61-0710_CC_Minutes_Regular MeetingRegular Meeting of the City Council of the City of San Juan Capistrano July 10, 1961 The meeting was called to order at 8:50 P. M. by Don Durnford, Mayor pro tem. Invocation and pledge of allegiance was given by Ernest A. Thompson. The roll call was taken. Councilmen present: Don Durnford, William A. Bathgate, Edward S. Chermak and Antonio M. (Tony} Olivares. Councilmen absent: Carl E. Buchheim. The minutes of the regular meeting of June 26, 1961, were approved as read. Don Durnford, Mayor pro tem, called upon Red Newhart, Jr., to make a special report and present a proposed ordinance relative to the area being considered for architectural control. Mr. Newhart described the boundaries encompassing the area for which architectural control would be desired. He further related the proposed requirements and specifications. Two (2) other phases of the Planning Commission proceedings were submitted: C_1 and C_2 zoning, and the preliminary arterial street system for the City of San Juan Capistrano. The City Attorney made an inquiry about the proposed ordinance on the architectural control and then advised that the first reading be delayed until the ordinance was complete and ready for presentation. Further discussion followed. Councilman Olivares commented as to the strict imposition of materials and paint colors. Action was deferred until July 24. WRITTEN COMMUNICAMNS: Letter from Paul Phelps Insurance was read by the Clerk. It stated many facets should be considered in writing insurance coverage for the City. Statement of billing was submitted from the Coastline Dispatch. The Sheriff's Department monthly report for June was received and read. ORAL COMMUNICATIONS: Mr. Robert Gates, of Gates Sweeping Service, was present and made his offer for sweeping the streets of the central downtown area. Those streets were Yorba, Verdugo, Ortega, E1 Camino Real, and Camino Capistrano. It was anticipated that it would take a minimum of 212 hours, and at a rate of $8.00 per hour, constituting $20.00 per week or $80.00 per month. UNFINISHED BUSINESS: Public hearing for any objections to the proposed granting of an electric franchise to the San Diego Gas and Electric Co. was held. There were no objections. On motion of Councilman Chermak, seconded by Councilman Olivares, the franchise ordinance, Ordinance No. 29, was read by title only, constituting the first reading. Motion carried. The second reading will be made on July 24, 1961. Public hearing on the Land Use Permit application of Gabriel C. Baltierra was held. There were no objections. Councilman Bathgate offered a resolution affirming the recommendations of the Planning Commission to grant the Land Use Permit. Resolution approved and adopted. The matter of endorsement of either the Santa Fe Railroad or the Southern Pacific Railroad, for thein acquisition of the control stock of the Western Pacific Railroad, was submitted for further consideration and action. Councilman Chermak offered a resolution to take no action and to allow the Interstate Commerce Commission to resolve the issue ultimately. Resolution approved unanimously. NEW BUSINESS: John Dawson, City Attorney, submitted a proposed fire code in ordinance form, for the City Council's eonsideration. Councilman Bathgate made a motion, seconded by Councilman Olivares, to waive the reading of the entire ordinance, Ordinance No. 30, except by title only. Motion carried, Second reading to be made on July 24, 1961. Mr. Karl Wray, co—publisher of the Coastline Dispatch, stated an urgency to contact the State Division of Highways relative to the City's proposed acquisition of certain excess land for use as a park site. The City Clerk was instructed to write such a letter of intention to the State Division of Highways. Don Durnford, Mayor pro tem, appointed a committee to meet with State Highway officials to further pursue this acquisition. The City Attorney, John Dawson, reported the Board of Supervisors had requested Governor Brown to sign the bill into law, which would authorize the placement of the City of San Juan Capistrano on the current tax rolls. He further suggested that the City Council also go on record urging the Governor to sign the bill. Councilman Chermak offered a resolution urging the Governor to sign the bill to authorize placement of San Juan Capistrano on the current tax rolls, and directing the City Clerk to write an appropriate letter to convey the resolution.
