68-0213_CC_Minutes_Regular Meeting38t ` Minutes of the Meeting of the City Council of San Juan Capistrano FEBRUARY 13, 1968 The regular meeting of the City Council was called to order at 6:05 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by City Attorney, John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Don Durnford and Edward S. Chermak. Councilman Olivares arrived at 6:10 PM. Absent: Carl E, Buchheim. The minutes of the regular meeting of February 5, 1968, were approved as presented. WRITTEN COMMUNICATIONS Letter from Capistrano Valley Jaycees, urging the City Council to adopt an appropriate ordinance to take advantage of property transfer tax; funds derived could be used for development of parks and recreational facilities. Mayor Chermak suggested item be held over until full Council was present. ORAL COMMUNICATIONS Mr. Timothy Strader, Deputy County Counsel, appeared on be- half of the Saddleback Junior College District. He stated letter was sent to City Administrator January 30th requesting that in order to satisfy formal requirements of the school board, language in motion passed by the four municipalities be uniform. Council- man Durnford then moved that the motion passed January 22, 1968 be amended to incorporate suggested language, "nunc pro tunc", to read as follows: "Councilman Bathgate moved that the City of San Juan Capistrano hereby consents to the consolidation of the bond election of the Saddleback Jr. College District to be held on April 9, 1968 with the municipal election to be held on that same day in the City of San Juan Capistrano. Councilman Durnford seconded motion and it carried unanimously." This motion was then seconded by Councilman Bathgate and carried by a unanimous vote. TREASURER'S REPORT The statement of cash receipts and disbursements for the month ending January 31, 1968 was presented by City Treasurer, Alice M. Ross. Councilman Bathgate, seconded by Councilman Durnford, moved that the Treasurer's Report be accepted and filed for audit. Motion carried unanimously. 2 —/3—bop 3 4 PLANNING COMMISSION MATTERS Minutes of meeting of February 6, 1968. Council action required regarding request from Community Presbyterian Church for waiver of landscaping for period of one year. Councilman Durnford, seconded by Mayor Chermak, moved that the request be granted. Motion carried by 3 to 0 vote, Councilman Bathgate abstaining. NEW BUSINESS Request from American Legion Post #721 for approval of an exclusive franchise for sale of fireworks. Councilman Durnford moved that Post #721 be permitted to set up fireworks sales be- tween 12:00 Noon June 28 to July 4, 1968, subject to normal con- ditions. Motion seconded by Councilman Olivares and carried unanimously. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson Reported that two laborers hired by the City to begin work February 15th. They are Rueben Vasquez and Alfred Sanchez. (b) City Attorney, John H. Dawson (1) Reported on notice from League of California Cities regarding California Supreme Court decision to declare unconstitutional the second paragraph of oath formerly required of public officers and employees in the Cali- fornia Constitution. (2) Reported on suggestion from League of California Cities regarding adoption of undergrounding ordinance. City Administrator stated more information on the sub- ject forthcoming. (3) Goes before Superior Court, Department 18, February _ 15th regarding Capistrano Shores annexation. (c) City Treasurer, Alice M. Ross Expressed concern regarding California Supreme Court drop- ping portion of oath, as reported by City Attorney. (d) Director of Public Works, T. J. Meadows Dennis O'Leary of Water Pollution Control Board, checked on problem of overflow in Oso Creek, and assures that it will not occur again. (e) City Engineer, Jack Y. Kubota (1) Made presentation of new Route #1, Interstate 5. Map z-i3-bg shows entire area on East side of Interstate S. 38, Con- Del Obispo chuck holes getting rougher and deeper. Director of Public Works stated County coming back to fill. (g) Mayor Chermak Reported that Dana Point and Capistrano Beach Sanitary Districts have rejected recommendation and suggestions from the City of San Juan Capistrano regarding a new Joint Powers Agreement. They gave an ultimatum for an answer from the City by March 1, 1968. His personal opinion was that some areas lack sincerity in looking at the over-all area as far as the South Coast is concerned. Received correspondence from Engineer of Waterworks District #4. Water line will not be built by May 15th. If no objections, asked to postpone paving job. Also stated he will have a look at preliminary design of traffic signalization within a month. (4) Has been working with Director of Public Works and Engineering -Science. Will present at the next regular meeting complete report on providing outfall for Darmi tract. (f) Councilman Durnford Del Obispo chuck holes getting rougher and deeper.
