68-0108_CC_Minutes_Regular Meeting366 Minutes of the Meeting of the City Council of San Juan Capistrano JANUARY 8, 1968 The regular meeting of the City Council was called to order at 6:01 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll. Councilman present: William A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak. The minutes of the regular meeting of Janaury 2, 1968 were approved as presented.— WRITTEN COMMUNICATIONS (a) Memorandum from League of California Cities re Distribution of Cigarette Taxes to Cities, formula attached. City Administrator explained how allocation was granted to cities. Councilman Bathgate offered Resolution No. 68-1-8-1 endors- ing proposed formula as presented, based upon both population and tax collected, to be directed to League of California Cities. Resolution passed, approved and adopted by 4 to 1 vote, Councilman Buchheim voting "No". (b) Correspondence from City of Tustin regarding proposed detachment of the City of Huntington Beach from the Orange County Harbor District. Councilman Durnford, seconded by Councilman Olivares, moved that the item be tabled indefinitely. Motion carried unanimously. (c) Notice, Orange County League of Cities, of Executive Meeting for January, 1968. Mayor Chermak and Councilmen Bathgate and Durnford to attend. (d) Request from American Cancer Society for annual fund drive. Permission granted. (e) City Attorney in receipt of letter from Wallace, Brown and Crane, attorneys, on behalf of residents of Doheny Park Village, complaining of sewerage odor in their area on Christmas day. Mr. Dawson was directed to reply to corres- pondence. ORAL COMMUNICATIONS Dr. Caruthers, of the Dana Point Sanitary District, asked permission to bring up the matter of the Joint Powers Agreement during this period. Mayor Chermak re- viewed for fellow Councilmen the outcome of committee meetings to date. After very lengthy discussion between Council, staff, members of the Dana Point District and representatives of Engineering -Science, Councilman Bathgate moved that the City employ the services of Mr. Fritz Stradling as legal counsel for the purpose of drafting a Joint Powers Agreement, subject to the approval of the other three entities to share expenses, and Engineering -Science to do the engineering work neces- sary for the Joint Powers Agreement. Motion seconded by Councilman Durnford and carried by a majority vote, Councilman Olivares voting "No". (Minute Order of this /-8-68 367 motion is to be presented to all entities involved). TREASURER'S REPORT The statement of cash receipts and disbursements for the month ending December 31, 1967 was presented by City Treasurer, Alice M. Ross. Councilman Bathgate, seconded by Councilman Durnford, moved that the Treasurer's Report be accepted and filed for audit. Motion carried unanimously. PLANNING COMMISSION MATTERS The Secretary of the Planning Commission presented Minutes of the meeting of January 2, 1968 for Council perusal. UNFINISHED BUSINESS City Attorney read draft of resolution urging the PUG to delay any determin- ation of approval for any additional franchised service from Orange County Airport. Councilman Bathgate offered Resolution No. 68-1-8-2, as presented above, for adopt- ion. Resolution passed, approved and adopted by a 4 to 1 vote, Councilman Durnford voting "No". Councilman Buchheim then moved that a letter be sent to Wm. L. Pereira and Assoc., the firm making the study for the County of Orange Airport Master Plan, strongly urging that they recommend El Toro Airbase for franchised air carriers. Motion seconded by Councilman Durnford and carried unanimously. NEW BUSINESS Exoneration of Monumentation Bonds, Tract 6038 (Marina Capistrano) - City Engineer requested time to review the situation for recommendation and report back to Council at the next regular meeting. RECOMMENDATIONS AND REPORTS (a) Ernest A. Thompson, City Administrator (1) Happy to report that all vehicles have left the "junk yard" on Camino Capistrano. (2) Redrafted storage facility lease sent to Mr. Osborne's office. Now awaiting signature from County Counselor's office. (3) Dr. Haight and Poundmaster Mason of the Orange County Health offices will be in attendance at the next regular meeting to present new contract for animal control services. (4) Truman Smith will not pick up trash in three City areas Wednesday, Jan. 10th, due to truck repairs. Pick-up will be on Thursday, Jan. 11th. (b) City Attorney, John H. Dawson (1) Received call from attorney regarding lighting of outdoor advertising sign near Airport annexation. Mr. Dawson asked him to submit complete report and he will bring it before Council. /-8^L 8 » 68U� (2) Had conversation from Real Property Services regarding his redrafting SDG&E storage building lease. (c) Director of Public Works, T. J. Meadows Invited Council to look at results of study regarding deep ditch sections on both sides of Camino Capistrano. (d) City Engineer, Jack Y. Kubota (1) Regarding retaining wall on east side of north bound lane on Camino Capistrano, according to plans they have provided a 11' travel lane and 8' parking shoulder. (2) Reported on mounting theivery and vandalism of road signs in the City. (e) Councilman Bathgate (1) Expressed concern regarding air rifle shots eminating from rural areas. City Attorney to research firearms laws. (2) Suggested City purchase new metallic display board and blackboard for Council Chambers. (f) Councilman Buchheim (1) Orange County Bank official related several customers had received traffic citations for making left hand turn at bank exit. (2) Thinks it is time that stop signs be posted at Camino Capistrano and Del Obispo Street making it a four-way stop intersection. This matter is to be discussed at the next regular meeting. (3) Suggested City purchase suitable chairs for Council table. (g) Mayor Chermak Commented on "junk yard" at Richfield station. He feels parent company should be made aware of this situation.
