REPORTS: (a) 1911 Act Improvement Plans and. Resolution of Intention to Form District: Resolution to be ready for June 22, 1964, meeting. (b) Tract No. 4840 - Bea,mish & Diggins - Jack Y. Kubota: Presented report and.recommendations to City Council. Discussion was held. Councilman Bathgate offered resolution of intention accepting map sub- ject only to minor deviations which are brought about by grading. The resolution was passed, approved and adopted by a majority vote. Ayes: Bathgate, Chermak, Olivares and Durnford; Noes: Buchheim. fJUH 8 '&� (c) Public Works Committee - San Diego Regional Water Pollution Control Board.: Investigated possible location of sewage treatment plant to be in Oso Creek. Reported that this is not a definite proposal and before anyttng is finalized. City would receive all data, and information. PLANNING COMMISSION REPORTS: (a.) Tentative Tract 5622 (Kol-Bet): Secretary, Robert K. Johns, read. memo from Planning Commission relating circumstances of disapproval of Tentative Tract 5622. Mike Koll was present to voice appeal of disapproval. Discussion was held. Mayor Durnford. directed that appeal be continued until June 22, 1964, and. also asked for written staff reports from Planner -Tech, City Engineer and City Administrator. "FIVE MINUTE RECESS" .............. (b) Division of Land (Keresey): Secretary read memo from Planning Commission regarding DL 64-101. City Engineer wa.s directed to draw plan for precise rights-of-way and also include precise alignment of curb installation for future construction and development from Del Obispo Street north on Camino Capistrano to Acjachema Street for submittal to council for referal to Planning Commission. (c) Division of Land 64-102 (Sandborn): Secretary read memo from Planning Commission regarding DL 64-102, with deferred. action. Will submit letter to City Attorney ad.king for legal opinion. (d) Division of Land 64-103 (Cook): Secretary read memo from Planning Commission regarding DL 64-103. Discussion was held. Council suggested that Mr. Cook acquire 10 -foot dedication in order to comply with minimum right-of-way of 40 feet under provisions of division of land code. Matter continued until June 22, 1964. AN 0 '&ti ED (e) PD Site Plans (Val Verde Corp.): Secretary read. memo from Planning Commission stating conditions of approval. UNFINISHED BUSINESS: (a) Ordinance No. 31 - Historical Society - John Dawson: Matter continued until information is obtained. (b) Pacific Southwest Water Plan: Continued for further study by Council. NEW BUSINESS: (a) Trash Pickup - Contract vs. Franchise: Mayor Durnford. appointed. Councilman Olivares and Councilman Buchheim to consider problem and to speak to service agencies interested. (b) Appointment - Site Plan Review Committee - Ordinance No. 90: Set over until "Executive Session". (c) Appointment - Architectural Board. of Review - Ordinance No 31: Set over until "Executive Session". (d.) Mission Viejo Company - Setting of public hearing date: - Prezoning: Councilman Bathgate made a motion to set public hearing for June 22, 1964, at 7:30 P. M. Councilman Buchheim seconded the motion and it carried unanimously. So ordered.. RECOMMENDATIONS and. REPORTS: (a) City Administrator - Ernest A. Thompson: (1) Laguna, Video, Inc., request for community antenna television franchise for San Juan Capistrano. Matter referred to City Attorney for study and report. (2) Summer emp]Wment suggested because of increased work load. To be discussed. at time of budget. (b) Director of Public Works - T. J. Meadows: Application to State Water Quality Control Board for extension of six months for award of contract granted. (c) City Engineer - Jack Y. Kubota: (1) Val Verde started. Monday, June 8, 1964, with grading. (2) Dike & Colegrove to start curb and gutter on Wednesday, June 10, 1964. (3) Misbin tract working on storm drain. JUN 8 '6y 3-74 AN (d) Councilman Buchheim suggested that some control be established. to prevent cluttered streets because of earth moving and. development activity. Suggested change in policy in regard to U_1 zoning. Zone change should be applied for prior to the time of tentative map submittal. Requested. consideration of suggestion at early date. (e) Councilman Chermak also reiterated. problems of street cleaning because of construction. (f) Councilman Olivares also suggested some action be taken to control street debris. (g) Mayor Durnford related that City will possibly be losing street cleaning contractor. Mayor Durnford adjourned meeting to "Executive Session". "EXECUTIVE SESSION" Personnel matters related to the consideation for appointment of qualified and. responsible citizens of the community to serve on the "Architectural Board of Review" and. the "Site Plan Review Committee" were discussed. at some length. Appointments will be made at the next regular meeting of the City Council. The City Attorney suggested that the City Council continue to seriously consider the establishment of a Building Department and. the employment of adequate qualified. personnel, in the near future.
