63-1209_CC_Minutes_Regular Meeting30d Minutes of the Regular Meeting of the City Council of San Juan Capistrano DECEMBER 9. 1963 The regular meeting of the City Council was called to order at 7:30 P.M., by Mayor William A. Bathgate. The pledge of allegiance was recited. The invocation was given by John Daw- son, City Attorney. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares, and William A. Bathgate. Councilmen absent: Eric F. Cliff. The minutes of the meeting held November 26, 1963, were approved as submitted. Also, the minutes of the regular adjourned meeting held November 27, 1963, were approved as submitted. WRITTEN COMMUNICATIONS: (a) March of Dimes: Mayor Bathgate related that January, 1964, has been declared March of Dimes month and read the Mayor's proclamation. (b) City Clerk, Ernest A. Thompson read a letter from the San Juan Capistrano Chamber of Commerce requesting that the City Council consider placing trash cans at strategic places on the city streets. City Clerk instructed to draft a letter to explain the complexities and pro- hibitive conditions existing to date with regard for the consideration for place- ment of trash containers on sidewalks in the downtown areas. (c) City Clerk read a letter from Voorheis_Trindle-Nelson Inc., requesting that the conditions made by the Planning Commission in approving Tentative Tract No. 5429 requiring that San Juan Creek Road and lallovia Avenue be dedicated and fully improved to City standards be rescinded and asking the cooperation of the City in improving these highways. Deferred to item (a) in Planning Commission Reports. (d) City Clerk read a minute order of the Board of Supervisors of Orange County regarding the letter from Ernest A. Thompson, City Clerk -Administrator, regarding the report of the Population Research Committee indicating an increase of the population figure, and protesting payment of police protection contract services for the first quarter of the 1963-1964 fiscal year, which they referred to the Population Research Committee and Director of Finance for a joint report to the Board of Supervisors. Dec 9 '63 308 TREASURER'S REPORT: The Treasurer's Report for the month of November, 1963, was submitted by the City Treasurer, Alice M. Ross. Councilman Durnford made a motion that the report be received and filed. Councilman Buchheim seconded the motion and it carried unanimously. So ordered. COMMITTEE REPORTS: T. J. Meadows, Director of Public Works, reported he had a group meeting with City Engineer, Jack Kubota, representatives of Johns -Manville, and Joe Feeney to discuss the ramifications and proposed specifications that would be acceptable for inclusion in the sewer construction standards of the city. Mr. Meadows rec- ommended that the resolution be amended to include the changes in the standards. Councilman Durnford offered a resolution amending existing Resolution No. 63-3-1-1, with addenda no. 1 for Exhibit "A" and "B". The resolution was passed, adopted and approved by a unanimous vote of the Councilmen present (Councilman Cliff absent). PLANNING COMMISSION REPORTS: City Clerk, Ernest A. Thompson reporting: (a) Tract No. 5+29 - Val Verde Corporation - Tentative approved. City Clerk read a letter from the Planning Commission stating public hearing was held on December 3, 1963, and the Tract map was tentatively approved subject to conditions. Discussion was held regarding the letter from Voorheis-Trindle-Nelson Inc., requesting that the conditions made by the Planning Commission in approving Tenta- tive Tract 5+29 requiring that San Juan Creek Road and Lallovia be dedicated and fully improved to City Standards be rescinded and asking the cooperation of the city in improving these highways. Councilman Buchheim suggested that a committee, along with City Engineer, Jack Kubota, be appointed to study the matter and report back to the council. Mayor Bathgate appointed Councilman Durnford and Buchheim to meet with the City Engineer on December 10, 1963s 1:00 P.M. (b) Land Use Variance 63-115 - Mexico Lindo: City Clerk read a letter from the Planning Commission stating public hearing was held on December 3, 1963, and the variance was granted subject to conditions. Councilman Buchheim made a motion to uphold the recommendation of the Planning Commission on Land Use Variance 63-115. Councilman Durnford seconded the motion