Minutes of the Meeting of the City Council of San Juan Capistrano
AUGUST 12, 1968
The regular meeting of the City Council was called to order at
7:00 PM by Mayor Edward S. Chermak.
The Pledge of Allegiance was recited. Invocation was given by
City Attorney, John H. Dawson.
The City Clerk called the roll. Councilmen present: William A.
Bathgate, Don Durnford, Thomas A. (Tony) Forster, Antonio M. (Tony)
Olivares and Edward S. Chermak.
The minutes of the regular meeting of July 22, 1968 were approved
as presented.
WRITTEN COMMUNICATIONS
(a) Minutes of Orange County Division, League of California Cities'
Meeting of July 25, 1968 - Informational
(b) Resolution from Capistrano Unified School District regarding
safety hazard in area of new Jr. High School site. After consider-
able discussion, Councilman Bathgate moved that a letter be direct-
ed to the School Board indicating the action taken by City Council
in the willingness of 50% participation by the City in the side-
walk project, and recommending that the Board contact County
Counsel for immediate action in connection with street improve-
ments required by Tract No. 4986. Motion seconded by Councilman
Forster and carried by unanimous vote.
(c) Communication from Orange County Health Department regarding
mobile commercial x-ray units. Councilman Forster, seconded
by Councilman Durnford, moved that Council take no action until
County has prepared appropriate ordinance. Carried unanimously.
(d) City Administrator, Ernest A. Thompson, cited matters before
Orange County Board of Supervisors pertaining to the area.
TREASURER'S REPORT
The statement of cash receipts and disbursements for the month
ending July 31, 1968 was presented by the Office of the City Treasurer.
Councilman Bathgate moved, seconded by Councilman Durnford, that the
Report be accepted and filed for audit. Motion carried unanimously.
PUBLIC HEARING - RZ 68-101 (Mission Hills Ranch)
Mayor Chermak announced that this being the time and date set
for public hearing on RZ 68-101, opened the hearing. He asked if any-
one wished to speak in favor of the rezone. City Administrator
explained Parks and Recreational Element. The Mayor then asked if
anyone wished to speak in opposition to the rezone. As there were no
major protests, declared public hearing closed.
Councilman Durnford moved that an ordinance be drafted to accomplish
the proposed rezone. Motion seconded by Councilman Forster and carried
unanimously. Item continued until later in the meeting for first read-
ing of proposed ordinance by City Attorney.
UNFINISHED BUSINESS
Letter from C. L. Markum requesting time limit for two parking
spots on westerly side of Camino Capistrano. Mayor Chermak referred
matter to staff for recommendation.
NEW BUSINESS
(a) Letter from Weldell Langman supporting Mr. Markum's request, and
urging consideration of trash problem in downtown streets. Con-
siderable discussion followed regarding proposed street improve-
ments and future parallel parking on Camino Capistrano. Mayor
Chermak then referred the matters to staff for recommendation and
report and instructed City Clerk to inform Mr. Markum of City's
plans in these directions. New street sweeping schedule is to
be published in Coastline Dispatch.
(b) Announcement of Institute on Labor Relations for City Officials
and request from City Administrator for attendance at the Con-
ference. Due to size of the City, Councilman Forster moved for
denial of the request. Seconded by Councilman Durnford and
carried unanimously.
(c) Proposed ordinances updating the following Codes were referred to
City Attorney for review and report for action at the next regu-
lar meeting:
(1) The Uniform Building Code, 1967 Edition
(2) Uniform Mechanical Code, Volume II, 1967 Uniform Bldg. Code
(3) The Uniform Plumbing Code, 1967 Edition
(4) The National Electric Code, current 1965 Edition
(5) Housing, Volume III, 1967 Uniform Building Code
(d) Request from Planning Commission to set public hearing date for
RZ 68-103 (McCracken). City Administrator, stating Monday,
September 9, 1968 is legal holiday, recommended setting hearing
date September 10, 1968 at 7:00 PM. Mayor Chermak so proclaimed.

(e) Continuing matter of RZ 68-101 (Mission Hills Ranch), Councilman
Bathgate moved that first reading of proposed Ordinance No. 138
be read by title only. Motion seconded by Councilman Durnford and
carried unanimously. City Attorney rendered first reading by
title only.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
(1) Regarding Park Site consideration of Kolbet, matter left in
deferral stage until Mr. Koll obtains financial backing
agency.
(2) Regarding cooperation between City and San Clemente on zon-
ing problems, Mr. Ken Carr posed study group be formed
involving Mayors and Planning Commissions of both cities.
Mayor Chermak recommended City Engineers also participate.
(b) City Attorney, John H. Dawson
(1) Has been in contact with County Counsel regarding lawsuit
involving Capistrano Shores Annexation. City can either
appeal or proceed with new annexation. Council concurred
that the item be dropped for the present. Mayor Chermak so
instructed.
(2) Regarding Parkways in city streets, is reviewing report on
County Improvement Districts (1911 Act) now amended to in-
clude cities. Will send report to City for review and study.
(c) Director of Public Works, T. J. Meadows
(1) Requested consideration for purchase of Model 111BP pump for
treatment plant and sewer maintenance at cost of $395.23
plus tax. Councilman Bathgate, seconded by Councilman Durn-
ford, moved that purchase be authorized. Carried unanimously
and so ordered.
(2) Authorized closure of Serra on-ramp to the freeway for period
of 45 days.
(3) Directional signs for Camino Capistrano and Del Obispo have
been ordered and will be installed upon delivery.
(4) Regarding report on ocean outfall prepared by Orco Diving
Service, has contacted representative of Dana Point Sanitary
District who feels situation is not critical at this time,
but will keep under surveillance.
