MARCH 9, 1964
The regular meeting of the City Council was called to order at 7:33 P. M.,
by Mayor William A. Bathgate.
The pledge of allegiance was recited. The invocation was given by John
H. Dawson, City Attorney.
The City Clerk called the roll: Councilmen present were: Carl E.
Buchheim, Don Durnford, Antonio M. (Tony) Olivares and William A. Bathgate.
Councilmen absent: Eric F. Cliff.
Councilman Cliff arrived at 7:37 P. M.
The minutes of the meeting held February 24, 1964, were corrected to
delete Warrant No. 761 in the Treasurer's Demands and in its place issue
Warrant No. 777. The minutes were then approved as corrected. The minutes
of the regular adjourned meeting held February 28, 1964, were approved as
submitted.
WRITTEN COMMUNICATIONS
(a) Trends - informational
(b) City of Costs Mesa _ Resolution protesting division of telephone directory
for Orange County:
From the floor, Mr. Bob Gannon, local telephone company manager,
went on record recommending to the City Council that they do not join in
the resolution being passed against the division of the telephone
directory.
(c) City of Redondo Beach - Proposed Resolution Prohibiting Use of Tobacco
by Minors:
City Council concluded it is a legal problem and not controllable
under legislative body.
(d) Mrs. Ventura Nieblas - request for temporary permit for dancing:
Request for dancing and orchestra at the Las Rosas Spanish Restaurant
on the nights of March 21 and 22 during the hours of 8:00 P. M. to
2:00 A. M. Orchestra and dancing to be confined to interior of the
building.
Councilman Durnford made a motion that the request be granted. Council-
man Cliff seconded the motion and it passed unanimously. So ordered

ORAL COMMUNICATIONS
Bill Webb requested the exclusive right for sale of fireworks for American
Legion Post 721 in 1964 in compliance with State and County Safety Regulations
for site.
Councilman Cliff made a motion to permit the request under the same
conditions as the preceding year. Councilman Buchheim seconded the motion and
it carried unanimously. So ordered.
PUBLIC HEARINGS
(a) District Zoning - Tract No. 5399:
Mayor Bathgate opened public hearing.
There was no one present to make comments. There were "NO PROTESTS".
Mayor Bathgate closed the public hearing.
Councilman Durnford made a motion to have the "first reading" of
district zoning ordinance - Tract No. 5399 by title only. Councilman
Cliff seconded the motion and it carried unanimously. So ordered.
TREASURER'S REPORT
The Treasurer's Report for the month of February, 1964, was submitted by
the City Treasurer, Alice M. Ross.
City Clerk, Ernest A. Thompson, recommended separating retirement, health
and medical, and unappropriated reserves funds from general fund for auditing
purposes, to be done at the time of auditor's quarterly audit.
Councilman Cliff made a motion to separate funds for accounting purposes.
Councilman Buchheim seconded the motion. Ayes: Councilmen Cliff, Buchheim
and Olivares. Noes: Councilman Durnford.
Councilman Durnford made a motion to accept the treasurer's report for
the month of February, 1964. Councilman Cliff seconded the motion and it
carried unanimously.
COMMITTEE REPORTS
(a) Service Clubs sign - Chamber of Commerce:
Councilman Durnford reported that it is believed that Chamber of
Commerce has made arrangements with the Utilities Commission to place the
sign on poles.
Discussion was held.

