Winchell of the California Highway Patrol, stating that the California Highway Patrol would terminate the traffic accident reporting service. on June 30, 1962, relative to those accidents occuring on local streets within the city limits, other then the San Diego Freeway. Mr. Dawson, related that he would invite Captain Winchell to the next regular council meeting to give the full details. (c) Director of Public Works, T. J. Meadows reported that status of the weed abatement project (d) Councilman Bathgate inquired as to the proposed public relat- ion program being initiated by Mr. Daniel Brown II. (e) Councilman Durnford reported the possible new considerations of Mr. C. W. Donohue, Superintendent of Building and Safety, County of Orange, regarding charges involved with the City -County Services contr- act, now expiring and possible renewal. (f) "ayor Buchheim recognized the, umpreparedness of the Council to submit names of persons for possible appointment to fill the vacanc- ies in the Planning Commission, therefore deferred action until the ne- xt regular meeting. May 28, 1962 The meeting was called to order at 7:32 P.M., by Mayor Carl E. Buchheim. Mr.. John H. Dawson, was flaked to give the invocation, after which the pledge of allegiance to the flag was recited. 133 The Clerk called the roll: Councilmen present; Eric F. Cliff, Don Lurnford, Antonio M. (Tony) Olivares, and Carl E. Buchheim. Councilmen absent; William A. Bathgate. The minutes of the meeting of May 14,.1962 were approved as submi- tted. Written Communication: Other than those written communications already submitted to the members of the City Council, the Clerk read the following: 1. A letter from the American Legion Post No 721, of San Juan Ca- pistrano, requesting permission to sell fireworks at the northeast cor- ner of Ortega Highway and El Camino Real. On motion of Councilman Durnford duly seconded by Councilman Oliv- ares, permission was granted to the American Legion Post No. 721, to sell fireworks at the northeast corner of Ortega Highway and E1 Camino Real, for the period of 12:00 Noon, June 28th until,12:00 Noon, July 6, 1962. Motion carried and so ordered. 2. Letter from the San Juan Elementary P.T.A.,regarding concern for imnrovement of the warning devices located on Verdugo Street at the Santa Fe Railroad tracts crossing. The letter further requested the City Council recognize the need and support the request. After some discussion by the Council, a motion was made by Council- man Durnford, duly seconded by Councilman Cliff, to endorse the request and direct the City Clerk to write to the Santa Fe Railroad to this re- spect. Motion carried. g. The City Clerk made note to the City Council of Annexation No. 8, by the amity of San Clemente. Oral Communications: 1. Captain Winchell of the California Highway Patrol was not pre- sent to give his views on the discontinuance of traffic accidents repo- rting within the City limits, effective July 1, 1962, except for that portion of the San Diego Freeway traversing the City. 2. Mr. Daniel Brown II, read the letter, previously submitted to the City Council for their consideration, regarding public relations and business promotion plans for the City of San Juan Capistrano. Considerable discussion followed to which question arose concerning f Y,P-Ly 334 the demand for financial support. Councilman Durnford made a motion to give recognition to the "For- med committee" as a public spirited body and study the financial aspect further at a later date, Motion seconded by Councilman Olivares, was passed. Public Hearing — San Juan Creek Annexation No. 1 Motion by Mayor Carl E. Buchheim was made to continue the Public Hearing for 60 days (July 23, 1962) Motion seconded and carried, Public Hearing — Proposed Sewer Annexation No. 1 This being the time and place to hear all matters on annexation to the San Juan Municipal Sewer District No. 1, either pro or con, the City Council opened the public hearing. There being no written protests and persons present desired not to make added statements pro or con, the hearing closed. Discussion followed, with statements of consideration submitted by Mr. Joe Feeney. The Council deferred action for period of two weeks. Treasurer's Demands: The City Council approved the Treasurer's Demands, as listed for issuing:aarrants for payment on June 1, 1962. Mayor Buchheim offered a statement regarding the list of Treasurerl's Demands, that anyone wishing to see the itemization listed in the Treas- urer's Demands may make their request in the office of the City Clerk. Committee Reports: 1. Councilman Tony Olivares reported the bids received for the acquisition and installation of a public address system and tape record- er. He reported that a local firm, Mission TV, had the lowest bid. Re- commendation was made that if approval could not be f,,iven for both the public address system and tape recorder, that the Council seriously co- nsider the tape recorder solely. 