Bathgate. The pled-, of allegiance was recited. The invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll: Councilmen present were: Car] E, Buchheim, Don Durnford, Antonio M. (Tony) Olivares, and William A. Bathgate. Councilmen absent were: Eric F. Cliff. The minutes of the previous meeting held Aup-ast 26, 1963, were approved as submitted. WRITTEN C01,21UNICATIONS: (a) Letter from the San Juan Capistrano Chamber of Commerce relating the expend- itures for the promotion of the community and thereby requesting- remuneration for the services rendered, The City Council began to review the matter at some length with discussion, reviewin- the previous letters and statements of costs that had been placed on file with the city previously. However, the City Council saw fit to take no action at this time upon the request. (b) Eng*ineering_Science, Incorporated, regarding interim report on sewage disnosal with the Dana Point Sanitary District. The City Council received a written report from Mr. Joe Feeney, En-ineerina_Science, Inc., Arcadia, California, relating, the aspect of an alternate location for the sewage disposal site and establishment of a sewage disposal plant. Report received and ordered filed. ORAL C01 1UNICATIONS: (a) Jack Kubota, City vin�ine.er, was requested by Councilman Buchheim to relate the matter of study for the ultimate density of development within the P -D, Planned Development District zone, as provided by the ordinance of the city. In reply, Mr. Kubota related several items of consideration in the density development. Thev are as follows: (a) minimum Bros„ floor areas, (b) additional bedrooms, (c) covered patios, (d) the 6o-40 ratio, (e) contingencies with respect to district tonin- of n.dioininr properties, for example, estate zonins� or R_l SEP10 '63 374 district zoning. Discussion folloTP d. As a conclusion thou -h, it *gas determined that. 11 units ner -ross acre could be the ultimate density development within the P -D, Planned Develonment Zones within our city. Captain Ed Holtz, Secretary of the Planning Commission, made comment that each proposed development within the P -D District Zones would be an individual case of consideration. As an added statement and announcement to both. the City Council and representatives of the Planning Commission, Mr. Jack Kubota reported that on Mondav, September 20, 1963, at the Ocean douse in San Diego, there would be a condominium conference. He urged that those that could be able to attend, do so, the conference would be verT informative. TREASURER'S REPORT: The Treasurer's Report for the month of AuF,ust, 1963, was submitted by the City 'Treasurer, Alice M. Hoss. After review of the report, Councilman Buchheim made a motion to accent the Treasurer's Report. The motion was duly seconded by Councilman Durnford. Motion carried and so ordered. COMIsiITTEE REPORTS: There were no committee reports to be submitted at this time. PLANNINU COitiR;Il- 3ION REPOUJ : Captain Ed Boltz, reporting for the Planning Commission, made announcements for forthcoming public hearings for the following: (a) Lone Change request - Darmi, Incornorated The Public Learing has been set for September 17, 1963, for the request of chanme of zone from R-1 to R -P for a portion of 1.r.d lying within Section 13-88 and Section 24-88 in the southerly portion of the city. (b) Zone Change recuest - Buchheim property Public Hearing has been set for 3ertember 17, 1963, for the change of zone request from U_l, Unclassified, to R-1, C-1, R-3, and P -D. The subject property lies within a portion of Section 36-7-8 and Section 1-8-8. (c) Sign Grant Request - Texaco, Incorporated Public Hearing has been set for September 17, 1963, to hear the Variance request for the installation of an oversized advertising sign nn pronert-* located at the southeast corner of F,l Camino Real_ and Orteea Hiphway. SEP10 '6i (d) Lone Change request - Oyharzabal property Public Hearing has been set for September 24, 1953, to hear the ?one Change request for the Oyharzabal property from the existinr, U-1, Unclassified /.one, for nronosed P_D, Planned Development Zoning. (e) Land Use Variance - 11illiam T. Reed The 11nd use variance of William T. Reed has been withdrawn. UNFINI,Jf)ED BUSINESS: (a) M -L, Limited Manufacturing District Regulations - 2nd Reading - Proposed Ord. On a motion, duly seconded and carried, the second reading of nroposed ordin- ance No. 73, setting forth the district regulations for the M -L, Limited Marnxfact_ uring District Regulations was heard. Councilman Durnford then offered a resolution for the adoption of the ordinance, Ordinance No. 73, "An Ordinance Amending City Ordinance No. 5 of th- City of San Juan