61-1023_CC_Minutes_Regular Meeting68 Regular Meeting of the City Council of the City of San Juan Capistrano October 23, 1961 Mayor Carl E. Buchheim called the meeting to order at 7;30 P. M. Reverend Gantenbein, of the First Baptist Church, of Dana Point, gave the invocation. Pledge of allegiance to the flag was given. The Clerk called the roll. Councilmen present were: Carl E. Buchheim, William A. Bathgate, Don Durnford, Edward S. Chermdy and Antonio M. (Tony) Olivares. Councilmen absent: None. The minutes of the previous meeting were approved as submitted. WRITTEN COMMUNICATIONS: 1. Letter from Duane Winters, President of the Orange County League of Cities, re: Welcome to membership and suggesting that regular attendanceeand support in handling mutual problems. 2. Letter from Bob Gannon, Pacific Telephone and Telegraph Company, re: the Changes in dialing codes and procedures for this area. 3. Letter from the Divison of Highways, acknowledging the request for a study, for painting of pedestrian crosswalks at the intersections of the San Diego Freeway ramps with Ortega Highway. An invest#tion is to be made. 4. Letter from George Hagens, Administrator Assistant Executive, Division of Beaches and Parks, acknowledging receipt of the letter of request to conduct a historical study of the city of San Juan Capistrano area. He stated a meeting would be held October 20, 1961, at which time the request would be considered. TREASURER DEMANDS: Councilman Durnford made a motion to approve the payment of the demands, as listed and submitted by the City Treasurer, and to instruct the City Treasurer to _ issue warrants for the payment thereof. Motion seconded by Councilman Chermak. Motion carried. PLANNING COMMISSION REPORT: Fred L. Newhart, Jr., chairman, reported the meetings and public handling the following items: 1. C-1 and C_2 Zoning and Use Districts: (a) Discussion revealed some conflict of classifications permitted in C_1, while comparative classifications were designated for C-2. In specific, "printing and bookbinding' was permittedin C_1 zone, but 'newspaper' publishing was only allowed in the C-2 zone. /v-23-& 2. Land Use Permit request of the First Baptist Church of Dana Point to establish a church along Del Obispo Street. 3. Planning Commission's report and recommendations reggrding the Baptist Church were to approve the request subject to conditions that (a) construction of the buildings meet all requirements of the #)uilding code; (b) sanitary facilities be the use of septic tanks and cesspools for no longer than three(3) years and in accordance with the provisions of the plumbing code; (c) adjacent property owners and the legal representative of the church furnish the City of San Juan Capistrano, a signed release absolving any liability or other damage claims which might result against the City. 4. Announcement of the public hearing to be held Tuesday, November 7, 1961, relative to the request of Paul Goya to construct three (3) single family dwellings on properties located on Ganado Road, eoutherly of Ortega Highway. The City Council took action as follows: 1. Referred matter of conditions for approval back to Planning Commission for further extensive consideration, in view of the situation of drainage not being completely acceptable; 2. Councilman Durnford made a motion to approve the C-1 and C-2 permitted uses, provided that 'printing and bookbinding' be deleted from C-1 and placed in C-2. Motion seconded by Councilman Chermak. Motion carried. COMMITTEE REPORTS: There were no reports of committees, but Counilman Durnford did relate his attending the meetitg of the Beaches and Parks Commission in San Diego, October 20, 1961. At this meeting, it was decided that San Juan Capistrano and the area would be first in the historical study to be conducted by the Commission of Beaches and Parks. Mayor Carl Buchheim extended a word of thanks to Durnford and to Karl Wray for their participation makingthis historical study contemplation evident. "FIVE MINUTE RECESS............ UNFIN3$HED BUSINESS: 1. Taxi cab Ordinance Councilman Durnford made a motion to waive the reading of the proposed ordinance, except by title only. Notion seconded and carried. The second reading of the ordinance was given. Councilman Oliveres offered a resolution to adopt the taxi ordinance, Ordinatce No. 3$, an ordinance of the City of San Juan Capistrano regul ting the business of operating taxicabs within the city of San Juan Capistrano, establishing regulations io-13-61 in connection therewith, and setting penalties for violation thereof. Resolution adopted by unanimous vote of the City Council. 