63-0422_CC_Minutes_Regular Meeting2216 Minutes of the Regular Meeting of the City Council of San Juan Capistrano April 22, 1963 The regular meeting of the City Council was called to order at 7:30 P.M., by Mayor William A. Bathgate. The pledge of allegiance to the flag was recited. The invocation was given by Karl Wray, publisher of the Coastline Dispatch. The City Clerk called the roll: Councilmen present were: Carl E. Buchheim, Eric F. Cliff, Don Durnford, Antonio M. (Tony) Olivares, and William A. Bathgate; Councilmen absent: None. The Minutes of the previous meeting held April 22, 1963, were approved as submitted. WRITTEN COMMUNICATIONS: (a) City Clerk, Ernest A. Thompson, read a letter from Clarence Lobo, expressing his desire to proceed in establishing a tourist "Tram" in compliance with the proposed amendment of Ordinance No. 35- (b) City Clerk, read a letter from the home owners on Avenida Los Cerritos requesting that a "Slow - Children at Play" sign be erected for the safety of the children in the area due to the use of excessive speed on Los Cerritos. Councilman Buchheim felt that if they erected a sign for them, many citizens would begin requesting signs all over the area. Councilman Cliff added that if it is done for one section, it would have to be done for the entire City. Mayor Bathgate stated the sign refers to the street as a playground. Mr. Ed Holtz, a property owner on Avenida Los Cerritos, explained that the street is often used for drag racing. Councilman Durnford moved that the petitioners be allowed to put up the sign requested, at their own expense. Councilman Cliff seconded the motion and carried unanimously. (c) City Clerk read a letter from William J. Phillips, Board of Supervisors of Orange County, regarding their adoption of a resolution requesting that Orange County be separated from the Los Angeles -Long Beach Standard Metropolitan Area and becoming a separate Standard Metropolitan Area. Councilman Olivares asked for reading of the Resolution in which City Clerk, Ernest A. Thompson, complied. City Attorney, John Dawson, stated that it is a worthwhile project and felt that San Juan Capistrano is now ready for it. /-,/- z i- - 6 3 227 Councilman Buchheim proposed a resolution that we adopt the resolution pre- sented by the Board of Supervisors of Orange County. The resolution was passed, accepted, and adopted by a unanimous vote. Councilman Durnford moved that the resolution be forwarded to the Mayor of Anaheim with a proxy to represent the City in Washington, D.C. The motion was seconded by Councilman Buchheim and passed unanimously. (d) Ernest A. Thompson, City Clerk, read a letter from the City of Anaheim opposing Assembly Bill No. 351• Councilman Buchheim offered a resolution for adoption of the resolution as stated by the City of Anaheim. The resolution was passed, accepted and adopted by a unanimous vote. (e) City Clerk read a letter from State Division of Highways concerning the budgeting of funds for general maintenance of City streets, but must have an approved project in order to approve. Ernest A. Thompson, City Clerk, recommended that they instruct the City Engineer to draft a feasible project for gaining these funds. Mayor Bathgate directed the City Engineer to work with the City Clerk on a proposed project to process said fund application. (f) A letter was read by the City Clerk from the Orange Empire Council for Boy Scouts of America, requesting permission for the sale of tickets by the Boy Scouts for the Scout -O -Rama to be held May 24th and 25th. Councilman Durnford made a motion to grant the request, seconded by Council- man Cliff and carried unanimously. TREASURER'S DEMANDS: The list of demands and accounts payable on May 1, 1963, was submitted by the City Treasurer, Mrs. Alice M. Ross. Councilman Cliff made a motion to accept and approve for payment, the list of demands, as submitted; duly seconded by Councilman Durnford. Passed unanimously and so ordered. COMMITTEE REPORTS: Sewer Committee - re: Dana Point Meeting Councilman Olivares turned the discussion over to T. J. Meadows, Director of Public Works. Mr. Meadows reported the meeting in which he and Councilman Olivares attended on April 10, in which they presented a request to tie in with the Dana Point dewer facilities which was receptive, but studies for engineering should be 4 z:-63 228 made and be presented at Dana Point's next meeting. Councilman Cliff made a motion to authorize the Consulting Engineer, Joe Feeney, to prepare a report and that the matter be deferred until research is completed. Motion was seconded by Councilman Buchheim. Passed unanimously and so ordered. City Attorney, John Dawson, told of a new