61-0424_CC_Minutes_Regular Meeting11 Regular Meeting of the City Council of the City of San Juan Capistrano APRIL 24, 1961 The meeting was called to order by Mr. John Dawson. Introduction of Father James Toal, Mission of Sap Juan Capistrano, was made. Invocation was given by Father James Toal. Salute to the flag was lead by Mr. John Dawson. The roll was called. Councilmen present were# William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Don Durnford, and Antonio M. (Tony) Olivares. Election by secret ballot for Mayor was held. Mr. Carl E. Buchheim elected. Election by secret ballot for Mayor Pro -Tem was held. Mr. Don Durnford elected. Mr. Dawson presented the Mayor with a new gavel. The Mayor, Mr. Buchheim, takes control of the meeting. Mr. Buchheim extended his gratitude for the people's confidence in their electing him Mayor: He further extended his hopes and aims. Motion made by Don Durnford, duly seconded by Bill Bathgate, and carried, the appointment of Ernest A. Thompson as City Clerk Pro -Tem. Motion made by Don Durnford, duly seconded by Ed Chermak, and carried, the appointment of John Dawson as City Attorney. Mr. Carl Buchheim introduced Mr. David Ring, Administrative Assistant to Supervisor Claire Nelson. Mr. Ring spoke for Mr. Nelson as to extending help and cooperation from the County level of government and best wishes to all City Councilmen. The City Clerk Pro -Tem, read a letter from the co -publisher of the "Coast- line Dispatch", relative to the offer of publishing all legal notices and ordinances. Ed Chermak made a motion to accept the offer of Mr. Karl Wray, co -publisher of the "Coastline Dispatch" duly seconded by Don Durnford. Approved and so ordered. The matter of initial ordinances and ordinances with the urgency thereof was brought up by John Dawson. The following ordinances were read, with the action taken: No. 1 "An Ordinance of the City of San Juan Capistrano, setting time and place of the Council meetings of the City of San Juan Capistrano." Tony Olivares made a motion, duly seconded by Bill Bathgate to approve said ordinance. Approved and so ordered. 21-zq-6/ 14 No. 16. "An Ordinance of the City of San Juan Capistrano prohibiting intoxication in certain places." Don Durnford made a motion, duly seconded by Ed Chermak, to approve said ordinance. Approved and so ordered. No. 17. "An Ordinance of the City of San Juan Capistrano requiring the capping or covering of abandoned wells and providing penalities for the violation thereof." Ed Chermak made a motion, duly seconded by Bill Bathgate, to approve said ordinance. Approved and so ordered. No. 18. "An Ordinance of the City of San Juan Capistrano relative to the assessment of property and the collection of taxes." Don Durnford made a motion, duly seconded by Tony Olivares, to approve said Ordnance. Approved and so ordered. No. 19. "An Ordinance of the City of San Juan Capistrano providing that the City Council may create offices and positions, define the duties incident thereto, fix salaries therefore and time of payment thereof by resolution." Bill Bathgate made a motion, duly seconded by Tony Olivares, to approve said ordinance, as an emergency ordinance. Approved and so ordered. No. 20. "An Ordinance of the City of San Juan Capistrano authorizing the establishment of a depositary for the General Fund of the City of San Juan Capistrano, specifying procedures for deposits and determining authorized signatures necessary for withdrawals." Ed Chermak made a motion, duly seconded by Tony Olivares, to approve said ordinance. Approved and so ordered. No. 21. "An Ordinance of the City of San Juan Capistrano requiring the bonding of the City Clerk and the City Treasurer and setting the amount of said bonds." Don Durnford made a motion duly seconded by Ed Chermak to approve said ordinance. Approved and so ordered. Discussion as to the selecting or appointing the City Treasurer was tabled until the next regular meeting. Discussion relative to the confirmed selection and appointment of a City Administrator and City Clerk was tabled until the next regular -meeting. City Attorney, John Dawson, suggested some consideration be given to obtaining insurance for the City. Resolution was passed to instigate and properly oppose the transfer of the funds, presently delegated for the improvement of the Dana Point Harbor project, to any other locality (certified copies to be sent to the proper people.) Resolution was passed to request that certain excess property of the State Division of Highways NOT be placed on public auction. 14-2A41