2. Animal Licensing After a report by the City Clerk, it was deemed necessary the City Council propose the adoption of an ordinance to control and license animals within the city, in order to afford the Orange County Health Department to take jurisdiction for enforcement. Councilman Chermak made a motion to waive the reading of the proposed ordinance (reference ordinance, Ordinnce No. 457, as amended, Orange County), except by title only. The first reading of the proposed animal license ordinance was given. 3. C_1 (Local Business District) Zoning: Councilman Durnford made a motion to waive the reading of the proposed ordinance for the C_1, Local Business District, Zoning, except by title only. Motion seconded and carried. The first reading of the proposed C-1 Districting ordinance was read. 4. Business license ordinance amendment: The first reading was given for the proposed amendment to the Business License Ordinance No. 24, after Councilman Olivares made a motion to waive the reading of the proposed amendment, except by title only. 5. Councilman Durnford moved to waive the reading of the proposed ordinance, providing for the issuance of temporary non-negotiable notes, except by title only. Mr,tion seconded and carried. The seoond reading of the proposed ordinance was made by City Attorney, John H. Dawson. Councilman Chermak offered a resolution to adopt the ordinance, Ordinance No. 36, an ordinance of the City of San Juan Capistrano, California, providing for the issuance of temporary non-negotiable notes, and repealing Ordinance No. 27. Resolution adopted unanimously. 6. Councilman Durnford offered a resolution authorizing the Mayor to sign the contract agreement with Gates Sweeping, for street sweeping services. Resolution accepted and adopted. 7. Councilman Chermak offered axesolution to delegate the authority to the Health Department and the Building and Safety Department of the Catnty of Orange, to inspect mobilehomes and mobilehome parks within the City of San Juan Capistrano. Resolution accepted and adopted. fid- z 3 -6i :'71 NEW BUSINESS: 1. Subdivision Ordinance (proposal) After some discussion, the City Council instructed the City Attorney to procure or draft an acceptable ordinance for submission. 2. Grading ordinance proposal was also refected to the City Attorney. 3. Civil Defense Ordinance Councilman Durnford offered a resolution for adoption, an emergency ordinance relating to civil defense and disasters, Ordinance No. 37. Resolution passed and adopted unanimously. 4. Councilman Olivares offered a resolution establishing the city organization for civil defense and disaster. Resolution accepted and adopted unanimously. 5. Councilman Bathgate offered a resolution to qualify the City of San Juan Capistrano to be eligible for surplus Federal poperty over and under $2,500.00. Resolution accepted and adopted. 6. Councilman Durnford offered a resolution relative to "Workman's Compensation Benefits for Registered Volunteer Disaster Service Workers". Resolution accepted and adopted unanimously. 7. Councilman Chermak offered a resolution approving and agreeing to abide by the California Disaster and Civil Defense Master Mutual Aid Agreement. Resolution accepted and adopted unanimously. 8. Proposed ordinance establishinIg the penalties and providing addenda clauses to those ordinances without the penalty provisions, was offered as an emergency ordinance by the City Attorney. Councilman Chermak offered a resolution to adopt Ordinance No. 38; resolution accepted and adopted unanimously. RECOMMENDATIONS and REPORTS: 1. City Clerk -Administrator reported that an estimate of $1200 to $1400 for the cost of applying a slurry seal -coat for E1 Camino Real, from Acjahema northerly, and La Mantanza and La Calera. Motion made by Councilman Durnford, seconded by Councilman Olivares, to authorize the work to be done by the Orange County Highway Department. Motion carried. The City Clerk further requested theestablishment of a "petty cash fund" of $20 or $25, to provide fund for pastage, postal cards and other incidentals. Councilman Chermak made a motion to authorize $25.00 as a "petty cash fund". Motion seconded by Councilman Durnford. Motion carried. 2. Councilman Bathgate related the authorization for the sale of the $2.8 million water bonds by the Board of Supervisors, and therefore requesting a meeting /,p - Lj-6/
