63-0603_CC_Minutes_Regular Meeting241 ` Minutes of the Regular Adjourned Meeting of the City Council of San Juan Capistrano June 3, 1963 Mayor William A. Bathgate called the meeting to order at 2:05 P.M. The pledge of allegiance to the flag was recited. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Don Durnford, Tony Olivares, and William A. Bathgate. Councilmen absent: Eric F. Cliff.* *(Councilman Cliff arrived later at 2:15 P.M.) COMMITTEE REPORTS: (a) An item regarding a preliminary feasibility report with respect to sewer facilities being developed and tied into the Dana Point Sanitary District treat- ment plant was deferred by the City Council until this time, in order to more com- pletely receive and discuss the matter. Mr. Joe Feeney, Engineering -Science, Arcadia, California, the consulting engineer retained by the City gave his report. In the report, five alternates were extended for consideration, but the fifth one was recommended as most feasible. After lengthy discussion regarding engineering, financing, time schedule and possible legal and .joint -power agreement aspects, Councilman Durnford made a motion that the City of San Juan Capistrano approach the Dana Point Sanitary District on the basis of the recommended alternate number 5. The motion was seconded by Coun_ oilman Buchheim; passed and so ordered. Mr. Joe Feeney will rewrite the report with the view in mind and supply 20 copies prior to the regularly scheduled meeting of the Dana Point Sanitary District on June 129 1963, at 7:30 P.M. (b) An added facet of sanitary and sewer conditions was injected, at this time, _ regarding the proposal of Mr. Clarence R. Brown for resolving the serious condition at the Colony Kitchen and Standard Oil Service Station. It was felt that this proposal should spearhead and expedite the proposed 1911 Improvement District in the area. UNFINISHED BUSINESS: (a) Architectural District _ extension westerly Councilman Durnford reiterated the background and proposal for the expansion of the "Mission Area", in order to retain a unique atmosphere and motif for the "central downtown area" existing to date. JUN 3 '(-) 243 Discussion followed among the various Councilmen concerning the 'pros and cons' and added imposition upon the property owners in the area. Mayor Bathgate specifically endorsed the proposal of extending the architec- tural controlled district westerly. Councilman Durnford offered a resolution to adopt the ordinance, after its second reading by title only; Ordinance No. 69 "An Ordinance of the City of San Juan Capistrano, Amending Ordinance No. 31 by Revising Section No. 9 Thereof for Extending the Boundaries of the Mission Area Architectural Restricted Zone." The resolution was adopted by a majority vote, with Councilman Olivares voting 'NOE'. (b) Personnel System - proposed ordinance for the establishment of the personnel system of the City. Consideration for the second reading and possible adoption was undertaken by the Council. Some revision and clarification was made to the proposed format. Second reading by title only failed, therefor, the City Clerk read the pro- posed Ordinance in full. Councilman Durnford offered a resolution to accept and adopt the ordinance, Ordinance No. 70 - "An Ordinance of the City of San Juan Capistrano establishing a Personnel System." The resolution was passed, accepted, and approved by a majority vote, with Councilman Olivares voting 'NOE'. RECESS - until &:30 P.M. The City Council reconvened and considered further 'Unfinished Business'. (c) Personnel Compensation and Classification - proposed ordinance The City Council had received the proposed ordinance format, and thereupon considered it section by section by the reading of each section. After full deliberation, Mayor Bathgate made a motion that the second reading of the proposed ordinance by title only. So ordered. Councilman Buchheim offered the resolution of adoption of Ordinance No. 71, "An Ordinance of the City Council of the City of San Juan Capistrano providing for the Compensation of City Officers and Employees in the Various and Several Offices of the City." The resolution was passed, accepted, and approved by a unanimous vote. (d) Duties of the post of City Administrator - proposed resolution. JUN 3 16 3 244 Councilman Cliff felt this resolution had merit and priority and made a motion that the Council consider it during a session on June 10th, 1963, at 3:00 P.M. Motion carried and so ordered. (e) Personnel Rules and Regulations _ proposed resolution Deferred action. (f) State Highway Fund Expenditure A project statement was submitted by the City Engineer, Jack Y. Kubota, for application for said funds. Councilman Durnford offered the resolution approving and adopting the project statement. The resolution was accepted and approved by a unanimous vote. (g) Information was revealed by Councilman Durnford regarding historical and tour- ist recognition of the area of San Juan Capistrano. He further related a possible coordinated program to promote and advance this recognition and the setting aside by designation those historical buildings and landmarks for continued preservation. Mayor Bathgate appointed Councilman Durnford and Councilman Buchheim to con- tact the County and Supervisor Alton Allen to further pursue this matter. (h) Mr. L. R. Baker, a resident of the San Juan Park area was recognized by the Council. He entered a protest of the delay in development and installation of sewer facilities in his area. This protest was rebutted by statements of the individual Councilmen and the Director of Public Works. However, Councilman Buchheim made a motion that a letter be sent to the chair- man of the area committee (Mr. Richard Newcom) requesting a decision of intent be submitted to the City Council prior to July 1, 1963; the letter to be signed by the Mayor, City Administrator and Director of Public Works. The motion was seconded by Councilman Durnford. Passed and so ordered. _ The meeting adjourned at 9%25 P.M. L E st A.