2. Councilman Don Durnford and Mayor Carl Buchheim gave a report of their trip to view the Feather River project. Added note was made that at NO EXPENSE to the City. Information renorted that delivery of water to Southern California 13 is exnect�d in about 10 years, (however Councilman Durnford presented a "small and first delivery" in a bottle). Planning Commission Renort: 1. Public Hearing — E1 Adobe Restaurant — Variance,to permit dancing. The Planning Commission recommended approval. Councilman Durnford made a motion to uphold the recommendation of the Planning Commission and grant approval of the variance request. Motion seconded and carried. 2. Recommendation was made for engineering study to be made in connection with the oresent contracting projects of the Orange County Flood Control District insofar as the accuracy and practical design for handling surface drainage waters from the adjacent properties. Further, it was recommended the retention of a full-time engineer in order to accomplish this study and other engineering problems. The City Council took no action on this matter. 3. Zoning studies for E-1, E-2, and E-3 classifications have been submitted for establishment of an ordinance; with this anticipation di- strict zoning is contemplated for several specific areas within the City. Consideration is being given, as suggested,by the Council for C-2 zoning of that area between Camino Capistrano and the railroad tracks from San Juan Creek southerly to the City limits. Unfinished nosiness: 1. Capitol Outlay With a recommendation for anproval, by committee report, Council- man Durnford made a motion to accept the bid of Mission TV (in the am- ount of $640.23, plus a contingencv fee of $50.00 because of the time delay in accepting the tid, some prices have changed) Sor the purchase of a public address system and tape recorder for the City Council Cham- bers. The motion was seconded by Councilman Cliff'. Motion carried and so ordered. 2. Membership dues — to the League of California Cities; and the Orange County League of Cities. After considerable discussion as to the implications that could evolve from becoming a member of the League of California Cities, the f2d'- 6 -►.-- 136 merits were still of greater advantage. Therefore, Mayor Carl E. Buch- heim moved to pay the dues to both the California League of Cities and the Orange County League of Cities. Motion seconded by Councilman Dur- nford. Motion carried and so ordered. Recess for five (5) minutes. New Business: 1. City - County Service contracts The City -Council instructed the City Administrator to procure all the proposed service contract agreements so that the Council could rev- iew them thoroughly before making a decision. Recommendations & Reports: (1) City Clerk - Administrator Request was made of the City Council for clarification as to the extent of authority and jurisdiction; and ii4hether all directives must come from the -Council as a body or may individual Councilmen require performances of service. Mayor Carl Buchheim explained in detail and stated the.inference was not directed as criticise, but as an inquiry. Further, that no change in the realm of jurisdiction and ,Authority was to be enforced. (7) Councilman Don Durnford related that work sessions of the Co- ouncil would be ca'led to consider the preliminary budget, nuv being drafted. (3) Mayor Carl Buchheim stated a recommendation to hold study sessions at 3:00 P.M. prior to regular meetings of the Council in order to study items on the agenda. The regular meeting adjourned at 9:59 P.M., into an ececutive sess- ion to discuss.personnel issues. Executive Session Item No. 1 Fees for annexation proceedings — John H. Dawson, 'ity Attorney. Considerable discussion relative to the listed fee schedule and charges submitted by John H. Dawson, City Attorney, resolved the matter with a motion by Councilman Cliff, seconded by Councilman Durnford, to nay the statement of charges. Motion carried and so ordered.