and it carried unanimously. DEC 9 ,61 (c) Tract No. 5407 - Darmi, Inc. _ Set for hearing: 309 City Clerk reported the plans have been submitted and the fees have been paid. Set for public hearing on December 17, 1963. UNFINISHED BUSINESS: (a) Zone Change Request _ Donald Reeve - (Second Reading): Councilman Buchheim made a motion to have the second reading by title only. Councilman Olivares seconded the motion and it carried. City Attorney, John Dawson read proposed Ordinance No. 82 by title only. This constituted the second reading. Councilman Durnford offered a resolution to adopt Ordinance No. 82 "An Ord- inance 0£ The City Of San Juan Capistrano, Amending Ordinance No. 5 And Adopting Sectional District Map Defining The Boundaries Of The C_1, Local Business District, Within The City Of San Juan Capistrano, California". The resolution was accepted, adopted and passed by a unanimous vote of the Councilmen present; (Councilman Cliff absent). (b) Pre -Zoning Ordinance - (Second Reading): Councilman Buchheim made a motion to have the second reading by title only. Councilman Durnford seconded the motion and it carried. City Attorney, John Dawson read proposed Ordinance No. 83 "An Ordinance Of The City Of San Juan Capistrano, Amending Ordinance No. 5 By Adding To Section 3A Thereof, Subsections 1, 2, 3, and 4 Dealing With Land Classifications", by title only. This constituted the second reading. Councilman Durnford offered a resolution to adopt Ordinance No. 83. The resolution was accepted, adopted, and passed by a unanimous vote ( Councilman Cliff absent). (c) Proposed Ordinance _ Traffic, Parking and Vehicle Regulations: Discussion was entered into for vehicles on sidewalks and private sidewalks; definition of heavy traffic as being vehicles of 12,000 pounds and greater; types of tires permitted on streets; and regulations of the loading zones. Councilman Buchheim made a motion to have the first reading of the proposed ordinance with the recommended revisions by title only. Councilman Durnford seconded the motion and it carried unanimously. City Attorney, John Dawson read the title of the proposed traffic ordinance. This constituted the first reading. (d) City Attorney, John Dawson reported on Maintenance District No. 1 and awaiting the Boundaries Commission report. Mr. Dawson suggested the Council give serious DEC 9 *63 310 consideration to passing the necessary resolutions so the city will be able to obtain tax revenues. City Attorney and City Administrator to inform Darmi, Inc., of the urgency of providing the necessary documents and descriptions to accomplish the procedure. NEW BUSINESS: (a) Bond Election - Canvass of Ballots: City Clerk, Ernest A. Thompson presented the ballots to the Councilmen to canvass the votes. (b) Resolution Declaring Result of Special Bond Election: This being the time and place fixed for the canvass of the returns of the special bond election held on December 3, 1963, the returns of said election were duly and regularly canvassed as provided by law. Councilman Durnford offered the following resolution declaring the results of said canvass be adopted, and that said resolution, together with the City Clerk's Statement, be set forth in full on the minutes, Resolution No. 63-12_9-49 "Reso- lution Of The City Council Of The City Of San Juan Capistrano, California, Declaring The Result of The Special Bond Election Held In Said City On December 3, 1963". The resolution was accepted, adopted and passed by a unanimous vote of those coun- cilmen present; (Councilman Cliff absent). (c) Councilman Olivares called on T. J. Meadows to explain the P. L. 660 Monies (Federal Grant). T. J. Meadows, Director of Public Works responded. RECOMMENDATIONS and REPORTS: (a) City Attorney, John Dawson related that he is ready to proceed with the legal considerations of the proposed 1911 Act Improvement as soon as the engineers have the plans and specifications completed. - (b) City Engineer, Jack Kubota reported they have completed the second phase of the Master Drainage Study. (c) Councilman Buchheim suggested that the County be informed of the attitude of the Telephone Company regarding the delay in street repairs. (d) Mayor Bathgate recommended that the Planning Commission seriously study the policy that should be taken by the City for selecting street names and numbering of the streets.