Capistrano, California, by Incornoratinrr Therein Certain District Regulations Governing M -L, Limited Manufacturing; and Research District Regulations". The reso- lution was accept.Pd, adopted and approved by a unanimous vote. (b) District Zoning i'he issue of district zoning of an area within the city of San Juar Capistrano for C -2-A, General Business District - Restricted, was submitted by Councilman Durnford to be considered at this time. Basically, the recommendation had been I orthcoming by the City Planning Commission for this snecific area lying westerly of Alanaz Street and from Del Obisno Street to Camino Del Avion for this pr000sed district zoning. Therefore, Councilman Durnford moved that the district zoning ordinance be read by title only constitutinrT the first reading. The motion was seconded by Councilman Buchheim. The motion carried. (c) P -D, Planned Development District Zoning - Pr000sed 2nd Reading, of a District Zoning Ordinance Before the issue was actually taken under consideration for discussion, City Attorney, John Dawson related certain factors pertinent to the ,justification of the area to be considered for this specific zone, Captain Holtz, Secretary of the Planning Commission, reiterated that there had been no property owner objection at the Public Hearin?; and ILayor Bathgate felt that some decision should be warranted at the earliest possible time. However, no fur- ther action was taken at this time. (d) Joint -Powers Agreement SEPIO '(,3 4 ?76 City Attorney, John Da-rsnn, submitted a draft format of _joint -powers agree- ment for authorization for signature between the City of an Juan Capistrano and Capistrano 3eac1h Sanitary District for the inint utilization and disposition of sewerage on some 700 acres within the City for an interim neriod, not, to exceed five years. Discussion followed. Some of the Councilmen questioned th^ injection of cnnsi.der-_tion of n')yment of an additional 15' o-er the based assessed valuation tax figure being paid by properties within the Capistrano Beach Nanitary District, - now. Councilman Olivares, =Tong with Director of Public Works, T. J. Meadows, reminded the City Council that the negotiations with the Dana Point 3anitary Dis- trict should also be pursued in parallel and like manner. Therefore, Council action was deferred at this time. FIVE MINUTE RECESS Before entering upon the issues of New Business, the Citt Council called upon Mr. Joe Feenev, Eneineering-Science, Inc,., to Five a recap of highlimhte of the interim report for consideration in negotiating with the Dana. Point Sanitary Dis- trict for relocation of the ultimate site for a disnoeal plant for tre area. NEW 3USINESS: (a) Contract Agreement - En7ineerina_Science, Incorporated A draft of contract aereement, naming Engineering -Science, Inc., Arcadia, California, as engineer of work for the proposed 1911. Improvement Act District was submitted for review. The City Council discussed this very briefly, then referred the matter to the City Attorney for review and recommendations. (b) San Juan Elementary School District - Change of Boundaries John Dawson, City Attorney, reported the hearing before the 3oard of Super_ visors on September 10, this date, whereby the hearing was deferred for one weak. (c) Proposed Contract Agreement - j3nird of lupervisors _ re: 'Later Servicing - Orange Countv Waterworks District No. 4, Tri -Cities 74ater District, Irvine Ranch, and hi^ulton_Niguel .4ater District. The proposed contract draft was referred to City Attorney, John Dawson, for review and opinion. (d) City Attorney, John Dawson, read a resolution for the proposed dissolution of Orange County 'Waterworks District No. 4 as offered and accepted by the City SEP10 '" V%l Council at a prior meeting. Copies were submitted. Added note was made here that this resolution should be accompanied by signatures of 50 freeholders *.within the Orange County Waterworks District No. 4 before being transmitted to the Board of Supervisors. The City Clerk was instructed to draft the appropriate appendage sheet for such signatures as required. RECOMMENDATIONS and REPORTS: (a) City Administrator, Ernest A. Thompson Mr. Thompson related the scheduled meeting of the Orange County League of Cities to be held Thursday evening, 6:45 P.M., in the City of Orange at Friedemann Hall, Ceptember 12, 1963. (b) Councilman Durnford issued. a commendation to Councilman Buchheim for his efforts in obtaining a school crossing sign for Camino Capistrano from the Mission School. An added and extended commendation should be also made to the Missinn School. There being no further official husiness to be taken uo at this time, the meeting, adjourned at 1D:10 P.I4.
