Minutes of the Meeting of the City Council of San Juan Capistrano
DECEMBER 11, 1967
The regular meeting of the City Council was called to order at 6:00 PM by
Mayor Edward S. Chermak.
The pledge of allegiance was recited. Invocation was given by Ernest A.
Thompson, City Administrator.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak.
The minutes of the regular meeting of December 4, 1967 were approved as
presented.
WRITTEN COMMUNICATIONS
(a) Notice of Orange County League of Cities Executive Meeting for December, 1967.
As reports on administration of the new Property Transfer Tax were to be given,
Mayor Chermak urged Council attendance.
(b) Memorandum from staff regarding Driveways Within Public Rights of Ways.
Lengthy discussion took place. Mayor Chermak directed that the matter be con-
tinued to the next regular meeting.
(c) Appeal in the matter of Land Use Permit Application #67-108. Mayor Chermak
set a hearing, open to the public, for December 18, 1967. Applicants and
opponents are to be notified.
(d) Correspondence from State Controller regarding monthly apportionment of the
Cigarette Tax Fund - Informational
ORAL COMMUNICATIONS
Mr. Sant, developer of the Marina Capistrano tract, appeared before Council
requesting waiver for development of parcel. Mayor Chermak asked that Mr. Sant
attend the next regular meeting with proper documents and map to present for Council
review.
TREASURER'S REPORT
The Statement of Cash Receipts and Disbursements for the month ending November
30, 1967 was presented by City Treasurer, Alice M. Ross. Councilman Durnford, seconded
by Councilman Bathgate, moved that the Treasurer's Report be received and filed for
audit. Motion carried unanimously.
NEW BUSINESS
(a) Waterworks District #4 Sub -lease of garage and storage facilities. City
Attorney, John H. Dawson, stated he was not satisfied with the lease as pre-
sented from the District. Mayor Chermak recommended that Mr. Dawson re -write
the lease using his own terminology, to present at next regular meeting.
(b) City Administrator in receipt of executed Agreement for waiver of undergrounding

of transmission line for parcel map at Del Obispo and Camino Capistrano.
City Attorney stating document in satisfactory order, Councilman Bathgate,
seconded by Councilman Durnford, moved that the Agreement be accepted and
recorded. Motion carried unanimously.

(b) City Attorney, John H. Dawson
Received from California League of Cities a suggested ordinance for removal
of abandoned vehicles on private and public properties.
(c) City Engineer, Jack Y. Kubota
(1) Reported on drainage at Baptist Church site. Parties have agreed to
install storm drain, but it will be bulkheaded until future use.
(2) Proceeding with plan check for improvements of Phillips 66 station.
Also plan check for Del Obispo.
(3) County of Orange has replied to correspondence from CUSD and his letter
regarding the Del Obispo bridge. Reconstruction is to commence
January 4, 1968.
(4) State Division of Highways did fund $2,000 asked for Engineering from
Gas Tax Program. Budget clearance came through last week.
(d) Councilman Buchheim
Inquired if tape recorder in Council Room still in use. Answer was negative
as reception from microphones not appropriate.
There being no further business, the meeting adjourned at 7:46 PM.
