Minutes of the Meeting of the City Council of San Juan Capistrano
OCTOBER 16, 1967
The regular meeting of the City Council was called to order at 6:00 PM by
Mayor Edward S. Chermak.
The pledge of allegiance was recited. Invocation was given by Ernest A.
Thompson, City Administrator.
The City Clerk called the roll. Councilmen present: Don Durnford, Antonio
M. (Tony) Olivares and Edward S. Chermak. Absent: William A. Bathgate and Carl
E. Buchheim.
The minutes of the regular meeting of October 9, 1967 were approved as
presented.
WRITTEN COMMUNICATIONS
(a) Notice from California Legislature of Public Hearings on Congressional
Reapportionment - Informational
(b) Resolution, Orange County Grand Jury, regarding imporper and illegal voiding
of traffic citations - Informational
(c) Letter of Introduction from,H. Ayanian, District Engineer, Division of High-
ways, District 7, succeeding Mr. E. T. Telford. Mayor Chermak directed
City Clerk to send letter of congratulations on new post.
(d)
Letter from
Arthritis Foundation requesting permission to solicit for funds
on February
8, 9 and
10, 1968. This organization on approved list.
(e)
Request from Orange
County Association for Retarded Children to solicit for
funds November 1 to December 15, 1967. Councilman Durnford, seconded by
Councilman Olivares, moved that the request be referred to administrative
staff for study and investigation. Motion carried unanimously. City Attorney
volunteered to make cursory investigation.
(f) Letter from Glendale Federal Savings confirming pledge for completion of
improvements at San Juan Hills Country Club site. Discussion followed.
Councilman Durnford moved that the clubhouse be given temporary use and
occupancy permit with all utilities. Motion seconded by Mayor Chermak and
carried unanimously.
UNFINISHED BUSINESS
(a) Re: Special Parks & Maintenance District, Tract 59147 (Transamerica) -
Councilman Durnford offered Resolution No. 67-10_16-1 fixing and describing
the boundaries of a Recreation and Park District designated Casas Capistrano
Recreation and Park District. Passed, approved and adopted by unanimous vote.
Mayor Chermak then offered Resolution No. 67_10-16-2 calling and giving not-
ice for an election relative to the formation of CasasCapistrano Recreation

336 and Park District to be held the 5th day of December, 1967. This resolution
also approved by unanimous vote.
(b) Mayor Chermak requested postponement until the next regular meeting of second
reading of proposed Ordinance 131, implementing the Parks and Recreation
Element, for further study by Council.
(c) City Attorney, John H. Dawson, reported on group of prepared deeds in con-
nection with Assessment District 66-1, which he referred to Mr. Dick Bentwood
of Engineering -Science for obtaining of signatures of property owners.
NEW BUSINESS
(a) Contingent to approval of Tract Map 6427 (Mission Hills Ranch) at last
regular meeting, Councilman Durnford offered Resolution No. 67-10-16-3
accepting Grant Deed for Mission Hills Drive and authorization for recording
of same, subject to review and approval by City Engineer. Passed, approved
and adopted by unanimous vote.
(b) City Administrator, with verification of City Engineer that no contingencies
exist, requested exoneration of grading bonds for Mission Drive -In Theatre,
Tract 5947 (Transamerica), and San Juan Hills Country Club. Councilman
Durnford, seconded by Councilman Olivares, moved that these bonds be exoner-
ated. Motion carried unanimously and was so ordered.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
Stated that San Juan Capistrano Soil Conservation District annual report
is on file in his office and available for perusal.
(b) City Attorney, John H. Dawson
Anticipates action regarding LAFCO litigation around the middle of December.
Will keep Council informed as to details.
(c) Director of Public Works, T. J. Meadows
Mr. Meadows gave the floor to Mr. Dick Bentwood of Engineering -Science, Inc., —
who reported on progress of Assessment District 66-1 sewer job and recon-
struction of broken pepeline in San Juan Creek. Director of Public Works
recommended that no action be taken on repair of pepeline until he has dis-
cussed the problem with the City Engineer.
(d) City Engineer, Jack Y. Kubota
(1) Stated Tract Map 6427(Mission Hills Ranch) was released October 12,
1967.
(2) Has reviewed Freeway Agreement for Interstate No. 5, Route 1, and
determined that under new agreement, City must pledge to build all
local facilities at Camino Las Ramblas. He asked Council permission

to review with Mr. Morris Misbin. So granted.
(3) Reported as follows on construction programs:
A. Airport road paved and ready for final inspection; railroad
crossing safety devices now in working order.
B. Tract 6244 (Darmi) ready for paving operations. Proponents
planning to record map.
C. Finaling Del Obispo school site and Del Obispo and Camino
Capistrano jobs.
D. Received word that Stroscheins plan to move along with their
development.
(e) Councilman Durnford
Still concerned with junk cars near airport road. City Administrator stated
Building Department has been notified.
(f) Mayor Chermak
(1) Inquired as to the possibility of biweekly trash pickup. City
Administrator to review contract and report at next regular meeting.
(2) Has noted speedsters on new streets and suggested speed limit signs
be posted.
