64-0127_CC_Minutes_Regular Meeting313 Minutes of the Regular Meeting of the City Council of San Juan Capistrano JANUARY 27, 1964 The regular meeting of the City Council was called to order at 7:30 P. M., by Mayor William A. Bathgate. The pledge of allegiance was recited. The invocation was given by Ernest A. Thompson, City Clerk -Administrator. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Eric P. Cliff, Don Durnford, Antonio M. (Tony) Olivares and Mayor William A. Bath- gate. Councilmen absent: None. The minutes of the meeting held January 13, 1964, were approved as submitted. WRITTEN COMMUNICATIONS: (a) Trends - informational (b) Wes H. Klusmann - Valley View Project: Mayor Bathgate related request for general aporoval of a plan for streets and the cooperation of the city in the development of a complete plan for related improvements such as surface drainage and sewer lines, utilizing the provisions of the 1911 Act for organizing, developing and financing. Jack Kubota reported he had investigated the area and suggested a committee meet to discuss a possible program to initiate a 1911 act, and to present such program to the City Council. Mayor Bathgate appointed a committee composed of Carl E. 3uchheim (chairman) and Eric F. Cliff to meet with Jack Kubota. Mayor Bathgate requested legal advice of City Attorney, John Dawson, as to whether this matter could be worked on a contract basis. The City Attorney stated that there were several different ways the matter could be handled, but that in his opinion the best possible solution would be on a contract basis. (c) Mrs. Marcia Thurston - request for leave of absence: Councilman Durnford made a motion that a leave of absence be granted to Mrs. Thurston in accordance with Resolution No. 63-8-19-1, RULE XI, SECTION 4. Councilman Cliff seconded the motion and it carried unanimously. 3o ordered. (d) Public Utilities Commission - grade crossing: Councilman Durnf-)rd questioned whether the Public Utilities Commission has power to determine whether or not public safety requires physical pro- tection or alteration of such crossing and the construction and maintenance of protective devices thereat. City Attorney, John Dawson, stated that the JAN27 �6y 320 Public Utilities Commission does not have power to determine these facts. Mayor Bathgate requested the City Attorney to write a letter to the Public Utilities Commission requesting to be notified of their action. (e) Tract No. 5429 - Val Verde Corp. - James M. Barr: City Clerk read a letter from James M. Barr of Val Verde Corporation requesting participation in the trunk sewer line north of San Juan Creek, which is proposed to be constructed by San Juan Capistrano Assessment Dis- trict No. 1. The City Clerk was directed to write a letter to Engineering -Science informing them of this request. PUL3LIC HEARINGS: (a) U -Mac, Inc. - Camino Del Avion Annexation: Mayor Bathgate opened the Public Bearing on Camino Del Avion Annexation. Mr. J. Wall, representative of U -Mac, Inc., requested that this public hearing be continued until February 10, 1964. Mayor Bathgate asked for any objections from any one in the audience. There were no objections. Councilman Durnford made a motion to continue; seconded by Councilman Buchheim; and it carried unanimously. So ordered. (b) Capistrano Beach Maintenance District - (Sewers) Mayor Bathgate opened the Public Hearing. John Dawson, City Attorney, related that a change had been made in the legal description and northerly boundary to follow the existing property line. There were "No Protests". Mayor Bathgate declared the public hearing closed. John Dawson, City Attorney, read a proposed resolution to form Capistrano Beach Maintenance District No. 1. Councilman Buchheim offered the resolution for adoption. The resolution was accepted, adopted and passed by a unanimous vote. TREASURER'S DEMANDS: The list of demands and accounts payable on February 1, 1964, was sub- mitted by the City Treasurer, Alice M. Ross. City Clerk, Ernest A. Thompson, submitted billing from County of Orange, Division of Forestry, for fire protection. The City Clerk recommended that it be added to the list of demands, and that Warrant No. 743 be added in the JAN27 'bq 321 in the amount of $464.00. Councilman Cliff made a motion to approve the list of demands and instruct the City Treasurer to draft Warrants No. 704 thru 743 inclusive for a total amount of demands payable of $13,743.70. The motion was seconded by Councilman Durnford and it carried unanimously. So ordered. COMMITTEE REPORTS: (a) Traffic Committee: Councilman Durnford reported that the traffic committee met Friday, January 24, 1964, to examine passenger loading, zones. The committee recom- mended that the passenger loading zones for the Mission School, Mission Chapel and Community Presbyterian Church be marked "Passenger Loading, 'Lone" - and that the zone in front of the Mission Chapel and Community Presbyterian Church be stencilled "Sundays Only" - and the Mission School loading zone be stencilled "School Days Only". The loading zone for the Mission School should be approximately 60 feet long to accomodate the two school buses. The committee also recomended that "No Parking" signs be installed on Don Juan between E1 Camino Real and Guadalupe. Councilman Durnford offered a resolution that these recommendations be accepted as provided in Ordinance No. 84. The resolutionras accepted, adopted and passed by a unanimous vote of the City Council. PLANNING COMMISSION REPORTS: City Clerk, Ernest A. Thompson reporting: (a) Pre -zoning proposal - U -Mac, Inc.: City Clerk