67-1204_CC_Minutes_Regular Meeting355 Minutes of the Meeting of the City Council of San Juan Capistrano DECEMBER 4, 1967 The regular meeting of the City Council was called to order at 6:00 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by John H. Dawson, City Attorney. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak. The minutes of the regular meeting of November 27, 1967 were approved as presented. WRITTEN COMMUNICATIONS (a) Request from Motor Car Dealers of Orange County to designate December 1 - 10 as Automotive Week. Mayor Chermak then proclaimed "Orange County Automotive Week". (b) Resolution from City of Anaheim, concerning Federal Tax Sharing. This item tabled for future discussion. ORAL COMMUNNICATIONS Mr. L. D. Bruce appeared before Council to appeal his position regarding the installation of a driveway on La Matanza. Mr. John Springman, who installed the driveway, also appeared on Mr. Bruce's behalf. City Attorney cited sections of the Penal Code, Civil Code and Code of Civil Procedure. Lengthy discussion follow- ed. Mayor Chermak recommended that staff study the situation and report back at the next regular meeting. UNFINISHED BUSINESS John H. Dawson, City Attorney, reported on Property Transfer Tax and read excerpts of State law on the subject. Item deferred for further study. NEW BUSINESS (a) Letter from Capistrano Unified School District requesting adoption of ordinance requiring subdividers to dedicate property to the school district. Council concurred in that there should be direct negotiations among all agencies con- cerned. Item tabled for the future. /C'2 i//(b) City Attorney in receipt of Easement Grant Deed from D. A. Gannon Company pertaining to Assessment District No. 66-1. Councilman Bathgate offered Resolution No. 67-12_4-1 accepting the deed and authorizing recordation of same. Resolution passed, approved and adopted by unanimous vote. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (a) Reported on State-wide Conference on undergrounding utilities. Notebook /2-42-67 35 ► received is on file in his office for public perusal. (2) Received letter from SDG&E suggesting conversion projects of overhead utilities to underground in various areas of the City. (b) City Attorney, John H. Dawson In receipt of letter from California League of Cities regarding subdivision park dedication. A test case is now running in Walnut Creek, California. He stated they are open to any suggestions. (c) Director of Public Works, T. J. Meadows Mr. Meadows gave the floor to Mr. Richard Bentwood of Engineering -Science, who reported on progress of construction in Assessment District 66_1 Approci- mately 96% of total lineal footage in place to date. (d) City Engineer, Jack Y. Kubota (1) Reported on widening of Camino Capistrano from Del Obispo to San Juan Creek Bridge. Estimated cost for street portion would run $50,000, and an estimated $10,000 to reconstruct street lighting and conversion to underground. Also, an approximate cost of $15,000-20,000 for drainage purposes. (2) Made presentation of strip map of Del Obispo precise alignment adjacent to Presbyterian Church property and Russ Cook property. An estimated cost for road purposes would be $20,000, or approximately $20.00 per foot. (3) In consultation with Mr. Misbin and Mr. Christiansen of Darmi Tract. They would like to commence negotiations with State Highway Division regarding the Las Ramblas interchange. (4) Would like to set up meeting with proponents involved in Baptist Church drainage problem. (e) Councilman Buchheim Inquired as to progress on (1) Val Verde; (2) Greenlee easement; and (3) Reid and Chade property easements in connection with AD 64-1 and AD 66-1 respectively. (f) Councilman Durnford Has received complaints regarding traffic markings on Del Obispo and Camino Capistrano. (g) Mayor Chermak Reported on meeting held with committees from four agencies in relation to joint facilities on ocean outfall. ® �v ADJOURNMENT - The meeting adjourned at 8:40 PM. E est A.
