63-0527_CC_Minutes_Regular MeetingCouncilman Buchheim suggested that copies of the letter be given to the Plan- ning Commission. PUBLIC HEARINGS: (a) Weed Abatement: Mayor Bathgate opened Public Hearing on Weed Abatement and announced that the property has been posted and also the property owners were notified by mail. City Clerk, Ernest A. Thompson, announced that the property is to be cleaned by June 11, 1963, and that the City will appoint a crew to clean property which has not been cleaned by that time and the charge will be put on their taxes. There were NO PROTESTS. Therefore, Mayor Bathgate announced the baring closed. (b) M -L, Limited -Manufacturing District Regulations: Mayor Bathgate opened Public Hearing on M_L District Regulations. City Clerk, Ernest Thompson, read a letter from the Planning Commission to the City Council regarding the letter from the San Diego Gas and Electric Company which related a receptive attitude of the proposed clarifications and amendments extended by the San Diego Gas and Electric Company. City Clerk read a letter from the San Diego Gas and Electric Company commending the Planning Commission for their understanding and consideration. There were NO PROTESTS. Therefore, Mayor Bathgate declared the hearing closed. Lengthy discussion was held. Councilman Cliff requested that action be deferred until additional information is received. TREASURER'S DEMANDS: The list of demands and accounts payable on June 1, 1963, was submitted by the City Treasurer, Mrs. Alice M. Ross. Councilman Cliff made a motion to accept and approve for payment, the list of demands, as submitted; duly seconded by Councilman Buchheim. Passed unanimously and so ordered. COMMITTEE REPORTS: Mr. T. J. Meadows, Director of Public Works, apologised for Mr. Joe Feeney who could not be in attendance at the meeting and requested that an adjourned meeting be set for the matter of Municipal Sewers. Mayor Bathgate felt that an adjourned meeting was in order, which was set for June 3, 1963, at 2:00 P.M. PLANNING COMMISSION REPORTS: The Planning Commission reports were given by the Secretary of the Planning MAY 27 '63 C'4'0 Commission, Mr. Ed W. Boltz. (a) Trailer Dwelling - Variance Application: Mr. Holtz reported the application from Mr. Charles Duke (employee of Loughridge) for a one (1) year duration. Public Hearing set for June 4, 1963. (b) Lower Capistrano Valley Zoning: Mr. Holtz reported that the Commission has completed the Public Hearings. The City Engineer's report to be presented at the meeting of the Commission _ on May 28, 1963, and also are expecting the County study soon. (c) Announcements: Million -dollar mall project in the mill, is being proposed by Mr. Les Jones, purchaser of the 'Las Rosas' building. UNFINISHED BUSINESS: (a) Architectural District - extension westerly (Second Reading of Ordinance) Councilman Buchheim moved that the extension ordinance be read by title only. The motion was seconded by Councilman Cliff. Councilman Olivares voted "Noe", therefore, the Ordinance was read in full by John Dawson, City Attorney. Councilman Olivares felt that the extension would cause a hardship to many people because they would have to conform to the architectural demand if their house should happen to burn down. Deferred action until a full council is present. (b) R -P, Residential -Professional District Regulations (Second Reading of Ordi- nance No. 67) Councilman Cliff made a motion that Ordinance No. 67 be read by title only. Councilman Olivares questioned why the Ordinance couldn't be read in full again. Mayor Bathgate directed John Dawson, City Attorney to read the Ordinance in full. City Attorney, John Dawson, read Ordinance No. 67 in full. This constituted the "Second Reading" Mayor Bathgate offered a resolution to adopt the Ordinance No. 67, "An Ordi- nance Amending City Ordinance No. 5 of the City of San Juan Capistrano, California, by Incorporating Therein Certain District Regulations Governing R -P, Residential Professional Districts." The resolution was accepted, adopted, and passed by a unanimous vote. (e) District Zoning - E-3, R-1, and C_1 (Second Reading of Ordinance No. 68) Councilman Cliff made a motion that Ordinance No. 68 be read by title only. The motion was seconded by Councilman Bathgate. Councilman Buchheim voted "Noe", MAY 27 163 therefore, Ordinance No. 68 was read in full by City Attorney, John Dawson. This constituted the "Second Reading". Councilman Cliff offered a resolution to adopt Ordinance No. 68, "An Ordinance of the City of San Juan Capistrano Adopting Sectional City Map Defining the Boun- daries of Certain City Areas as E-3, Small Estates District; R_1, Single -Family Residential District; and C-1, Local Business District." The resolution was ac- cepted, adopted, and passed by a unanimous vote. (d) Personnel System Establishment (Second Reading of Ordinance) Councilman Cliff felt that there should be another study session held; Coun- cilman Buchheim agreed. (e) Personnel Compensation and Classifications (Second Reading of Ordinance) Items (d) and (e) deferred, and will be discussed on June 3, 1963, if there is time after the Municipal Sewer Meeting. NEW BUSINESS: (a) State Highway Fund Expenditure - Budget Resolution Jack Kubota, City Engineer, related provisions of Section 197 of the Streets and Highways Code, relating to the procedures for applying for said funds. Action deferred until June 3, 1963. RECOMMENDATIONS AND REPORTS: (a) Councilman Buchheim questioned if John Dawson, City Attorney, had determined whether San Juan Capistrano can de -annex from the County Library and Cemetary dis- tricts. (b) Mayor Bathgate presented a resolution which established fully under City law the position of the City Administrator, and felt that it should be given consider- ation in the near future.
