67-0807_CC_Minutes_Regular MeetingMinutes of the Meeting of the City Council of San Juan Capistrano AUGUST 7, 1967 The regular meeting of the City Council was called to order at 6:01 PM by Mayor Edward S. Chermak. The pledge of allegiance was recited. Invocation was given by Ernest A. Thompson, City Administrator. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford and Edward S. Chermak. Absent: Antonio M. (Tony) _ Olivares. The minutes of the regular meeting of July 31, 1967 were approved with one correction. WRITTEN COMMUNICATIONS (a) Notice of Executive Meeting for August, Orange County League of'Cities - Informational (b) The following reports were received from Administrative Office, County of Orange: (1) Review of Revenues - Charges for Current Services, and (2) Charges for Refuse Transfer Services. Council to retain brochure for future reference. (c) Letter from Orange County Disposal Association regarding Proposed Trash Transfer Tax. No action to be taken until further information is obtained. (d) Request from Transamerica. Development Company regarding exoneration of bonds, Tract 5947. City Engineer to report back to Council at next regular meeting. (e) Request from Mr. & Mrs. Girard V. Smith for reimbursement for loss of orange trees during improvements on AD 64-1. Councilman Durnford, seconded by Councilman Buchheim, moved that the matter be referred to City Administrator to handle in same manner as previous claims. Motion carried unanimously. TREASURER'S REPORT The list of cash receipts and disbursements for the month ending July 31, 1967 was presented by City Treasurer, Alice M. Ross. Councilman Buchheim, seconded by Councilman Bathgate, moved that the Treasurer's Report for the month of July, 1967 be accepted and filed for audit PLANNING COMMISSION MATTERS Motion carried unanimously. The Secretary of the Planning Commission presented Minutes of their meeting of August 1, 1967. Councilman Buchheim commended the Commission. UNFINISHED BUSINESS City Attorney rendered in full first reading of proposed Ordinance #129, relating to overtime parking and amending Ordinance #84. AP -7-61 305 RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson Advised that engineering firm for Sutro Company had paid for engineering and inspection fees for street improvements on Camino Capistrano and Del Obispo. He also stated excavation and construction is to commence August 10th. (b) City Attorney, John H. Dawson (1) In regard to condemnation proceedings on Assessment District 66-1, Complaint has been filed and papers are ready to be served. He is to personally contact Oyharzabal attorney. Dick Bentwood of Engineering - Science, Inc., to serve balance of property owners. (2) Is working on settlement of Greenlee AD 64-1 suit. (3) Talked with owner of San Clemente Sun -Post regarding Capistrano Shores Annexation suit. He then read article regarding proposed incorporation of Dana Point/Capistrano Beach published this date, which was in part erroneously written. (c) Director of Public Works, T. J. Meadows (1) Reported on Assessment District 66-1. Contractor expected in office August 8 to post bonds and sign contract. (2) Contacted owners (Old Mission) regarding rubble on property. Caretaker has promised to have crew in soon to clean up area. (d) City Engineer, Jack Y. Kubota (1) Tract Map for Tract 6402 released August 3rd. (2) Proceeding with design for railroad crossing to be presented to Santa Fe. (3) In connection with the project of resurfacing Camino Capistrano and set- ting up traffic signals, he has been advised that Waterworks District No. 4 will not complete their project before October 4. After consider- able discussion, Councilman Buchheim, seconded by Councilman Bathgate, moved that Mr. Kubota contact Mr. Osborne of the Flood Control District urging District No. 4 to complete their project before City starts improvement project. Motion carried unanimously. (e) Councilman Don Durnford Texaco station not living up to condition of maintaining public park on site. They should be put on notice that their variance is dependent upon the park. Mayor Chermak instructed City Administrator to contact proponents regarding conditions of the variance. (f) Mayor Chermak (1) Santa Fe trains have lately been blowing deisel smoke while passing through the center of the City. He directed City Administrator and 9-7-v7 306 City Attorney to put Santa Fe on notice that the City is objecting to this practice. (2) Noted influx of horses on city streets. Inquired as to how far the anti -litter law would apply regarding this problem. City Attorney is to research matter and report back to Council. City Administrator will also contact corral owners regarding policing of the area. (3) The American Legion Post has invited 100 Marine hospital guests to a steak dinner August 21st and invited Council to participate. Suggested Council meeting of August 21 be set at 4:30 PM as an adjourned session. ADJOURNMENT There being no further business, the meeting adjourned at 7:06 PM. Er est A.
