Don Durnford made a motion to adopt Ordinance No. 25.
Seconded by William Bathgate; approved and so ordered.
RECOMMENDATIONS and REPORTS:
The members of the Planning Commission were advised to select a Chairman,
Vice:Chairman and Secretary. Then, proceed to project recommendations to City
Council in regard to current matters to be considered.
Don Durnford brought up the matter of insurance and liability.
Mr. Durnford also recommended the City Clerk be authorized to procure a
receipt book (possibly Rediform) which provides triplicate entries and beginning with
No. 1.
Mayor Buchheim inquired into the complexity of Public Utility companies to
comply with the existing "Business License and Use Tax" ordinance.
The City Attorney was instructed to contact the person in connection with
pipeline operations along Oso Road.
Meeting adjourned 10:15 P. M., to May 29, 1961.
A closed executive session of the City Council and the City Planning Commission
followed.

Regular Adjourned Meeting of the City Council of the City of San Juan Capistrano
May 29, 1961
The meeting was called to order at 7:35 P. M. by Don Durnford, Mayor pro tem.
Invocation was given by Father Toale.
Salute to the flag was lead by Don Durnford.
Councilmen present: Don Durnford, Ed Chermak, William Bathgate and Tony
Olivares.
Councilmen absent: Mayor Carl E. Buchheim.
Minutes of the meeting of May 22, 1961, were read and approved as corrected.

WRITTEN COMMUNICATIONS:
1. State Board of Equalization requesting list of the officials of theCity
in order to send such materials and printed matter of concern and importance.
2. Orange County Planning Commission - stating that application for Use
Variance No. 4771, by the Susquehanna Western, Inc., to permit the establishment
of a plant for the manufacturing of lightweight aggregate in the Al General
Agricultural District. Location is to be in Prima Deshecha Canyon, approximately
2 miles north and northeast of Coast Highway, northwest of San Clemente.
Discussion by the council disclosed that no reason to take opposition to the
variance application. A'no action or comment' statement to be forwarded to the
Orange County Planning Commission as a matter of courtesy and consideration.
3. Mr. Dawson read a letter of his action in processing a building permit
application of Mr. Merrill Woods. He further asked the city council to endorse
his action.
Motion to endorse the action, was made by Ed Chermak, seconded by Tony Olivares,
Passed and so ordered.
4. letter from the Woman's Club of San Juan Capistrano was read. The club
offered congratulations and assistance for the future of the city.
The Clerk was directed to make acknowledgment and thanks.
ORAL COMMUNICATIONS:
1. Mr. Tom Treulis introduced himself to the council. His capacity under
County franchise is trash pickup and disposal. He projected a proposal to apply
for authority or franchise to make trash pickup in the incorporated area of the
city, until such time a formal bid and/or franchise was issued. He also offered
his held in composing a formal bid with the necessary provisions applicable.
Mr. Durnford asked Mr. Treulis to put all these things stated into a written
report to the city council.
2. Mr. C. C. McCary request action be deferred on the proposal of abandonment
of a portion of Del Obispo Street (McKinley Ave.). Request granted.
3. Mr. Dellinger read a letter of statements, protesting further any
consideration of leasing the Olivares Building.
Matter referred to the City Attorney for examination and opinion.
REPORTS:
1. Traffic, parking and crosswalks Committee:
Don Durnford submitted a sketch which portrayed explicitly the proposed changes
and definite location of diagonal parking, parallel parking, crosswalks and loading

zones. Also, the proposal to change the existing signs of 35 mph to that of
25 mph.
Ed Chermak offered a resolution to establish diagonal parking (as per diagram)
new crosswalks, loading zones, and reduction of speed limit now posted 35 mph to
25mph.
Resolution adopted.
UNFINISHED BUSINESS:
1. Proposed adoption of the Master Plan of Arterial Highways of Orange County
was referred to the City Planning Commission for further study and report by the
motion made by Ed Chermak. Motion seconded by Tony Olivares. Passed and so
ordered.
2. Mr. John Dawson presented information regarding a parcel of land contiguous
with the southerly city limits at Ma California. This parcel could be obtained
from the State Division of Highways by filing a notice of desire and intent.
Action deferred until City Council and City Planning Commission can investigate.
3. City Clerk, pro tem, reported that proper mailings and postings had been
made regarding the Land Use Permit application of Dr. Sparkuhl.
NEW BUSINESS:
1. Mr. Dawson informed the Council that Ordinance No. 5, the "Land Use
Ordinance", lacked clarity insofar as administration in that Section III, C, 2,
a, b, and c. Therefore, a proposed amendment to the ordinance was offered to wit:
Ordinance No. 26 - "An Ordinance of the City of San Juan Capistrano amending
Ordinance No. 5, by adding thereto a new section Section III, C, 2, d, limiting
the areas within which assessory buildings may be constructed."
Tony Olivares made a motion to adopt said Ordinance No. 26. Seconded by
William Bathgate. Passed and so ordered.
2. The need for County services, to the extent of:
(1) fire protection
(2) police protection
(3) building permit & inspection administration
(4) highway department administration & maintenance
was brought forth for consideration.
Resolution was passed, directing the Clerk to forward a letter to the Board
of Supervisors of Orange County, requesting the composition of contract agreements
for the aforementioned services.
3. Fred Newhart reported the meeting of the Planning Commission that was held
at 3:10 P. M., Monday afternoon, May 29, 1961.
