An e.nphatic suggestion was entertained, for the City to consider the increr,se to an 18" line for that portion crossing underneath the freeway, westerly to the existing treatment plant. Following this presentation, discussion took place, with questions from the property owners and interested persons in attendance. City Attorney, John H. Daws n,_ advised that the property owners of the area being considered, be required to submit a bond, guaranteeing coverage of the engineering costs, until such time a contract was act- ually let. Mr. Less Remmers, property owner in the. San Juan Capistrano valley, but outside the City limits, petitioned those in attendance, along with the City Council, to pursue the aspect of requesting Supervisor Claire Nelson and the Orange County Board of Supervisors to make a study for an overall sanitation district for. the, 'valley', at an estimated cost of between :$25,000 and $40,000, which would be raid by the County. This cost of the pronosed and suggested study to be made by the County wAs questioned as to the actuality that the County would pay for such a study --- Mr. Less hemmers and Mrs. Ethel Pease stated that they would obtained the commitment from the County in writing. The City Clerk gave a hrief resume of the proceedings to date. The City Attorney relates further, thr sne:,.ific phases of intent 7 Z3-6z- 152 and litigation. Discussion followed. Councilman -;lif; stated that - "we should keep our word", in refe- rring to the failure of the efforts of the City of San Clemente. Councilman Durnford offered a resolution to ab n,,:on the proposed "San Juan Creek Annexation No. 1" proceedings. Resolution was accepted and adopted unani-,ously. PLANNING i.0_2!ISSIOIi REPOHT: Fr?d L. .ewhart, Jr., 'Jhainian of the Planning �;ommission reported the .following items of business: (1) Letter of -eco-imendati�n that the City Council approve and adopt the oronosed 'subdivision ordin!:nce',as previously submitted. the City Council discussed the latter, `>ut deferred action until the next regular Council T•?eeting. (2) Renort of public hearing held, relative to a pr000sed land use zoning classification of "E-4, 10,000, Hillside Estates". A recom- -!ndat,ion was submitted for the acceptance and an-roval for the establ- ish --hent of the L-4 land use classification, by ordinance. Discussion followed. In view of the limited study by the mer:iber: of the City Council, the matter was deferred for further study. (3) The variance request of Er. Jack Norton -,nd =elitas Forster to permit the construction of a four unit coimnercial building,. with four apart.ent units shove, was reported with a recommendation Cor denial. (In view of correspondence of anneal, having; been read earlier, the matter was scheduled later on the agenda s "New 3usi,leFs"). (b) A report on the study and public bearings regarding; the nrop- osed zoning to "C-2, General Husiness" that are of land lying between Camino Canistrano and the Santa Fe tiilroad tracts was submitted with a request to terminate the study a -,til some time in the future when deve- lonment warrants. (5) Proposed "E-2, ".'odium .states", zoning fir that land .area ly- ing northerly and westerly of Del 0bisno Street, as s own on Exhibit A, was submitted to the Cnuncil with a recommendation for approval. Discussion followed, with interesting nersons present relating their view points "for and a,-ainst". '.otion was made, duly seconded, to refer the matter 'pack to the Planning Commission with V'e instructions to plan and study the interim area loin,' between the existing C-2 zone and the subject area for prop- osed zoning, motion carried. (6) The report of the study of E-3, Small Estate zoning for the 250 acres, more or less, 'evolving land owned by McCracken, ='orster, and others revealed, through public hearings and correspondence, that the owners were very much opposed to any consideration of zone classificat- ion requires only the minimum of 15,000 square feet. Therefore he re- commendation of the PLanning Commission was ;o retain the "U-1, Unclas- sified zoning for the area. Councilmse Durnford made a motion to uphold the recommendation of the Plannin Commission. Motion was seconded and carried. (7) The zoning request of 3eami5h and DigFtins was rei�oramended for denial, with a statement that a possible E-4, 10,000 square feet ty,)e of zoni:�g ^light be reviewed. The Council upheld the reco.umendation with a proper motion being passed. FIVE MI!'JUTE tEJESS. UWFINTSHED ��USINESS: 1. Ordinance No. 52 rend asecond reading, by title only. 2. An ordin.nce, repealing City Ordinance !+o. 6, and adopting the 1961 Edition of the uniform Building 'Code, and Ordinance fo, 1435 of the Oounty of Orange, by re erence, had its first reading, by title only. NErd BUSINESS: 1, action of appeal by Mr. Jack Horton and Leilitas Forster was considered :;r. Horton submitted additional plans and to show merit and justification for the a-geal. A lengthy discussion took place; and in view of the added plans and information, the matter was referred back to the Planning Commission for a report of conditions to t,e imposed if the City Council an"roved the variance request. The Associated Chambers of Comuerce of Orange County submitted, through correspondence, a proposed resolution for adoption, re,'arding the "utilization of services and prod,-cts", :jiL'-in Orange County. The request :nd nropcsal. of Dike and Colegrove for land area annexation and de -annexation between the cities of San Juan Canistrano and San Clemente was discussed, A *point was questioned relative to the _ bond obligation on the parcel of land Lo be de -annexed, rince it .as part of Orange 'County Waterworks District 11o. 1. Jack Kubota, of Carlsbad, Calif- ornia, who was requested to 'e in attendance in order to be interviewed for possible consulting engineer,for the 'City of San Juan Capistrano. 2. Don Durnford suggested some method be studied to provide angle parking along the ,ission on Camino Canistraro. Ile further related that the County would )ossibly adopt the propo- sed "Urading ordinance" on Wednesday, July 25, 1962. 3. Tony Olivares reported that he and T. J. ileadows had begun a survey of the streets within the city to observe the conditions exist- ing. Del Obispo and Alipas Street were the tonic of most concern. Mayor Buchheim instructed Councilman Olivares and Public Works Di- rector, '.'Meadows, to complete the survey. The meeting adjourned into an executive session at 11:00 P.'M. EXECUTIVE SESSION: Mr. Jack Kubota was personally interviewed by the members of the City Council and City Administrator in respect to the qualifications and schedule of fees for engineering services.