read a report from the Planning Commission setting the public hearing, for re -zone under the provisions of City Ordinance No. 83 of property described as Camino Del Avion Annexation, for February 4, 1964. (b) Proposed Amendment of Ordinance No. 51 - to permit swimming pools: City Clerk read a report from the Planning Commission requesting clarifi- cation as to why a building permit for the construction of swimming pools would not be issued in E-3 Zones. A recommendation was introduced by the Planning Commission that Ordinance No. 51 establishing regulations for E-1, E_2 and E-3 Zones be amended to permit swimming pools. John Da.oson related that as long as a structure (swimming pool in this instance) complied with the regulations regarding set backs that it would not 3AN27 'tY 322 be necessary to amend the ordinance. Councilman Buchheim made a motion that the City Council interpret Ordinance No. 51 to include swimming pools. Councilman Durnford seconded the motion, and it carried unanimously. So ordered. UNFINISIiED BUSINESS: (a) Ordinance No. 39 - Amendment: J. H. Dawson, City Attorney, reporting: The planning Commission had previously suggested that all service stations be established only through variance proceedings. However, the tendency is that certain zones should permit service stations as a matter of right. He stated that it is entirely up to the City Council, and extreme care in establishing a C-1 Zone for the control of service stations is a proper way to handle the matter. Jack Kubota, City Engineer, suggested that the City Council wait and see the developments of the proposed Texaco Service Station as far as architectural design is concerned. Mayor Bathgate concurred with this suggestion. (b) Purchase of 5 unit council table: City Clerk, Ernest A. 'Thompson, reporting: Suggested matter be deferred until a sufficient number of bids are submitted. (c) Tract 5429 - District zoning: Councilman Buchheim made a motion to set public hearing of proposed district zoning for February 10, 1964. The motion was seconded by Council- man Durnford, and it carried unanimously. So ordered. NEW BUSINESS• (a) Notice of General Municipal Election: City Clerk, Ernest A. Thompson, read the proposed resolution for the General Municipal Election by title only. Councilman Durnford offered the resolution for adoption. The resolution was accepted, adopted and passed by a unanimous vote. RECOMMENDATIONS and REPORTS: (a) City Administrator, Ernest A. Thompson: (1) The City Administrator reported that the tentative date set for the JAN2'Z 'bN 323 presentation of the General Plan of the Capistrano Valley has been changed from January 21, 1964, to January 30, 1964. (2) City Administrator related that the annual meeting of City Manager9 Division of the League of Cities is to be held in Palm Springs during February 19, 20, and 21, 1964, and requested that he attend the meeting. Councilman 9uchheim made a motion to send the City Administrator to the meeting. The motion was seconded by Councilman Durnford, and it carried unanimously. So ordered. (b) Director of Public Works, T. J. Meadows: (1) The Director of Public -forks stated he had received a report from the consulting engineers for the Dana Point Sanitary District. He related he hadn't had a chance to go over the report with Councilman Olivares and Joe Feeney. Further reporting to be at a liter date. (2) Lester & Fisher - Resolution No. 63-3-11-1 - Sewer Connection Fee Schedule: Recommended to the City Council that the fee of $250.00 be charged for the sewer connection. Councilman Buchheim made a motion to uphold the recommendation of T. J. Meadows. The motion was seconded by Councilman Cliff, and it carried unanimously. So ordered. (3) Boko Engineering - Volkswagon: Recommended to the City Council that the fee of $125.00 be charged for the sewer connection. Councilman Cliff made a motion to uphold the recommendation of T. J. Meadows. The motion was seconded by Councilman Durnford, and it carried unanimously. So ordered. (4) Accepted a check in the amount of $205.00 for reimbursement to Pacific Mobilhome Parks, Inc., as p-�r contract dated October 16, 1951, for connection and utilization of forced sewer line. (c) City Engineer - Jack Kubota: (1) Darmi, Inc., Tract 4678, storm drainage facilities are conforming to standards set forth by the City. (2) Dyke & Colgrove - Mesa Meadows - No determination has been made yet, regarding the possibility of saving the trees located at the northwest corner of the intersecti;n of Del Obispo Street and Alipaz Street, until street improvement plans are submitted. JAN 27 '6v 324 (3) San Juan Capistrano - 3oi1 Conservation District - Mr. Kubota related that if the City will substantiate $6,000.00 for drainage facilities, there could be a grant from State Government for these projects and the District's program. (4) Reported that Phase II of the Drainage Report will be delivered at the next council meeting. (d) Councilman Durnford related that Senator 111�irdy had offered his assistance and help in any matter while he is still in office. Councilman Durnford suggested that Senator Murdy might assist the city by getting some control over the speed limit on Ortega Highway, and also certain parking restrictions on lower end of Ortega. Councilman Durnford will write a letter to Senator Murdy requesting such assistance. (e) Mayor Bathgate informed the council of a letter from Mayor Rector L. Coons of Anaheim declaring January 30, 1964, "Angle Day". Mayor Bathgate read a proclamation declaring January 30, 1964, "Angel Day" in the City of San Juan Capistrano.
