67-1218_CC_Minutes_Regular Meeting359 Minutes of the Meeting of the City Council of San Juan Capistrano DECEMBER 18, 1967 The regular meeting of the City Council was called to order at 6:00 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak. The minutes of the regular meeting of December 11, 1967 were approved as presented. UNFINISHED BUSINESS (a) The item regarding "Driveways Within Public Rights of Way" was continued from the meeting of December 11th. After considerable Council debate, Councilman Buchheim, seconded by Councilman Durnford, moved that the present treatment be permitted but that the property owner be incumbered with the responsibility of removing the encroachment portion of the driveway at the request of the City. Motion carried by a majority vote of 3 to 2. City Attorney to draw contract agreement between property owner and the City, which is to be recorded. (b) Mr. Sant, developer of Marina Capistrano tract, appeared before Council request- ing waiver of improvements on 55 acre parcel. He presented a map and letter quoting section of Ordinance No. 56 regarding proposed Division of Land and explained the situation in detail. Councilman Buchheim then moved that the street improvements for Camino del Avion and Del Obispo Street be waived, with the concurrence of the Planning Commission regarding proposed Division of Land 67-104. Motion seconded by Councilman Durnford and carried unanimously. (c) Waterworks District #4 sub -lease of garage and storage facilities. Councilman Buchheim, seconded by Councilman Bathgate, moved that the lease, as re -phrased and presented by City Attorney, be accepted and executed on behalf of the City of San Juan Capistrano, as Lessor, and submitted to the County of Orange, as Lessee, for their execution. Motion carried unanimously. City Attorney to hand carry to County. NEW BUSINESS (a) Appeal of Land Use Permit Application (LUP 67-108). City Attorney, John H. Dawson, stated that when an Appeal is made, the City Council reviews the file and a "de novo" hearing on Appeal is opened. Mayor Chermak opened the hearing. Counselor Jack Rimel appeared as spokesman for the appellants, stating their objections to the proposed trailer park and requesting Council consideration. Lengthy discussion took place among Council members, proponents, opponents and /2-/8-67 360 several members of the Planning Commission. City Attorney stated Council should consider all matters that were presented before the Planning Commission, such as topographical maps, pictures and model of the proposed park. Mayor Chermak then continued the hearing until the next regular meeting which, due to the Christmas Holiday, is to be held Tuesday, December 26, 1967. (b) City Administrator, Ernest A. Thompson, presented minutes of the meetings held Thursday, December 14, 1967, regarding proposed joint venture of the area sewerage facilities. Mayor Chermak reported on the meetings, stating that Mr. Walt Garrison of the Los Angeles County Sanitary District and con- sented to work with the Dana Point Sanitary District and the City of San Juan Capistrano for two days and then present a written recommendation re- garding the ocean outfall problems, and that the City should participate in paying for normal expenses incurred in Mr. Garrison's travels to the area. Mayor Chermak then directed City Engineer, Jack Y. Kubota, to investigate engineering, operation and maintenance costs for the proposed additional joint use. (c) Personnel classification and position request, Public Works Department Project "Head Start" - Deferred to next regular meeting. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson. Formal papers will be received regarding Master Lease on holdings of Mission properties effective January 1$, 1968. Requested City pro -rate monthly rent. Awaiting notification by Mission. (b) City Engineer, Jack Y. Kubota Would like to consult with Engineering -Science for background on sewerage and the City of San Clemente as to how much gallonage is to be sent. (c) Mayor Chermak Read excerpts from copy of letter to Assistant Regional Administrator for Metropolitan Development from H. G. Osborne regarding Waterworks District #4 which reflected a future intent to transfer agency to the City. ADJOURNMENT The meeting adjourned at 9:01 PM. E est A.