John Dawson suggested the sign ordinance be amended to include
non -conforming signs. Mr. Dawson will have for next council meeting an
ordinance format for non -conforming signs and also a clause which could
be inserted in sign Ordinance No. 34 to amend to include non -conforming
signs for consideration by the council. Further action deferred.
PLANNING COMMISSION REPORT
(a) Robert K. Johns, secretary of the Planning Commission, stated that list
of conditions and two exhibits had been sent to Orange County Building
Department, Land Use Division regarding Land Use Variance No. 64-101 -
Val Verde Corp., golf course.
(b) P -D Development Plans, Tract No. 5513:
Continued to next regular meeting because certain plans required
under Ordinance No. 66 were not available or not in sufficient detail
to satisfy the commission.
(c) Change of Zone for Valley Property:
A request is before Orange County Planning Commission for change
of zone of Iwata and Remmers property to R4,7000 - PD -4000, "Suburban
Residential - Planned Development". Public hearing at 1:00 P. M.
March 25, 1964.
UNFINISHED BUSINESS
(a) Proposed Ordinance - amending Ordinance No. 51 and Ordinance No. 55 -
(Second Reading)
Deferred action. (Ordinance format not available.)
(b) Proposed Ordinance - amending Ordinance No. 53:
Mr. Dawson stated that the matter should be given considerable
thought. If the combustible materials are allowed by ordinance the
State Fire Underwriters will raise rates within Mission Zone Area.
Suggested possible way to solve problem would be for persons involved
to get easement from Orange County Bank covering side yard restrictions.

(a) Trash Pickup Franchise:
City Administrator, Ernest A. Thompson, questioned whether it
would be necessary to go to competetive bid for pickup.
Mr. Dawson, City Attorney, will report at next regular council meeting.

"FIVE MINUTE RECESS" ................
(b) Host General Meeting - Orange County League of Cities (Month of April)
Mayor Bathgate instructed City Clerk to draft letter to Orange
County League of Cities to make other considerations for the meeting of
the month of April.
(c) Comprehensive and General Liability Insurance - Notice of Renewal:
Councilman Buchheim made a motion to put comprehensive and general
liability insurance out for bid subject to specifications drawn up by
insurance man to be picked at the discretion of the City Administrator.
The motion was seconded by Councilman Durnford and it carried
unanimously. So ordered.
(d) Study of sixth draft of PCD, Planned Community Development Ordinance:
set for first reading March 23, 1964.
RECOMMENDATIONS and REPORTS
(a) City Administrator, Ernest A. Thompson:
Stated Executive Meeting of Orange County League of Cities is
Thursday, March 21, 1964, in Orange, California.
(b) City Attorney, John H. Dawson:
Suggested to council the re -codification of Land Use Ordinance.
Council to render decision at next council meeting.
(c) Director of Public Works, T. J. Meadows:
(1) City has been certified for a Federal grant of $303,000.
(2) Recommended sewer connection charge for Shell Station and Texaco
Station be $400.00 each.
Councilman Cliff made a motion to accept recommendation of
T. J. Meadows. Councilman Durnford seconded the motion and it
carried unanimously. So ordered.
(d) City Engineer, Jack Kubota:
(1) Office has approved all of the improvement plans for subdivision,
Dike & Colgrove. (Tract No. 5399)
(2) Darmi - Tentative approval of third revision of sewers.
(3) Val Verde - Referred to Engineering -Science for further look at
sewerage program for that part of property.

(4) Valley View - Wes Klusmann - Organization still wishes to go
ahead with plans.
(5) Reported that Weir Brothers will be happy to meet with council to
discuss regulations for adobe construction.
Tentative date for meeting set for work session at 3:00 P. M.,
March 23, 1964.
(e) City Attorney, John Dawson:
Suggested council rescind Resolution No. 64-2_24-3 approving Final
Map Tract No. 5513 since Val Verde has done nothing to comply with sub-
ject conditions.
G. Councilman Durnford offered resolution to rescind the original
resolution approving Final Tract Map No. 5513. The resolution was
accepted, adopted and passed by a unanimous vote.
(£) (1) Councilman Buchheim recommended that the problem of acquisition of
a library for the city be pursued.
(2) Complaints should be turned over to City Administrator regarding
littering of streets.
(g) (1) Mayor Bathgate related letter received to proclaim April 20-24
Public Schools Week in the State of California in this city.
Mayor Bathgate proclaimed April 20-24 as Public Schools Week
in the City of San Juan Capistrano.
(2) Letter and documents from Orange County Society for Crippled
Children and Adults asking to proclaim the month of March as Easter
Seal Month.
Mayor Bathgate proclaimed the month of March as Easter Seal
Month in the City of San Juan Capistrano.
The meeting adjourned at 10:06 P. M.
