Thompson City Clerk Pro -Tem Official proceedings of the City Council of San Juan Capistrano, April 24, 1961. -'/-2.4f-6/ Regular Adjourned Meeting of the City Council of the City of San Juan Capistrano May 1, 1961 The meeting was called to order at 7:32 P. M., by the Mayor, Mr. Carl E. Buchheim. Invocation was given by Dr. William C. Loper of the Community Church. Salute to the flag. Roll was called by the City Clerk, protem, Mr. Ernie Thompson. Councilmen present: Mr. Carl E. Buchheim, Mr. Don Durnford, Mr. Edward S. Chermak, Mr. William A. Bathgate and Mr. Tony Olivares Minutes of the meeting of April 24, 1964, were read and approved. WRITTEN COMMUNICATIONS RECEIVED: 1. Agreement regarding the provisions of contracting with the State Board of Equalization. Mr. Dawson, City Attorney, advises entering into an agreement. Mr. Don Durnford made a motion to authorize the Mayor to execute such agree - went. Ed Chermak seconded the motion. Passed and so ordered. 2. The Clerk read a letter from the 'Orange County League of Cities" extending an invitation of membership. Subsequently, a letter from the "League of California Cities" was read. Action deferred on both letters; letters filed. 3. Letter from the Mosquito Abatement District, Orange County, was read. The matter was discussed, then tabled. ORAL COMMUNICATIONS: 1. Mr. Latham relates problem of renovating a building adjacent to the "south gate" of the "Mission". Adversity and complexities were itemized, consequential to the incorporation of the City. Matter deferred to the City Attorney for directive processing. 5-/-(o/ 15 J6 UNFINISHED BUSINESS: 1. City Administrator - City Clerk appointment. Matter postponed to last item of business on meeting agenda. 2. Land Use Permits Rev. J. C. Gantenbein of the Southern Baptist Church presented plans of the proposed church to be constructed along Del Obispo Strebt. Discussion followed. Reports were requested on the following: _ (a) Flood Control & drainage (b) Sewer disposal (c) Ingress & egress location and design (d) List of property owners within 300 feet of location. 3. Urgency Ordinances (a) Proposed Handbill Ordinance (NO. 22) was read: "An Ordinance of the City of San Juan Capistrano regulating the distribution of handbills; pro- hibiting the distribution thereof under certain circumstances; prescribing penalties of the violation thereof; and declaring the urgency hereof." Discussion followed. Ed Chermak made a motion to adopt said ordinance, seconded by Tony Olivares. Approved and so ordered. (b) Proposed Ordinance (No. 23) was read: "An Ordinance of the City of San Juan Capistrano prohibiting the practice and exhibition of the business or art of astrology, palmistry, phranology, life -reading, fortune-telling, and similar pursuits, prescribing penalties therefore and declaring the urgency hereof." Discussion was held. Don Durnford made a motion to adopt said ordinance, seconded by Bill Bath- gate, approved and so ordered. _ An ordinance regulating the activity of "peddlers and solicitors" within the City of San Juan Capistrano was proposed. Taken under study with action deferred. "FIVE MINUTE RECESS"....... The proposed Business License ordinance was extended to the City Council for its consideration in order to further advise the City Attorney what realm the ordinance should encompass. Mr. Dawson related that basic licenses could be either "gross receipt tax" or a "flat fee". Other facets were the "exemptions", "contractorsY, "Wholesalers" an8 4etailers". The matter was taken under advisement. Action deferred. 17 REPORTS and RECOMMENDATIONS followed: 1. Mr. Dawson, City Attorney (a) Reported on resolutions being drafter (b) Recommends - (1) preliminary meetings; (2) Citizen participation in submitting possible ordinances. (c) Diagonal Parking, the need of diagonal parking, location, zones and limits, and pertinent crosswalks. (d) Capitol Outlay - (1) Stationery, (2) 'tephone, (3) Office equipment. (e) Mailing address - with regards to possible rental of property and availble space. 2. Mr. Thompson - City Clerk protem (a) Land Use Permits - Assessor's maps & file folder setup with the Building & Safety Dept., County of Orange. (b) State Board of Equalization - will receive addresses within and outside the perimeter of the city limits. Mr. Chermak, with mutual feeling of fellow councilmen, resolved that the appoint- ment of a City Clerk -Administrator will be made at the next regular meeting. Mr. Olivares related a "Public Notice" regarding a Use Variance hearing through previous County jurisdiction and processing. The applicant to be contacted and advised. Said applicant to be processed under the "Land Use Permit" ordinance of the City of San Juan Capistrano. Karl Wray, co -publisher of the "Coastline Dispatch", announced the coming appearance of Gov. Brown to the City of San Juan Capistrano on May 6, 1961, 4:30 P. M. or thereafter with a reception to follow. All officials of the City and those citizens present were invited to attend.
