64-0413_CC_Minutes_Regular Meeting348 Minutes of the Regular Meeting of the City Council of San Juan Capistrano APRIL 13, 1964 The regular meeting of the City Council was called to order at 7:31 P. M., by Mayor William A. Bathgate. The pledge of allegiance was recited. The invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and William A. Bathgate. _ Councilmen absent were: Eric F. Cliff. The minutes of the meeting held March 23, 1964 and the minutes of the adjourned meeting held April 6, 1964, were approved as submitted. WRITTEN COMMUNICATIONS: (a) Trends - informational (b) Jesus A. Bravo: letter requesting hourly raise from $2.50 to $3.50 per hour. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. (c) The Metropolitan Water District: request to go on record opposing Pacific Southwest Water Plan. Councilman Buchheim made a motion to continue until next regular meeting. The motion was seconded by Councilman Durnford and it carried unanimously. So ordered. (d) League of California Cities: Informational Buttetin and notice of 8th Biennial Institute for Mayors and Councilmen. (e) Rimel & Harvey: request for the abandonment of a portion of what was formerly Rosenbaum Road. Councilman Durnford offered resolution of intention to abandon portion of Rosenbaum Road from freeway fence to Camino Capistrano and also that applicant pay the costs of publication. The resolution was accepted, adopted and passed by a unanimous vote. (f) J. A. McCanne M. D.: requesting consideration be given to leash law. No action was taken. TREASURER'S REPORT: The Treasurer's Report for the month of March, 1964, was submitted by the City Treasurer, Alice M. Ross. Councilman Buchheim made a motion to accept the treasurer's report for the month of March, 1964. Councilman Durnford seconded the motion and it carried unanimously. APR 13 `�'-i 349 PLANNING COMMISSION REPORTS: (a) Authority for signs in subdivision other than P -D: Letter recommending that sign and/or subdivision ordinance be amended to permit signs within a standard subdivision comparabel to and under the same conditions as those authorized in P -D Ordinance. Discussion was held. Councilman Durnford made a motion to instruct City Attorney, John Dawson, to prepare an amendment to Ordinance No. 34 as an urgency ordinance and to provide same provisions as in P -C Ordinance. Council- man Buchheim seconded the motion and it carried unanimously. So ordered. (b) Received Tentative Tract Map from Fairlane Homes - P -D subdivision - public hearing set for April 21, 1964. (c) Two land use variances in estate zone. Public hearings set for April 21, 1964. UNFINISHED BUSINESS: (a) Proposed P -C Ordinance - John Dawson: Related the few changes he made in proposed PC Ordinance and stated that it was now ready for first reading if council wanted. Councilman Durnford made a motion to have ordinance read by title only. Councilman Olivares seconded the motion and it carried unanimously. So ordered. City Attorney, John Dawson, read ordinance by title only, ?An Ordinance of the City of San Juan Capistrano Establishing District Regulations For "PC, Planned Community" District Within the City of San Juan Capistrano". This constituted its first reading. (b) Camino Del Avion Annexation: Mr. J. Wall, representative of U -Mac, Company asked to either re- open public hearing or continue final determination over for one week. City Attorney stated there is no way the public hearing can be re -opened. Discussion was held. Request was granted to defer final determination for one week. "FIVE MINUTE RECESS" ............. NEW BUSINESS: (a) Notice of Intention - Resolution - Weed Abatement: APR13 'LN 350 Set protest hearing for Monday, June 8, 1964, at 8:00 P. M. Councilman Olivares offered resolution for weed abatement. The resolution was accepted, adopted and passed by a unanimous vote. (b) Val Verde, Corporation - Tract No 5513: City Administrator reported that all fees, bonds and certificates have been submitted. Only items outstanding would be approval of City Engineer and Director of Public Works. Councilman Buchheim offered resolution authorizing the Mayor and City Administrator to sign and accept final Tract Map No. 5513 subject to conditions set forth by City Engineer and Director of Public Works. The resolution was accepted, adopted and passed by a unanimous vote. (c) Letter from Councilman Cliff tendering his resignation to become effective April 30, 1964. y_ � Councilman Buchheim offered resolution of acceptance of resignation of Councilman Cliff and extended commendation and gratitude for his service to the City. The resolution was accepted, adopted and passed by a unanimous vote. (d) Harbor Security - request for business license: John Dawson, City Attorney, requested opportunity to look into matter and report back as to how it could be handled. (e) Children's Pre -School - application for business license in C-1 district which could be handled only by variance. No action taken at this time. RECOMMENDATIONS AND REPORTS: (a) City Administrator, Ernest A. Thompson: General Meeting of Orange County League of Cities to be hosted by San Juan Capistrano Thursday, April 23, 1964, at E1 Adobe restaurant. (b) City Attorney, John Dawson: (1) Reported that bars can now stay open for any election other than State-wide elections. (2) Reported that the Angels will be coming to Anaheim. (c) Director of Public Works, T. J. Meadows: (1) Reported letter from Paul W. Eastmen, Dept. of Health, Education and Welfare offering grant of $303,000.00 to City of San Juan Capistrano for Sewage Treatment Plant and Ocean Outfall. APR13 '6tl 351 Councilman Durnford offered resolution authorizing Director of Public Works to accept grant and to sign all necessary papers. The resolution was accepted, adopted and passed by a unanimous vote. (2) Hope to have joint powers agreement with Dana Point ready for council at next regular meeting. (3) Fisher and Lester have acquired sewer permit. (d) City Engineer, Jack Y. Kubota: (1) Dike & Colegrove: Some revision has been made on sewer plans and detailed pumping station. (2) Awaiting report from Engineering -Science on Morris Misbin tract. (3) Meeting with Val Verde engineers April 14, 1964. (e) Councilman Buchheim recommended that at least two councilmen be appointed to attend Dana Knolls Homeowner's meetings with regard to Waterworks District No. 4. Councilman Durnford made a motion to request that the Board of Supervisors notify City whenever a meeting concerning Waterworks District No. 4 comes before them. Councilman Buchheim seconded the motion and it carried unanimously. Mayor Bathgate appointed Councilman Buchheim and himself as committee to attend meetings. (f) Mayor Bathgate suggested that meeting adjourn to "Executive Session" to consider candidates to fill Councilman Cliff's vacancy. Councilman Durnford made motion to adjourn to "Executive Session". Councilman Olivares seconded the motion and it passed unanimously. So ordered. The members of the City Council convened at 10:20 P. M. in an "Executive Session" to suggest and consider possible persons who would be potential nominees for filling the vacancy on the City Council, created by the resig- nation of Eric F. Cliff.
