SEPTEMBER 18, 1967
The regular meeting of the City Council was called to order at 6:01 PM by
Mayor Edward S. Chermak.
The pledge of allegiance to the flag was recited. Invocation was given by
John H. Dawson, City Attorney.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Don Durnford and Edward S. Chermak. Absent: Antonio M. (Tony)
Olivares.
The minutes of the regular meeting of September 11, 1967 were approved as
presented.
WRITTEN COMMUNICATIONS
(a) Letter from H. G. Osborne, Water Pollution Department, County of Orange,
inviting Council to attend meeting on the subject of water softening.
Agenda attached.
(b) Resolutions from the cities of Laguna Beach and San Clemente endorsing their
nomination of Don Durnford as a director of Regional Water Quality Control
Board No. 9 and requesting the Governor of the State of California to appoint
Mr. Durnford to this Board for a four-year term. Council directed that a
letter from the City of San Juan Capistrano, also endorsing Mr. Durnford,
be prepared for submittal to Governor Reagan, the office of the Regional
Water Quality Control Board, Mr. H. G. Osborne, Orange County Flood Control
District, and Alton Allen, Supervisor, Fifth District.
COMMITTEE REPORT
City Administrator, Ernest A. Thompson, Director of Public Works, T. J.
Meadows, and Councilman Don Durnford met with representatives of the Dana Point
Sanitary District regarding breakage of the ocean outfall line. Reports from the
engineering firms of Brown and Caldwell and Engineering -Science, Inc. were dis-
cussed at length. Council action on this matter was deferred for further study.
UNFINISHED BUSINESS
City Attorney stated that due to change in deadline date for publication in
Coastline Dispatch, Ordinance No. 130, relating to the anti -litter law, had not
been published within 15 days from date of its passage. Therefore, Councilman
Durnford moved that a second second reading of the ordinance be read by title only.
Motion seconded by Councilman Bathgate and carried unanimously. Councilman Durnford
then offered Ordinance No. 130, entitled "An Ordinance of the City Council of the
City of San Juan Capistrano Amending Section 3 of Ordinance No. 62 Relating to
Litter", for adoption. Approved and adopted by unanimous vote.

RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
As a result of research on the Greenlee request for Division of Land, he
found that Mr. Greenlee had appeared before the Planning Commission on
October 24, 1961 and presented a plot plan for stable and tack room. The
request was granted for an accessory building. However, no application for
a Division of Land was made at that time. City Attorney suggested that
Division of Land and compromise of litigation be handled together. Mayor
Chermak directed Mr. Dawson to take jurisdiction of the matter.
(b) Director of Public Works, T. J. Meadows
Recommended sewer connection fee for new E1 Adobe Plaza building to be in
the amount of $1,225.00. Councilman Durnford, seconded by Councilman Bathgate,
moved to uphold Mr. Meadows' recommendation. Carried unanimously.
(c) City Engineer, Jack Y. Kubota
(1) Made inspection tour of Alipaz Street with Director of Public Works
and Mr. Cappello, sewer contractor. Question arose as to whether the
City should take contractor's offer of money as equivalent for re-
surfacing, or let him restore pavement as best he can under the circum-
stances. Councilman Durnford, seconded by Councilman Buchheim, moved
that the contractor complete his contract and the City not negotiate
any reimbursement portion of it. Motion carried unanimously.
(2) Street improvements on access road to Mission Drive -In Theatre com-
pleted for some time. Recommended bond for this work be exonerated.
Councilman Bathgate so moved. Motion seconded by Councilman Buchheim
and carried unanimously. So ordered.
(3) Regarding proposed Camino Capistrano and Ortega Highway project, Mr.
Osborne advised that their water line improvement project is being
considered for Federal funding and that approval is not apparent until
October, 1967 with no construction to take place until March, 1968.
Asked if City should go ahead with street lighting, curbs and sidewalks
at this time and contract for pavement resurfacing next spring, notify-
ing water compay of a time certain. Council concurred with this
recommendation and requested City Engineer to proceed along this line.
(d) Councilman Buchheim
Again reported on irrigation leak on Del Obispo. Director of Public Works
stated matter being checked this week.
(e) Councilman Durnford
Reported on field trip to Whittier Narrows and Pomona Water Reclamation

Plants. His conclusion was that the City's plant, with very little cost,
could reclaim 90% of water that goes into ocean outfall.
