63-0819_CC_Minutes_Regular MeetingMinutes of the Regular Adjourned Meeting of the City Council of San Juan Capistrano AUGUST 19.1963 The regular adjourned meeting of the City Council was called to order at 7:30 P.M., by Mayor William A. Bathgate. The pledge of allegiance was recited. The invocation was given by Ernest A. Thompson, City Clerk. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares, and William A. Bathgate. Councilmen absent: Eric F. Cliff. The minutes of the previous meeting held August 12, 1963, were approved as submitted. WRITTEN COMMUNICATIONS: (a) Mayor Bathgate related the receipt of an application for permit for solicit- ation of donations within the City from the Muscular Dystrophy Associations of America, Inc., Orange County Chapter. Councilman Durnford made a motion that no action be taken at this time and to instruct the City Clerk to investigate and report within 30 days. The motion was seconded by Councilman Olivares and passed unanimously. So ordered. (b) Mayor Bathgate informed of the receipt of a letter and ordinance format from the Orange County League of Cities pertaining, to proposed uniform curfew ordinance. Discussion was held. Councilman Durnford made a motion that no action be taken and referred to the City Attorney for study, Councilman 3uchheim seconded the motion and carried unan- imously. (c) City Clerk, Ernest A. Thompson, reported the City of Los Alamitos is hosting the August 29th meeting of the Orange County League of Cities. The meeting will be held at 7:00 P.M. at the Chicken Dinner Restaurant, Knott's Berry Farm, Buena Park. (d) City Clerk read a letter from the California Highway Patrol relating the laws pertaining; to school crossing signs, (e) City Clerk read a letter from Mr. Jack Kubota, City Engineer, presenting the scope for Phase II _ Drainage Study. Councilman Buchheim made a motion that authorization to proceed on Drainage Study - Phase II be given. Councilman Durnford seconded the motion and it carried unanimously. AUG19 '63 265 lob (f) City Clerk read a letter from Dr. J. A. and i'Innte McCann reF�arding the need of a dentist located in the City. City Clerk informed of the possibility of Dr. Andrew, a dentist who has been inquiring of the position. (g) City Clerk related the Public Utilities Commission is required by legislation contained in the Streets and Highways Code to establish a priority list of those railroad crossings of city streets or county roads most urgently in need of sepa- ration or existing separation structures most urgently in need of alteration. City Clerk listed the priority rating as (1) Del Obispo, (2) Verdugo, and (3) Oso Road, in which the Councilmen fully agreed. City Clerk directed to send a letter to the Commission informing of the pri- ority list. (h) City Clerk read a letter .from the Department of Public Storks, Division of Hinh_ ways, District VII, rewarding resolutions required of Cities pursuant to Collier_ Unruh Local Transportation Development Act. City Clerk to duolic,-tte copies and submit to the Councilmen and City Attorney I or the next regular meeting. TREASURER'S REPORT: The monthly report of the financial status of the City of San Juan Capistrano for the month ending July 31, 1963, was submitted by the City Treasurer, Alice Ross. Councilman Durnford made a motion to approve and accept the 'Preasurer's Report for the month ending July 31, 1903. The motion was seconded by Councilman Buchheim. The motion was passed and report ordered filed. COMMITTEE REPORTS: Councilman Buchheim reported he had contacted the Mission regarding school crossing signs for placement on Camino Capistrano at Mission Street. Mayor Bath_ _. gate and City Administrator to approach the high school in regards to a similar request. PUBLIC HEARING: (a) M -L, Limited Manufacturing District Regulations: IJiayor Bathgate opened the Public Hearing. After some discussion, Councilman Durnford moved that the hearing be continued until the next regular meeting. Councilman Buchheim seconded the motion and carried unanimously. City Clerk directed to revise and correct the regulations. AUG19 '63 20""i Mayor Bathgate then announced the hearing as closed. (b) M -L, C -2-A, and P_D District Zoning: (1) M_L District Zoning: 14-L 'Zoning not qualified to be considered until the M -L District Regu- lations are approved, and in full force and effect. (2) C -2_A District Zoning: Mayor