67-1002_CC_Minutes_Regular Meeting329 Minutes cf the Meeting of the City Council of San Juan Capistrano OCTOBER 2, 1967 The regular meeting of the City Council was called to order at 6:01 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak. The minutes of the regular meeting of September 25, 1967 were approved as presented. WRITTEN COMMUNICATIONS (a) Minutes of Board of Supervisors relating their action on report submitted regarding restrictive policy relative to certain billboards along the San Diego Freeway - Informational (b) Letter from Supervisor C. M. Featherly inviting Council to participate in the Irvine Park 70th Anniversary Celebration - Informational (c) Letter from Mayor Jordan, City of Costa Mesa, endorsing the Orange County Celebrity Golf Classic to be held November 5, 1967, sample resolution enclos- ed. Councilman Durnford, seconded by Councilman Buchheim, moved to refer matter to Chamber of Commerce. Motion carried unanimously. (d) Release from Office of Andrew J. Hinshaw, Orange County Assessor, stating his reaction to contents of resolution of Board of Supervisors regarding agricul- tural land preserves for a tax basis, providing relief by deferment. (e) Letter from Governor Reagan's office acknowledging receipt of City's letter recommending Councilman Durnford for appointment to the Regional Water Quality Control Board No. 9. (f) Application for transfer of alcoholic beverage license from Colony Kitchen - Informational ORAL COMMUNICATIONS City Administrator, stating Mr. Vandling was in the audience, brought up the subject of Keystone Development Company request for waiver of underground utilities in their Division of Land 67-103. City Attorney to draw draft of appropriate agree- ment to present at the next regular meeting. UNFINISHED BUSINESS Councilman Bathgate offered Resolution No. 67-10-2-1 endorsing resolution of California Highway Commission and accepting recommendation of waiver of hearings on Coastal Freeway routing. Resolution passed, approved and adopted by unanimous vote. io-z-67 4 30 NEW BUSINESS City Attorney, John H. Dawson, received letter from Royal Street Development Company requesting information regarding formation of a Parks and Maintenance District. He is research matter for presentation at the next regular meeting. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) Received new freeway agreement between the State and City of San Juan Capistrano, superseding freeway agreement dated September 22, 1965. This new agreement includes Camino Las Ramblas interchange. Mayor Chermak ordered the matter referred to City Engineer for recommendation and report. (2) In view of legislation being finalized, recommended City Attorney draft ordinance implementing Darks and Recreation element. City Council so directed. (3) Mr. Caldwell, representing Glendale Federal, requested waiver of con- tingencies on San Juan Hills clubhouse project, these being the removal of three power poles and utilities being placed underground. After considerable discussion, Councilman Durnford moved that the developers shall proceed according to the original requirements of the development, as called out in City Ordinance. Motion seconded by Councilman Buchheim and carried unanimously. (b) Director of Public Works, T. J. Meadows Regarding break in AD 64-1 sewer line, checked with Flood Control to ascertain when and if they are to repair dike. Was informed they have no present plans. (c) City Engineer, Jack Y. Kubota (1) Made presentation on location of sewer line washout, and suggested the design engineers evaluate corrective measures for methods of reconstru- ction. Also, some arrangement should be made with Flood Control to clean out channel for a degree of insurance. With Council concurrence, Engin- eering -Science, Inc, is to proceed with report. (2) Re: DL 66-103 (Stroschein), has received copies of new instrument re- garding dedication of road. They have also offered new Grant Deed and assurance of improvements, but no bond in the amount of $10,000. City Attorney has also reviewed documents and finds them in proper order. Mr. Kubota then suggested that the matter be deferred to the next regular meeting. (3) Striping work continuing on Del Obispo and Camino Capistrano and Camino Del Avion and Del Obispo street improvements. to -2-(07 331 (d) Councilman Buchheim Inquired as to progress in cleaning up debris in Mission Flats. Director of Public Works to again contact Mission for follow-up. (e) Councilman Durnford Now that West side of Camino Capistrano has been paved, City should consider improving other side of street. He would like to see an engineering and cost report. Mayor Chermak directed City Engineer to initiate a study from area of the San Juan Creek bridge to Del Obispo. (f) Mayor Chermak Stated that the City has gained an industrial park, but also an automobile dump. City Administrator stated pieces are to be moved presently.
