67-1120_CC_Minutes_Regular Meeting3 0 Minutes of the Meeting of the City Council of San Juan Capistrano NOVEMBER 20, 1967 The regular meeting of the City Council was called to order at 6:01 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by City Attorney, John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak. The minutes of the regular meeting of November 13, 1967 were approved as presented. WRITTEN COMMUNICATIONS (a) Correspondence from the Mayor of the City of San Diego, regarding issuance of a California Commemorative 200th Anniversary Stamp, and enclosing a copy of their resolution urging adoption of a similar resolution in support of the event. Councilman Durnford, seconded by Councilman Bathgate, moved that the City Attorney prepare resolution supporting the request. Motion carried unanimously. Councilman Durnford then offered Resolution No. 67-11-20-1, requesting the Postmaster General of the United States to issue a commerat- ive United States Postage Stamp in the year 1969 to commemorate and memorial ize the founding of the State of California. Resolution passed, approved and adopted by unanimous vote. (b) Notice from League of Women Voters announcing a Symposium on Urban Trans- portation to be held December 5, 1967. (c) Letter from Capistrano Beach Sanitary District inviting City officials to attend meeting November 21, 1967 at 8:00 PM, for the consideration of cooper- ative efforts. (d) Letter from E. Gene Crain, office of Wallace, Brown & Crain, Attorneys at Law, on behalf of Doheny Park Village, mobile home park, complaining of obnoxious odors eminating from the City's sewer treatment plant. Councilman Buchheim, seconded by Councilman Durnford, moved that the matter be referred to City Attorney for study and recommendation. Motion carried unanimously. (e) Memo of rebuttal from treatment plant operator regarding the above item - Informational. ORAL COMMUNICATIONS Mr. J. B. Hileman, 31422 La Matanza, appeared before Council regarding back up of water and silting on his property due to neighboring driveway approach having been installed without a permit. City Attorney stated this case is pending, and he will contact District Attorney's office at once to decide what steps can be /1-20-6-7 351 taken to remedy the situation. UNFINISHED BUSINESS (a) Continuation of matter regarding installation of necessary improvements in Orange County Waterworks District #4. After considerable discussion, City Attorney, John H. Dawson, was instructed to draft a letter which would cover the situation and give the City the protection it needs. This correspondence to be presented at the next regular meeting for Council action. (b) Continuation of item concerning proposed contracts for complete animal con- trol services as outlined by Orange County Health Department. Mr. Thompson, City Administrator, stated present contract operational until June 30, 1971, under Master Contract. Council concurred in Councilman Durnford's suggestion that a representative of the County Health Department present a critique before signing of a new contract. City Administrator to set up appointment. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) One more vehicle removed from "junk yard". (2) Received rough draft of sub -lease for SDG&E storage building from Waterworks District #4. Contract to be submitted for execution around December 1st. Rental to be $108 per month. (3) Confirmation from Dana Point Sanitary District regarding meeting Tuesday, November 28th at City Hall, 7:30 PM. (b) Director of Public Works, T. J. Meadows (1) No recent development in negotiations with property owners for ease- ments in flood control channel. (2) Also in receipt of letter inviting Council to attend meeting with Capistrano Beach Sanitary District and City of San Clemente to nego- tiate a joint powers agreement. Mayor Chermak to attend. (c) City Engineer, Jack Y. Kubota (1) Will obtain cost estimates and make a comparison chart regarding use of Mission bell type lumenaires. (2) Tract 6427 (Mission Hills Ranch) installing sewer line. Considerable rain damage over the week -end. (3) Tract 6244 (Darmi) paved out. Little rain damage. (4) Some activity with developers and engineers regarding Stroschein Division of Land. (5) Proponents of Baptist Church anxious to finish storm drain, curbs and gutters and street improvements. 11-20-04-7 V (6) An engineering firm is making inquiry of revision regarding Del Obispo and Camino Del Avion. Has arranged at meeting for Wednesday. (d) Councilman Bathgate (1) Attended Orange County Planning Commission meeting regarding PC Zoning on adjacent property. Public Hearing was held. Item continued until December 13th. Will try to attend and report back to Council. (2) There have been numerous inquiries as to an abandoned vehicle on top of hill which takes on the appearance of an airplane crash. City Admin- istrator stated County could take jurisdiction of removal with insti- tution of proper ordinance. (e) Councilman Durnford Participated in an interesting field trip to Camp Pendelton sponsored by San Clemente Chamber of Commerce, where Marines were in training before being shipped to Vietnam. (f) Mayor Chermak Asked of Council had any objection to City Employees observing Friday following Thanksgiving as a holiday. Councilman Buchheim, seconded by Councilman Durnford, moved that City Hall remain closed Friday, November 24, 1967. (g) City Attorney, John H. Dawson Rendered draft of Resolution No. 67-11-20-1 previously adopted regarding California's 200th Anniversary. ADJOURNMENT The meeting adjourned at 7:18 PM.