sewer process which he fei would be worth looking into. PLANNING COMMISSION REPORTS: (a) M.L. Limited Manufacturing District regulations: Mr. Ed Holtz, Secretary of the Planning Commission, read the explanation for the Limited Manufacturing regulations and presented a proposed Ordinance and recommendation for approval from the Planning Commission. Upon recommendation of City Clerk, Ernest A. Thompson, Councilman Buchheim made a motion that May 27, 8:00 P.M., be the date set for public hearing. Motion seconded by Councilman Olivares and passed unanimously. (b) The precise alignment adopted for Alipaz Street by ordinance of Orange County. (c) Mr. Holtz reported the Planning Commission's decision of denial on Tract 5100 (Di Maio property) based upon the technicalities of the map which is going to be resubmitted. (d) Public Hearing, May 7, on M -L, C -2-A, and P_D zoning, for portions of Section 12-8_8, lying southerly and easterly of Del Obispo. UNFINISHED BUSINESS: (a) Proposed Ordinance - amending Ordinance No. 35 to permit excursion trams. City Attorney, John Dawson, read the proposed Ordinance with its corrections and deletions. Councilman Durnford made a motion that this be the first reading of the Ordinance amending Ordinance No. 35. The motion was seconded by Councilman Cliff and passed unanimously. (b) Public Hearing - Parks and Highways District zoning (five parcels) No-one spoke in protest or opposition, therefore, hearing was declared closed. Councilman Durnford pointed out on the map, the location of the five parcels at the suggestion of Councilman Olivares. City Attorney, John Dawson, read the Ordinance adopting certain parcels of land as Parks and Highway zones. Councilman Durnford made a motion that this be constituted the first reading N-2--A-G3 22:1 of the Ordinance for zoning Parks and Highways. The motion was seconded by Coun- cilman Cliff and carried unanimously. (c) Public Hearing - P -D, Planned Development District regulations. No-one spoke in protest or opposition, therefore, hearing was declared closed. Councilman Buchheim moved that the first reading of the Ordinance be read by title only. Motion was seconded by Councilman Durnford, and passed unanimously. (d) Re-establishment of Municipal Sewer District. Councilman Cliff stated that they were not ready to decide until a report has been prepared. Councilman Durnford moved that the matter be tabled until they get further information and a report is presented. Councilman Buchheim seconded the motion and further stated that a determination should be made on May 27th. Passed unanimously and so ordered. NEW BUSINESS: (a) Weed Abatement - Resolution Councilman Buchheim offered a resolution directing the weed abatement. Roll call was taken; resolution was passed, accepted, and adopted by a majority vote of 4 to 1 (Councilman Olivares casting the dissenting vote). (b) Easement Deed. Camino Capistrano (Dr. J. A. McCanne) Councilman Cliff offered a resolution to accept the deed to convey easement on Camino Capistrano. The resolution was passed, accepted, and adopted by a unanimous vote. (c) Irrevocable offer to convey easement of property owned by Charles R. Williams in accordance with Ordinance No. 56 whereby he conveys the Southwesterly 122 feet and offered documents for acceptance and to be recorded. Councilman Durnford moved to receive the documents and instruct City Clerk to hold for recording. Motion seconded by Councilman Cliff and passed unanimously. RECOMMENDATIONS AND REPORTS: (a) City Clerk, Ernest A. Thompson, announced the general meeting of the Orange County Division League of Cities meeting at the Meadowlark Country Club on April 25, 1963, with the City of Huntington Beach as host. (b) City Attorney, John Dawson, reported that he contacted Mr. W. J. Burke regarding business license fees. Burke stated he would pay no fees to the City and advised to speak with the Orange County Building Contractors Association in which he did and was asked to defer the matter until Tuesday, April 23, 1963, for their decis- ion. Mr. Dawson then advised that if the decision was not acceptable, the City Al -y}-6 3 23fj Clerk should then file in small claims court. (c) T. J. Meadows, Director of Public Works, reported a meeting of the San Diego Regional Water Pollution Control Board which he and Councilman Olivares attended. Mr. Meadows reported that San Juan Capistrano received 21.8 points of priority for allocation of federal funds to improve it's sanitary facilities. (d) Mayor William A. Bathgate inquired about the sewer easement for San Juan School District. It was resolved that City Attorney, John Dawson, prepare the necessary doc- uments for a quick claim deed.
