61-1211_CC_Minutes_Regular Meetingof Public Works, and nominated T. J. Meadows as Director of Public Works, with compensation at a salary of $260.00 per month. Resolution accepted and adopted unanimously. A question was brought forth as to the date of possible and practical transfer of the Water District. Dissuasion followed. The date of July 1, 1962, was agreed to be the arbitrary day. The City Counril will inform the Board of Supervisors of this fact. Mayor Buchheim instructed City Attorney, John Dawson, to draft an appropriate resolution for the transfer of the Waterworks District No. 4. Further instructions, the City Attorney and Director of Public Works will attend the hearing, December 27, 1961. John H. Dawson reported the latest status of the annexation proceedings of San Juan Capistrano and also of San Clemente. He further stated that it will have to be the initiative of the pditioners of San Juan By_the=Sea Annexation No. 1 to correct the boundary description and refile with the County of Orange Boundaries Commission. Regular Meeting of the City Council of the City of Skn Juan Capistrano December 11, 1961 Mayor, Carl E. Buchheim, called the meeting to order at 7:30 P. M. Invocation was given by John H. Dawson. Pledge of allegiance to the flag was recited. The Clerk called the roll. Councilmen present: William A. Bathgate, Edward S. Chesmak, Don Durnford, Antonio M. (Tony) Olivares and Mayor Carl E. Buchheim. Councilmen absent: None The minutes of the previous meeting were approved as submitted. /2-//-d. / '83 k WRITTEN COMMUNICATIONS: 1. Postal Card re: the advance notice for the 14th California Street and Highway Conference, to be held on the U.C.L.A. campus, January 25_27, 1962. 2. Letter from the State Division of Highways re: the reasons for denying the City's request for the painting of crosswalks at the intersections of the San Diego Freeway ramps with Ortega Highway. 3. Letter from Dr. Robert H. Haight, Orange County Health Department, extending his concern in the consideration of adopting an animal control and licensing ordinance. 4. Memorandum from the Orange County Civil Defense re: Federal Shelter Survey to be launched on Friday, January 12, 1962, 5. Letter of information, transmitted from Supervisor, C. M. Nelson re: the status of projects within the Orange County Waterworks District No. 4, as committed in report letter of J. A. Woolley, Consultant Engineers and Associates, 6. Letter re: "Project Alert" and declaration of December 11 thru 15, as "Project Alert Week", as requested in communique from Patricia S. Gilbert, Chairman, Orange County Citizen's Committee, 7. Letter from the Leagun of California Cities re: Spring meeting, of City Managers and Administrators to be held February 14-16, 1962, at the Mission Inn, Riverside, California. ORAL COMMUNICATIONS: 1. Mr. Jack Callaham, expressed a desire for an endorsement of the City Council of the City of San Juan Capistrano , to request the re -alignment of the Orange County Flood Control channel for San Juan Creek, in order to allow the retention of airport facility, and possibly afford improvement of the facility. 2. Mayor Buchheim, introduced the Chief of Police, William Shmidt. Mr. Schmidt projected the proposed plan of administrative process of setting up a police department for the City of San Juan Capistrano. With this, Mayor Buchheim read a letter pditibn; signed by fourteen (14) citizens. He then extended the courtesy of allowing each of those citizens to question and interview Mr. Schmidt for a period of two (2) minutes. Some of the discussion extended an attitude of controvery of opinion for endorsing the City Council's appointment of Mr. William Schmidt, as Chief of Police. Mr. Bob Gardner, requested a suspension of duties and authority of the Chief of Pblics until further information and acceptance by the citizens was made. /1-//-6./ TREASURER'S DEMANDS and REPORT: On motion of Councilman Bathgate, seconded by Councilman Chernak, the addendum demands were authorized to be paid. The Treasurer's Report for the month of November was unanimously accepted. PLANNING COMMISSION REPORT: 1. Fred Newhart, Jr., chairman of the Planning Commission announced the date for Public Hearing on the Land Use Variance request of Mr. Alex Schmick, to construct a single family dwelling on the division of land, occuring subsequent to the effective date of the Land Use Ordinance, Ordinance No. 5. 2. Public Hearing was also to be held on the Land Use Classifications for R-1, R-2, and R-3 zoning. 3. Further, it was reported that study and consideration is stillleing given to the airport survey for this area. A meeting will be held with the Planning Commission of San Clemente for further discussion of the issue. 4. Discussion of minimum width for roads and some planning for the arterial street system for the city and its surrounding area was made. Councilman Charmak reported that an executive session would follow the meeting, in order to handle the personnel issue. The City Attorney projected to the audience the perrogative of the Mayor and the Council to restrict time for those items on the agenda, but did extend the jurstification and policy for hearing anybody wishing to be hear, and the procedure to follow to accomplish this. "FIVE MINUTE RECESS".......... UNFINISHED BUSINESS: 1. The City Attorney reported the subdivision and grading ordinance is still being composed. Further study is being made of reference ordinances of the City of Los Angeles and the City of Glendale. 2. The preliminary ordinance will then be submitted to the Planning Commission for study, review and recommendation. 3. Discussion my the individual councilmen revealed that a protest be made relative to the matter of imposing Federal Law and policies upon State operations of the San Luis Reservoir. Councilman Durnford offered a resolution, concurring with that of the Oaange County Water M stti:dt u#ng that Federal Law and Policies not be imposed upon the State Operations in its Service areas. 1Z -11-(0l Imm Resolution was passed, approved and adopted unanimously. 4. Animal Licensing Ordinance Disuussion preceded any motion to adopt and not to adopt the Orange County ordinance, by reference. Councilman Chermak made a motion to adopt the Orange County ordinance by reference, (Ordinance No. 1403). Vote ended in a tie, with one councilman abstaining. Mayor Buchheim made a motion to adopt the County ordinance (Ordinance No. 1403), but delete Section 7, "Confinement and Restraint" (leash provision) of said ordinance. Motion carried. The Animal Licensing and Control Ordinance had its first reading. 5. Councilman Bathgate offered the resolution for the transfer of Orange County Waterworks District No. 4 over to the City of San Juan Capistrano on or approximately July 1, 1962. Resolution was adopted unanimously. 6. The City Clerk brought up the subject of parking regulations. Councilman Durnford made a motion to request the Orange County Highway Department to stencil paint, these particular curbs, painted RED AND YELLOW, with the designation of 'NO PARKING' and 'LOADING ZONE', respectively. Motion carried and so ordered. NEW BUSINESS: There being no new business, the Mayor asked for recommendation and reports. RECOMMENDATIONS and REPORTS: 1. City Attorney, John H. Dawson, reported the status of the annexation proceedings of San Clemente's Annexation No. 2 (tidelands). He stated that Don Jones, annexation attorney for San Clemente, had appeared before the Board of Supervisors to present a ten (10) statement document giving the basis for ,justification to allow the annexation. The meeting was further continued until December 12, 1961, because Mr. Jones was ill and unable to proceed. As yet, the State Lands Commission had not filed a written protest to the 'tidelands annexation'. It was further advised that proceedings should continue, respective to the 'uninhabited strip' annexation for San Juan Creek, until it is certain that both of San ClemenWa proposed annexation have failed. 2. Councilman Bathgate had one quedion relative to the dissolution of Orange County Wateraerks District No. 4.
