Minutes of the Regular Meeting of the City Council of San Juan
Capistrano.
September 24, 1962
The meeting was called to order by ;'9ayor Carl E. 3uchheim at 7:35
P. M.; followed by the pledge of allegiance to the flag and invocation.
The City Clerk called the roll. Councilmen present were: William
A. 3athgate, Eric F. Cliff, Don Durnford, Antonio (T�ny) M. Olivares
and Carl E. 3uchheim, Councilmen absent: Nine.
The minutes )f the regular meeting, held September 10, 1962, were
approved as submitted.
CLAIM:
,The claim submitted by Helen 3ordash, 1118 'Nest 91st Street, Los
Angeles 44, Calif)rnia, was read, in full, by the City Clerk. The claim
against the City requested an initial reimbursement for injuries suffer-
ed, in the amount of X5,841.00.
The City Council denied payment of the claim, and instructed the
City Clerk to refer the matter to the City Attorney and the insurance
agent for the City.
WRITTEN COHIUNICATIONS:
Two items among the correspondence submitted to the Council received
official consideration. They are (1) Santiago Girl Scout Council, re-
questing permission to conduct their annual Calendar Sale from November
3rd thru 17th, 1962; and (2) National Foundation for Infantile Paraly-
sis, Inc. (March of Dimes), Oran=,e County Chapter, requesting permission
to conduct their 1962 March of Dimes campaign in the cit:,* during the
-ionth of January, 1963.
On motion of Councilman Cliff, duly sec)nded by Councilman '3athgate,
approval was granted to both agencies, as per their respective requests.
Motion passed and so ordored.
ORAL COHIUNICATIONS:
1. Mr. Ramond Seaver spoke to the City Council on a matter of app-
eal for consideration regarding approval of the construction of a patio
roof that projects into a "public utility" easement.
With further st_itenents that the"public utility easement" was not
being used, it was advised that po.,sible anandonment proceedings should

be pursued, in order to alleviate the situation and auth rize the grant-
ing )f approval.
The matter was referred to the City Attorney for drafting the necess-
ary pdition to be circulated for the proposed abandonment.

The list of acc)unts payable on October 1, 1962, Ups approved, as
submitted.
CO_IMITTEE REPORTS:
The report on annexation and connection fees had been received,
c pied, and distributed to e,ch of the councilmen. Action wss deferred
until the next regular me -Ming.
PLANNING COMMISSION REPORTS:
Captain Ed. Holtz, Secretary to the Planning Commission renorted
the following items:
(a) C_2A, Restricted General Business District Regulations Format
;with the recommendation of approval and the proposed amending "L7nd Use
Ordinance No. 5" to provide for such 'dis:.rict regulations' and 'district
z ning'.
Councilman Durnford made a m:ti;n to adopt the proposed ordinance,
as recommended. Said ordinance to be read in full, by the City Attorney,
thus constituting the first reading. Motion duly seconded by Councilman
Cliff. Passed and so ordered.
(2) C -2A, Restricted General Business District Zonin-,, was recomm-
ended by the Planning COMMi33i:7n for that area within the City limits
bounded by the San Diego Freeway on the east, the A.T.&3.F. railroad on
the west, the San Juan Creek and San Juin Creek Road on the n rth, and
the s--utherly city limits on the south, with an approoriate ordinance
so designating and zoning the area as such.
Motion by Councilman Durnford, duly seconded b Councilman 3athgata,
acceot�d the recommendation and requested the re ding„ in full, the pro-
posed ordinance for zoning. Moti)rn carried.
The City attorney ;ave the first reding, in full, of the proposed
ordinance for the district xDning fir "C_2?, Restricted General 3usiness
District" for the aforementioned area within the City of San Juan Capis-
trano.
