FEBRUARY 199 1968
The regular meeting of the City Council was called to order
at 6:03 PM by Mayor Edward S. Chermak.
The pledge of allegiance was recited. Invocation was given
by City Administrator, Ernest A. Thompson.
The City Clerk called the roll. Councilmen present: William
A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony)
Olivares and Edward S. Chermak.
The minutes of the regular meeting of February 13, 1968 were
approved as presented.
WRITTEN COMMUNICATIONS
A copy of Statement of Policy of Capistrano Beach and Dana
Point Sanitary Districts was presented. Councilman Buchheim moved
that the document be referred to legal and professional staff for
study and report at the next regular meeting. Motion seconded by
Councilman Durnford and carried by a majority vote, Councilman
Bathgate voting "No".
ORAL COMMUNICATIONS
Mr. George Kastorff appeared before Council relating the
following: (1) Junk car on street near Jr. High School. He was
assured Sheriff's office has been notified; (2) Sidewalk in front
of Swallow's Inn not completed. Staff to check status.
UNFINISHED BUSINESS
Request from Capistrano Valley Jaycees urging the City Council
to adopt appropriate ordinaice to take advantage of property transfer
tax, stating funds derived could be used for development of parks and
recreational facilities in the City. City Attorney suggested if
ordinance were passed, funds should go into General Fund. Mayor
Chermak, seconded by Councilman Durnford, then moved that first
reading of proposed ordinance relating to documentary stamp taxes
on the sale of real property, be read by title only. Motion carried
unanimously. City Administrator then rendered first reading of pro-
posed Ordinance No. 132 by title only.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
Reported regarding construction of Tiny Naylor's Restaurant
and service station in Stroschein development. Principles

wish to utilize hilltop property as borrow area for filling
their location. This fill, involving 85,000 cubic yards of
material, to be removed according to Mr. Munce's specifications
for leveling of said hilltop. The question arose as to the
necessity of processing a land use permit. After consider-
able discussion, Mayor Chermak moved that the Munce property
be utilized as site preparation without a land use permit if
any and all requirements of the Grading Code, plus the follow-
ing conditions are met:
(1) Valle Road, San Juan Creek Road, Interstate 5 and
Ortega Highway be utilized for routing.
(2) Spillage clean-up daily.
(3) Time of operation, 7:00 AM to 5:00 PM daily, Monday
through Friday.
(4) No activity from 5:00 PM March 15th until 7:00 AM
March 18th (Swallow's Day weekend).
Motion seconded by Councilman Buchheim and carried unanimously.
(b) Director of Public Works, T. J. Meadows
Introduced Mr. Joe Feeney and Mr. Gene Kazmierczak of Engineer-
ing Science, Inc., who were in the audience.
(c) City Engineer, Jack Y. Kubota
(1) Made presentation of centerline profile sheet, Del
Obispo alignment, from Aguacate Road to high school
property.
(2) Approved this date street plans for Stroschein property.
ADJOURNMENT
There being no further business, the meeting adjourned at
7:25 PM. '