Bathgate opened the Public Hearing. Protests were heard from the Oyharzabal's, Mrs. Fran Hobart, and Mr. Lynn Shrewsbury. Discussion was held. Mr. Ed Holtz stated the Planning Commission's recom- mendation. There were no further protests. Mayor Bathgate announced the hearing closed. Councilman Durnford stated he wished to go on record as opposing any manu- facturing, light or heavy, in the lover valley. Councilman Buchheim moved to table the matter of C_2 -A District Zone until decision is made on 'T4 -L" designated area, by exhibit. Motion passed and so ordered. (3) P_D District Zoning: Mayor Bathgate opened the Public Hearing, There were NO PROTESTS, Mayor Bathgate announced the hearing closed. Councilman Buchheim made a motion for the first reading of the proposed ordinance by title only. Councilman Durnford seconded the motion and carried unanimously. City Clerk read the title of the proposed ordinance constituting the first reading. FIVE MTINUCE RECESS PLANNING COMMISSION REPORTS: The Planning Commission Reports were given by Edward H,ltz, Secretary of the Planning Commission. (a) Russ Waters - Variance: Public Bearing was held on July 16, 1963- Mr. Iioltz read a letter from the Planning Commission recommending approval of the Variance. Councilman Buchheim made a motion to uphold and approve the recommendation of the Planning Commission. Councilman Olivares seconded the motion and carried unanimously. AUG 19 '(03 268 (b) Dan Brown _ Division of Land: Mr. Holtz reported that no action can be taken other than denial, until the adequate road easement right of way problem is solved. (c) Texaco _ Deferred Mr. Holtz reported deferred action has been taken due to the difference in the artist's concept and elevation plans, signs and materials. (d) Mayor Bathgate expressed appreciation and thanks to Mr. Holtz for attending the Board of Supervisors meeting, wherein he expressed the views of the City regarding preservation of the open fli*ht zone to the i''l Toro 11.arine Base. UNFINISHED BUSINESS: (a) Personnel Rules and Regulations _ Resolution Councilman Buchheim offered a motion to adopt the resolution. The resolution was accented, adopted and passed by a unanimous vote. (b) Civil Defense - Resolution of Endorsement Discussion was held. Mayor Bathgate made a motion to adopt the resolution. Councilman Buchheim and Olivares voted "NOE". Due to a tie vote, the motion was defeated. (c) Building, Electrical, Plumbing Codes, etc. _ Resolution. Councilman Durnford offered a resolution urging the continuance of the Uniform Building Code, the Uniform Housing Code, the Uniform Plumbing Code, and the National Electric Code, as instruments of Municipal. jurisdiction. The resolution was accepted, adopted, and passed by a unanimous vote. City Clerk directed to draft the resolution and send to: Mr. Al Hall, Director of the Leaves of Cities; office of the Governor; Board of Supervisors; and Mr. C. W. Donahue, Supt, of Building and Safety. NEW BUSINESS: (a) Street Sweeping Contract - Crates Sweeping - Approval and execution Discussion was held. Councilman Durnford moved that the City Clerk be instructed to contact the businessmen in the City and ask them to represent themselves at the study session at 3:00 P.M. on Monday, August 26, 1963, and also to explain the situation to Mr. Gates. Councilman Buchheim seconded the motion and carried unanimously. RECOM1,IENDATIONS AND REPORTS: (a) City Administrator, Ernest A. Thompson, informed of the urgency Ordinance 1664 to be in effect for 60 days by the County of Orange for zoning control of the flight AUCI9 'L3 269 path to El Toro. (b) Director of Public Works, T. J. Meadows, reported another session with the Dana Point Sanitary Board. They had suggested that San Juan Capistrano consider building a plant farther upstream from the Dana Point facilities, but still share in the use of the ocean outfall line. Mr. Joe Feeney is to supply supplemental information to resolve some of these factors being, contended. (c) Mayor Bathgate informed that the resolution for a Tourist Routing Survey was just to consist of the Valley rather than countywide. Councilman Durnford offered a resolution rescending the previous resolution and therefor requesting the 'Tourist -Routing' survey be made for the Capistrano Valley. The resolution was accepted and adopted by a unanimous vote of the Coun_ oil. The meeting adjourned at 10:10 P.M. E st A.
