The meeting of June 26 to be made possibly for Captain Winchell and Mr.
Robert Sharp. The local newspaper to make notice accordingly for the public's
attendance.
Ed Chermak related a situation of "open burning" which is taking place within
the city limits. He requested proper action be taken; an ordinance if necessary.
Action deferred.
William Bathgate and Don Durnford to investigate and report on possible
housing and quarters for the City Council. Report to be made June 19, at
adjourned meeting.
Meeting adjourned at 9:00 P. M. to June 19, 1961.

Regular Adjourned Meeting of the City Council of the City of San Juan Capistrano
June 19, 1961
The meeting was called to order at 7:38 P. M. by Don Durnford, Mayor pro tem.
Invocation was given by John H. Dawson.
Pledge of allegiance to the flag was made.
Roll was called. Councilmen present: Don Durnford, William A. Bathgate,
Edward S. Chermak and Antonio (Tony) M. Olivares. Councilmen absent were: Mayor
Carl E. Buchheim.
Minutes of the meeting of June 12, 1961, were approved as read.
WRITTEN COMMUNICATIONS:
1. Letter of G. C. Baltierra requesting a 'Land Use Permit' for the establish-
ment of a wholesale and retail automotive parts sales business, to be located in
the Olivares Building.
2. Letter of the State Division of Highways transmitting maintenance
agreements for the State highway routes within the city limits of San Juan
Capistrano.
ORAL CON MUNICATIONS•
I
1. Mr. John Dawson confirmed the proposed attendance of Mr. Robert Sharp
Orange County Sheriff's Department, and Captain Floyd Winchell, California Highway
Patrol, at the next Council meeting, June 26, 1961.
2. Mr. Fred Fuller, A.T.&S.F. Railroad, was nresent and requested a City
Council endorsement, for the Santa Fe Railroad to acquire the controlling stock
in the Western Pacific Railroad Company. He also related that the Southern .
Pacific Railroad is also bidding, but stated certain conditions would evolve which
would not be in the best interests of the general public.
After some discussion, Councilman Chermak made a motion to defer action until
further consideration and study of the request could be made. Seconded by
Olivares. Passed and so ordered.
Mr. Fred Fuller was advised to return July 3 for the decision of the Council.
3. Mr. Otto A. Hirr, San Diego Gas and Electric Company, presented a pro-
posed resolution of intention to grant electric franchise. Further, he
related the provisions of the franchise, and the steps to be taken in order to
process the granting of the franchise.
SPECIAL COMMITTEE REPORTS:
1. State Highway Relinquishment Intention:
Don Durnford, Mayor pro tem, stated three things of concern should be
clarified and/or rectified. These were as follows: (1) an excess in length, a
portion lying outside the city limits, (2) a running spring of water, created
by the freeway construction, traverses the highway easement, and (3) slope con-
ditions are adverse to restricting the erosion factor.
Councilman Olivares made a motion to take the full 90 days for processing
the proposed relinquishment of that certain portion of 'Old State Highway 101',
lying within the city limits; and to refer the matter back to the Division of
Highways for processing the three (3) points concerned. Seconded by Ed Chermak.
Passed and so ordered.
2. Insurance Committee:
Councilman Chermak read a proposed letter relating the City's request for
bids for insurance. This letter to be submitted to four (4) firms in the
area: (1) Paul Phelps, Capistrano Beach; (2) James Holbert, Dana Point; (3)
Insurance Unlimited, San Clemente; and (4) Marshall and Ropp, Taguna Beach.
The City Clerk was instructed to contactihese firms with this letter.
3. Housing Committee:
Don Durnford, Mayor pro tem, stated that negotiations are under way for a
building at $125.00 per month, with leasing provision of two (2) years. However,
the owner has stated the lease be for three (3) years. These details are to

be worked out.
4. Planning Commission:
Fred Newhart, Chairman of the City Planning Commission, reported their
meeting had Mr. Allen S. Koch, County Surveyor and Road Commissioner in atten-
dance. Mr. Koch projected to the Planning Commission the thinking and plans for
streets and highways for the area prior to the incorporation of San Juan
Capistrano.
The main subject of discussion was the "Ortega _ Del Obispo" connection and
the proposed routing alignment.
The Planning Commission also recommended approval of the application of G.
C. Baltierra, for a 'Land Use Permit'.
The City Council set July 10, 1961, for Public Hearing on the Land Use
Permit application.
NEW BUSINESS:
c 1. Mr. John Dawson, City Attorney, read a proposed resolution of intention to
grant electric franchise to the San Diego Gas and Electric Company.
Councilman Olivares made a motion to adopt the resolution. Passed unanimously.
July 10, 1961, was the date set for any and all protests relative to the
granting of the franchise.
2. Mr. Dawson read an urgency ordinance to provide for the financial funds
to the City through a loan up to $2$,000.00 from the United California Bank,
San Clemente Branch.
Councilman Chermak made a motion to adopt said ordinance Nc. 27, and "Ordinance
of the City of San Juan Capistrano, California, providing for the issuance of
temporary non-negotiable notes." Motion seconded by William Bathgate. Passed
unanimously.
RECOMMENDATIONS and REPORTS:
Councilman Bathgate inquired about the building acceptance and clearance for
Jay Latham. Referred to Clerk to handle matter.
Councilman reported the matter of open fires had been taken care of. He
further reported a situation of "Teenage Hecklors" in the San Juan Park area.
Notification to be made to the Sheriff's Department.
Note was also made of a resident trimming shrubbery and hedges ind then
leaving the clippings and debris in the city street.
