64-0406_CC_Minutes_Adjourned Regular Meeting346 Minutes of the Regularly Adjourned Meeting of the City Council of the City of San Juan Capistrano APRIL 6, 1964 The meeting was called to order at 7:32 P. M., by Mayor Pro -Tem, Don Durnford. The pledge of allegiance to the plag was recited. The invocation was given by City Attorney, John H. Dawson. City Clerk called the roll: Councilmen present: Carl E. Buchheim, Eric F. Cliff, Don Durnford and Antonio M. (Tony) Olivares. Councilmen absent: William A. Bathgate. Item #1. The draft of the proposed ordinance providing for the district regulations for PC, Planned Community District, was brought before the City Council for consideration at this time. Discussion was entered into by those councilmen present. Councilman Olivares injected the consider- ation of providing twenty (20) working days instead of the fifteen (15) working days for that section of Appeals for the City Council on page 24 of the draft #7. Mr. William Webb of the San Diego Gas & Electric Company proposed an addition of paragraph 4 to Section 21, Subsection H to contain the following "Provisions of this Section should not be construed to limit or interfere with the installation, maintenance and operation of electric, telephone or telegraph transmission or distribution lines, poles, towers or other utility structures when installed, maintained and operated in accordance with the rules and regulations of the State of California, Public Utilities Commission and with all other applicable laws." The City Attorney, Mr. John Dawson, then injected several items of evaluatron others --nothing more than phraseology; and others, the attitude and scope of feasibility of enforcement and execution. Based upon the discussion and consideration of the proposed ordinance for PC, Planned Community District Regulations, Councilman Buchheim moved that a study be set by the Mayor after full study and recommendations of the City Attorney had been submitted. Motion was seconded by Councilman Cliff and discussion followed whereby it was consented to withdraw the motion concurred by the second that the Mayor Pro -Tem appoint a committee to study and make recommendations for its adoption. Don Durnford, Mayor Pro - Tem, then appointed Councilman Cliff, Councilman Olivares and himself and suggested a meeting be held at 9:00 A. M., Saturday, April 18, 1964. At APR 6 %q 34'4' this meeting the Planning Commission would have representation to discuss the points of recommendation. Item #2. Camino Del Avion Annexation: Mr. J. Wall, representative of U -Mac, Incorporated, requested the City Council to consider the re -opening of the public hearing with reference to annexation. The reason for the request was based upon the possibility of withdrawal of the Petition for Annexation so that the principals might be 4)le to complete their engineering and financial transactions. After some discussion and consideration, the City Council felt that deferred action would be taken until the regular meeting of April 13, 1964. Item #3. Councilman Olivares reported the status of the proposed agree- ment with the Dana Point Sanitary District. He referred the discussion to the Director of Public Works, T. J. Meadows, Mr. Meadows related several facets of unacceptable provisions in the proposed draft, but assured the council that these would be worked out in the very near future. There being no further business to come before the City Council at this regularly adjourned session, the meeting adjourned at 9:07 P. M. Ern t A.
