Mayor Buchheim appointed Councilman Bathgate and T. J. Meadows to arrange such
a meeting with Mr. Woolley.
3. Councilman Durnford made two (2) requests: (a) to instruct the City Attorney
to tbtain an opinion from the Attorney General, regarding the interpretation of
Section 38611, Government Code, as it pertains to fire districts and County
Structural Fire Protection taxation; (b) a study of the possibility and legality
to require business license for m6bi.lehrnne or trailer parks.

Regular Meeting of the City Council of the City of San Juan Capistrano
November 13, 1961
Mayor Carl E. Buchheim called the meeting to order at 7:30 P. M.
Pledge of allegiance to the flag was given. Invocation was recited by John H.
Dawson.'
The City Clerk called the roll. Councilmen present: Carl E. Buchheim, William
A. Bathgate, Edward S. Chermak, Antonio M. (Tony) Olivares. Councilmen absent:
Don Durnford.
The minutes of the previous meeting of October 23, 1961, were approved as
submitted.
Councilman Don Durnford arrives at meeting.
WRITTEN COMMUNICATIONS:
1. Letter re: United Cerebral Palsey Association of Orange County, Inc.,
requesting permission to solicit funds within the City, during January 11, 12, 13,
1962.
2. Minute Order of the Board of Supervisors re: Report on taxxelief for fall-
out shelters.
3. Letter and Agreemet, League of California Cities re: New agreement to be
effective January 1, 1962, in accordance with privisions of new legislation.

4. Petition of residents of the Capistrano Beach area re: the proposed
petitioning to annex to the City of San Juan Capistrano.
ORAL COMMUNICATIONS:
1. Jack Snipes was presented for his request of the City Council to consider
participating in establishing a park and recreational district for this area.
2. Councilman Bathgate introduced Bill Lundy and Ray Woodside, of J. A.
Woolley Consulting Engineers.
Bill Lundy gave an explicit presentation of the schedule of procedures for
the water program, to bring water to the Capistrano Valley.

Questions from those in the audience were answered by Mr. Lundy.
TREASURER'S REPORT:
On motion of Councilman Durnford, seconded by Councilman Chermak, the 'treasurer's
report was approved, as presented, for the month of October, 1961.
PLANNING COMMISSION REPORT:
Fred L. Newhart, Jr., chairman of the Planning Commission reported the
following:
1. First Baptist Church:
(a) Extended consideration and review;
(b) Projected recommendations for approval, subject to itemized conditions,
to which item No. 7 was added by the City Council.
The City Council acted through motion of Councilman Durnford, being duly
seconded, to approve and grant the Land Use Variance request, subject to the
recommendations and conditions set forth by the Planning Commission and add item
No. 7 - "That all drafted documents and covenants, to fulfill the precedent conditions,
be subject to the approval of the City Attorney.
2. Paul Goya - a request to conshuct three (3) single family dwelling on
individual and separately recorded parcels of land. Planning Commission recommends
' approval.
Motion made by Councilman Bathgate, duly seconded, and carried, the approval
of the Land Use Variance request of Paul Goya.
3. C-2, General Business District, zoning
(a) Recommendation for adoption of district boundaries as submitted on
Sectional District Map, Exhibit 'A'.
