67-1127_CC_Minutes_Regular Meeting353 Minutes of the Meeting of the City Council of San Juan Capistrano NOVEMBER 27, 1967 The regular meeting of the City Council was called to order at 6:06 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by City Adminis- trator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford and Edward S. Chermak. Absent: Antonio M. (Tony) Olivares. The minutes of the regular meeting of November 20, 1967 were approved as presented. WRITTEN COMMUNICATIONS (a) Minutes of the Executive Board, League of California Cities, Orange County Division, November 9th. (b) Correspondence from J. A. Legarra, State Highway Engineer, regarding amend- ment of the Outdoor Advertising Act. Mayor Chermak directed City Clerk to communicate with Mr. Legarra endorsing legislation. TREASURY DEMANDS The list of accounts payable November 30, 1967 was presented by Director of Finance, Harold L. Albert. Councilman Bathgate, seconded by Councilman Durnford, moved that Warrant Nos. 2866 through 2915, inclusive, be issued in the total amount of $40,816.98. Motion carried unanimously. PLANNING COMMISSION MATTERS (a) Minutes of the meeting of November 21, 1967 were presented for Council peru- sal. Councilman Durnford moved that the Planning Commission report be accepted as submitted. Seconded by Councilman Buchheim and carried unanimously. (b) Resolution No. 67-11-21_1 relating to similarity of uses in "Local Business" District presented for file. Councilman Durnford moved to uphold the Plan- ning Commission in its passage of this resolution. Motion died for lack of a second. UNFINISHED BUSINESS (a) In reply to the request of Orange County Waterworks District #4 for support of their application for grant in aid for installation of necessary improve- ments in the District, City Attorney read draft of letter. Councilman Buchheim, seconded by Councilman Durnford, moved that the full text of the letter be forwarded to Waterworks District #4, with copies to HUD and to each member of the Orange County Board of Supervisors. Motion carried by a 3 to 1 vote (Councilman Bathgate voting "No".) //-27-46-7 v5'4 (b) In the matter of proposed Ordinance No. 132 regarding Property Transfer Tax (reference Orange County Ordinance #2183 passed November 21, 1967 and effective January 1, 1968), City Attorney was directed to research Orange County method of procedure and report back at the next regular meeting. RECOMMENDATIONS AND REPORTS (a) City Attorney, John H. Dawson An interesting situation arose regarding eminent domain proceedings for AD 66-1, in that a certain property owner refused to cooperate in granting an easement, only to find, through title report, that when property was first deeded there was reserved an easement for road and public utility purposes from the original grantor. Engineering -Science will contact original pro- perty owner to discuss matter. (b) Director of Public Works, T. J. Meadows Reported on operation of Water Quality Control Plant. Problems have been solved and operation now running very efficiently. (c) City Engineer, Jack Y. Kubota (1) Proponents of Baptist Church asked for final approval of plans for church site and buildings. He then drew sketch outlining drainage problem areas. Councilman Buchheim suggested that City Attorney and City Engineer make recommendation to Council prior to time of final decision as to method of procedure. (2) Rains caused substantial slow -down in construction programs. (3) Developers wish to proceed with improvements on Del Obispo and Camino del Avion. They request some assistance from the City regarding the repaving after storm drain is installed. (4) State Division of Highways to prepare cooperative agreement regarding the Las Ramblas interchange for presentation by January, 1968. (5) Rendered cost figures on ornamental street lights. Mission Bell type cost approximately 45% more than regular type. (6) Will have reports on two road jobs at next meeting. (d) Councilman Durnford Asked status of annexation proceedings. City Attorney stated he is prepar- ing a Stipulation of Facts to present at Court. (e) Mayor Chermak Reported on meeting with Capistrano Beach and Dana Point Sanitary Districts and the City of San Clemente regarding possibility of joint ventures.
