3. Councilman Chermak made a suggestion that the School Board should consider
establishinP student traffic and crosswalk markers around the school -- even
possibly making a portion of E1 Camino Real a-ONE—WAY street.
4. Councilman Durnford entered a statement contradicting the findings of
the traffic survey made by the Division of Highways for the crosswalk painting
request for the ramps of the San Diego Freeway at Ortega Highway.
He then, made a motion that the City Council go on record that the reason
stated by the Division of Highways were unsound and unfounded. Motion carried. _
The City Council adjourend to an Executive Session at 9:40 P. M.
Councilman Chermak reported his contact with Mrs. Virginia Meadows
relative to the possibility of her continuing to keep the books for the Sewer
District.
It was also reported that Auditor—Controller, Vic Heim had requested December
15 be the date for transfer of the Sewer District funds to the City.
Discussion among the councilmen, Mm Meadows, City Attorney, and City
Administrator was entered into, relative to the various phases of the work
required.
Councilman Olivares offered a resolution to employ the services of Mrs. Meadows,
as secretary and bookkeeper for the Sewer District, at a salary of $60.00 per
month, to be effective December 15, 1961.
A motion was made, seconded and carried to adjourn until 7:30 P. M.,
Tuesday, December 26, 1961.

The regular meeting of the City Council was called to order by Mayor Carl E.
Buchheim at 7:30 P. M.
The invocation was given by Ernest A. Thompson, followed by the pledge of
allegiance to the flag.

The City Clerk called the roll: Councilmen present; William A. Bathgate,
Edward S. Chermak, Don Durnford, Antonio M. (Tony) Olivares and Carl E. Buchheim.
Councilmen absent: None.
Note: City Attorney, John H. Dawson, absent
The minutes of the previous meeting were approved as submitted, with one
correction that Mr. Leo Chade suggested El Camino Real possibly be made a ONE-
WAY street along the school frontages.
WRITTEN COMMUNICATIONS:
1. Letter from the Camp Fire Girls, Orange County Council re: the conduction
of a sale of peanuts within the City of San Juan Capistrano from January 12
through January 29, 1962.
2. Letter from Mr. Arthur Gould re: the enforcement of an anti -litter law
to prevent the depositing of cans and bottles along the sidewalks and streets of
downtown San Juan Capistrano.
3. Letter from the League of California Cities re: Committee appointments by
New League President. (Note was made by the City Clerk that Mayor Duane Winters
had been appointed to the Airports Committee; and that the City Planning Commission
should avail itself of this contact.)
4. Letter from the Red Devil Fireworks Company re: the appreciation for the
cooperation in the past, and requesting two (2) copies of the most current Ordinance
relating to the sale and discharge of fireworks within the City.
5, Letter from the State Board of Equalization acknowleging receipt of the
contract agreement for the local use and sales tax administration to be effective
January 1, 1962.
ORAL COMMUNICATIONS:
1. Subject: Chief of Police.
Mayor Carl E. Buchheim asked the councilmen to make individual statements in
regard to the appointment of the Chief of Police, Mr. William A. Schmidt:
(a) Councilman Olivares had no statements to make contrary to the appoint-
ment;
(b) Councilman Durnford stated the provision of the Government Code, and
further projected the need for administrative advisement for the establishment
of a police department;
(c) Councilman Bathgate abstained to any comment;

(d) Councilman Chermak related the responsibility of the City Council and
its duty to the residents of the city for police protection. He further
reprimanded the newspapers for the "smear campaign" utilized in reporting
recent sessions and situations within the City of San Juan Capistrano. He
emphatically attacked the "out and out lies", printed in the Santa Ana
Register (newspaper).
He related the personal obligations under the oath of office, and the
right to hire a "specialist", under provisions of the Government Code.
Other topics of his statements covered (1) budget, (2) taxes, (3) crime,
(4) a sincere request for support,telp and more cooperation from the citizens.
(e) Mayor Buchheim commended the editorial of the Coastline Dispatch. H e
then charged the "Register" with out -right discrepanires in the news reported.
He then took a firm stand in stating that he would never be used to the degree
of referee for a "twwn hall" type of meeting or operation.
Mayor Buchheim requested an expression from the Council on the "two (2) minutes
time limit" for those persons requesting to be heard in regard to the topic of 'Chief
of Police'.
Motion made by Councilman Durnford to limit person to two (2) minutes was
seconded and carried. So ordered.
Question from the floor by C. V. Dellinger, relative to who imposed the $100
fine and/or 10 days of imprisonment -- the mayor; the City Attorney for the Mayor;
or a court of law?
Mr. C. R. Nelson, former district attorney, related that in the absence of the
City Attorney for decision and answer.
Mr. Paul Herbold enters protest and demanded as legal opinion now, on Mr. Del-
linger's question.
Mr. Bob Gardner inquired how time limit was to be imposed: on the person's
presentation only; or a combination of presentation and answers from persons con-
cerned.
Mr. Fulton Shaw stood to be recognized by the Mayor, but was ruled "out of order"
and not allowed to speak on the subject at hand. Therefore, Mr. Shaw left the
meeting.
Mrs. Ruth Robertson spoke, commending the Council, but entered a concern for
neighborliness. She requested the City Council to post a calendar of events for
issues to be considered by the Council.
Mr. R. A. Benton, expressed a high regard for the officials of the City and
offered his help.
